Tim Darnell and his wife Cathy Darnell just don't have the sense God gave a goat. The case in which the elderly Rep X sued Tim Darnell, Jack Weinzierl and Advantage Conferences dragged on and on as the lying paupers wanted to run up the legal fees and spend the dear friend of mine into giving up. Eventually as the attorney fees reached $80,000.00 that my family had spent helping her we decided to end the attorney fees by having me step in as Plaintiff and represent myself. I couldn't carry most of the causes of action as they could not be assigned to another party.

Tim and Jack had from day one tried to drag me and my truthful postings into this case about an Advantage Conferences rep seeking a refund. In an attempt to derail this case Jack Weinzierl had filed a fraudulent bankruptcy and been forced to withdraw it when the Department of Justice demanded more paperwork and hired an attorney to investigate and litigate against Jack's estate. Tim sued me and lost in the middle of this long case as well. That lie-filled frivolous suit ended up with my victory in Summary Judgment.

I went to all the hearings except the one's I declined to attend at the request of the Allen, TX police who were investigating Timothy Darnell for a felony. That felony investigation centered on the slam site www.heatherdobrott.com. I discussed it without mentioning JAck and Tim for months as we were under a gag order in Rep X's case against them. Jack's attorney wanted all the e-mails between Rep X and myself. Rep X's attorney requested the judge view them in camera as they contained attorney client privileged info. I wrote an Affidavit telling the judge they could not be released to Jack and Tim as the felony investigation was the subject of many e-mails and they would be tipped off about the ongoing investigation. A rogue clerk after being told the Affidavit was for the judge's eyes only released after filing it on the docket. Tim was alerted to the investigation. The police then decided to table the investigation as they feared he had destroyed all the evidence and seizing his computers as planned would have been useless after him being tipped off.

The only option I had to get that lie-filled vicious revenge site taken down was a personal suit. Now, I can discuss that openly. That site was taken down as were all the other posts I complained of in my original petitions. Tim Darnell has made a complete fool out of himself again in court and all of the filings will now be made available here. Tim Darnell's pro se filings are pure comedic gold!

Tim Darnell refused to respond appropriately to the lawsuit filings I made and skipped hearings with the judge. Check out the Motion for Continuance. Darnell's shenanigans have kept him in court for the last 6 years. The hideous, threatening and lie-filled postings attributable to him only stop or are taken down when he feels law enforcement is closing in as these filings demonstrate.

His lie-filled Motion for Summary Judgment was not accepted for filing after he mailed it to me because the court will not take such motions until after mediation is complete. For him to claim there was no outstanding discovery judging from his discovery responses and the Motion to Compel Discovery filed and scheduled for future hearing is beyond absurd. He lies without impunity and apparently knows no other way to live but lying to everyone and threatening anyone who dares to question him. Tim had meltdowns or complaints in front of the judge at every hearing he managed to attend and the court being unwilling to file his Summary Judgment precipitated one of them. The judge repeatedly told him that he did not know what he was doing and needed legal counsel.

What a complete idiot. Even if the court had accepted the garbage he tried to file, did he really think that would win the case for him when he had turned over almost nothing and was not responding as required by law??? Why didn't he immediately settle with me so these humiliating filings could have been kept private or better yet never been necessary at all? His wife has lived in Darnell hell for years now and there is no end in sight. Why does Cottonwood Creek Baptist Church allows Tim Darnell to have unsupervised contact with children knowing how dishonest and desperate he is?

Soup for Brains Darnell had skipped the 8/25/2011 hearing on the Motion for Continuance so the judge ruled in my favor. The order was filed on 9/ 3/2011. When Timmy got a copy of that and realized just how much trouble he was in he decided to make an appearance for the next hearing. I had warned him repeatedly that not responding to me at all and refusing to produce the requested discovery was going to come back to haunt him. I made it clear to him that his inaction and lie-filled filings would guarantee I got a continuance and it did. His habit of ignoring correspondence and skipping hearings was very detrimental to his case. I also sent him Requests for Admissions on 7/29/2011. As he didn't respond within 30 days of receiving them technically they were admitted and I could have won the case in Summary Judgment with those as a part of the evidence. My goal was to force Darnell to remove the slam site and posts about me and I got that. So, the Admissions were never used for anything.

Timmy in another one of his ding bat moments decided to file a Motion for Contempt against me because the fact we had not mediated was preventing his filing of the Motion for No Evidence Summary Judgment. However, I had told him flat out that I would not mediate until I had the discovery in hand and we could intelligently discuss where we stood. At that next hearing that he showed up for after the Continuance was ruled in my favor (due to his failure to appear after numerous notices) the judge finally blew her stack with him. She ordered we go to mediation immediately and told him in no certain terms his antics were over he had to have legal counsel. She declined to rule on my Motion to Compel stating she wanted mediation completed first and Darnell to procure counsel. She for the third time had to tell Darnell his garbage filings wouldn't fly. He tried to file an Objection to my Motion to Compel Discovery that was heard that day, but it was too close to the hearing to meet the filing deadlines and it like other hilarious, lie-filled rants was rejected and never heard. More filth in my e-mail box.

That poor clueless llittle idiot still doesn't understand he lost the case against the BBB and that that district court case loss resulted in Advantage Conferences being adjudicated a pyramid scheme. That was litigated agin in his losing case against me and still that fact eludes the poor little dummy. These delusional rants are comedic gold, though I think the one where he hallucinates a conversation with the non-existent head of the non-existent Pyramid Division of the Texas Attorney General's office takes the prize for the most outlandish filing in Darnell's long history of legal shenanigans. It must be chaos in there.

In order to stop that nutbag Darnell from filing or attempting to file anymore frivolous garbage motions the judge inactivated the case while we got mediation scheduled and attended the session. At that 9/16/2011 hearing Cathy Darnell became even more menacing and threatening toward me than she had previously been. It was so obvious to the bailiff that she was potentially dangerous that I was asked to stay in court with him until he could walk me out a secret entrance not available to the public long after Darnell and his clearly disturbed wife had left. From then on a bailiff escorted me out safely.

The first trial date came around and the judge who had already agreed to my continuance dates asked us to appear nonetheless. Darnell on the Wednesday before the Tuesday court date in a panic went out and secured counsel. He lied to this fine young lawyer and assured him that the case would be going to trial on the following Tuesday. I filed another emergency motion for continuance to clarify for Darnell and his new attorney that there would be no trial. His attorney, came for that day thinking he was going to be helping Timmy with procedural issues for trial and then be out. Darnell was visibly upset as his attorney and I worked out the details of moving forward using my filed scheduling order.

The attorney had filed a Motion to Quash the Deemed Admissions in a desperate bid to save his client who had totally botched the case. The idea of settlement immediately came to the forefront. I knew Tim was completely destitute and uncollectable and that the true goal was to get the slam site and his lunatic rants calling me a deranged stalker removed. Darnell had excellent counsel who was Ivy League educated did everything humanly possible to help him, Timmy didn't deal with him honestly. Tim has always in every case filed in the last 6 years (whether I was a party or not) tried desperately to get my truthful postings about himself removed.

Before we had any ink on anything Timmy removed all the postings on his sites about me and though he claimed he knew nothing about it the slam site, www.heatherdobrott.com disappeared as well. All his bargaining chips were gone, so I refused to sign a confidentiality agreement. He tried to con me into non-suiting him and yet letting him retain his imaginary claims against me, which I also rejected. Timmy then had his attorney demand I remove all my postings about him in exchange for him dropping his imaginary claims against me. Well, the idiot had already sued me and lost and he had filed no counterclaim in this case, so needless to say I refused. Tim is obviously unstable judging from his false claims of being stalked and receiving death threats, so no doubt he will always be up to no good.

The truth has always been on my side and I know he is flat broke and hopelessly snowed under with the delinquent tax suit on his home and IRS liens and God only knows how much more debt (borrowing toilet from the neighbors again?). He is nothing more than a laughing stock. So, I don't think there was any reason to go forward. I would win and get a judgment that I could never possibly collect. Tim's attorney is a fabulous attorney and really honest, personable guy. He, like Tim's last attorney, would have been stiffed tens of thousands of dollars and was already working for free I imagine, so I ended the case having gotten everything I wanted. I am not going to waste my life chasing around a delusional and dangerous pauper. Hopefully, now he and his wife will finally get the psychiatric help they need. Tim is obviously unstable judging from his false claims of being stalked and receiving death threats, so no doubt he will always be up to no good without serious intervention.

Those who have been following this sordid saga may recall that I stepped in as Plaintiff for the Rep X that sued Tim Darnell and Jack Weinzierl when they swindled her out of her life savings in Advantage Conferences. There was a gag order in that case, and as I was her local adviser, I and all the rest of the parties were barred from discussing the case and the other parties. Well, that slam site, www.heatherdobrott.com, was a clear violation of that order, and as the clerk's office had already mistakenly released an Affidavit I submitted for the judge's eyes only with e-mails between the original Plaintiff and myself and alerted the scammers to the criminal investigation, I filed a Motion for Contempt and asked for discovery on that.

The discussion of that in court had Jack puffy and red in the face and on the verge of tears. He cried out to the judge that he needed to be excused because he was going to be sick. The sniveling little wimp ran out the door to go vomit. So, that tells me just how involved Weinzierl really is. Tim Darnell's Ivy League attorney, that he conned into helping him long after he completely botched the case that I had filed against him and kept secret, implored him to clean up his act as that slam site could have gotten him a felony conviction. Imagine my surprise when, just hours after it disappeared, I got the following e-mail from a very flustered Jack who has obviously been obsessing over and completely fixated on the slam site.

There is the thread about that hideous slam site. Notice I did not name who I sued and in the early posts did not mention Tim or Jack as we were all under a gag order.

Remember all those provably false and previously litigated claims of me sending death threats and stalking people? Continuing the sordid saga of the lying scammer from hell we should discuss the wild tales Darnell told his attorney. He skipped the hearing for the Motion for Continuance held on 8/25/2011 even though he had numerous reminder e-mails and I had proof of service to the clown by registered mail. The judge ruled in my favor and set out the dates in my scheduling order. Darnell was told we had to submit a scheduling order at the Motion to Compel hearing on 5/13/2011 and had refused to respond to me since then except for garbage motions and one e-mail bragging of being in NY and promising to respond when he returned to town. As he wouldn't conference on a scheduling order and had turned over only a minute fraction of the requested discovery I had to formulate everything myself and his skipping the hearing guaranteed that my dates would be used. The judge asked me to submit the following Order and dates and Darnell received them when I filed them on 9/3/2011.

I had mailed him the requests for Admissions on 7/29/2011. As I had already filed the Motion for Continuance, knew Darnell was not responding and that we would never have discovery complete before the trial date that was tentatively set by the court, it was a given that the continuance was going to be granted. Darnell got quite the chewing on both 9/12/2011 and 9/16/2011 about responding to me from the judge. One should never skip a court date that they have had numerous notices about. It really pisses off the judges and hurts one's case. And, one should do everything to work out discovery and scheduling disputes before coming to the judge for help. Tim Darnell's indifference and arrogance was his undoing in court to be sure. 9/16/2011 is when she ordered us to mediation and blocked us from filing anything in order to keep that nut from filing more garbage motions and responses. She was fed up with telling him he could not file things outside the time limits and get them heard and he could not ignore correspondence from me. She told him she would not entertain any more of his antics and that he must secure legal counsel.

Tim Darnell didn't have the good sense to end this charade in mediation, so in a panic as the ignorant fool still didn't understand the trial date had been moved, he hired Mr. U and completely misled him about everything. I told the Ivy League educated lawyer that taking Tim as a client was a mistake. Mr. U said he had only agreed to help with procedural issues at the trial that Timmy said was scheduled on 10/20/2011. As Timmy was such a nuisance the judge ordered us all to appear that day anyway. Timmy had refused to pick up registered letters containing filings and had skipped hearings in addition to his obvious inability to accept reality and report anything truthfully. So, his poor attorney was handed a pile of exaggerations and outright lies and based on those filed Defendnat's Motion to Quash Alleged Deemed Admissions and Alternatively to Undeem Admissions and Set Aside. Darnell should have immediately responded to those admissions and the correspondence he was getting. Those could have easily won me the case in Summary Judgment if it had come to that.

Darnell's attorney came in and we know what happened. Darnell panicked and pulled everything off of the internet that I had included in my original petition. So, why would I bother continuing a case against that lying pauper. He is not collectable. I would much rather watch the taxing districts enforce the lien on his home for delinquent taxes and / or the IRS nail him by garnishing his sleazy wife's salary and / or foreclosing on their 3 liens on his home. His millionaire lifestyle is going to end!

I love the last page where Darnell signs under oath that the facts in that motion are true and correct. He knew the trial date was March 28, 2012 and none of the dates in that motion based on the original trial date were correct when that was written. He knew he had turned over almost nothing. There was no volume of discovery and the judge would have nailed him on that lie and the Motion to Compel Discovery would have been ruled in my favor as well as he wasn't making any effort to turn over anything and what few things he thought he might have had were withheld. It doesn't work that way. Again, Darnell has no grasp of the law. He knew that he hadn't misfiled the paperwork. The arrogant prick just didn't want to bother to respond and was far to stupid to understand how horrific the consequences would be for not responding to the Requests for Admissions. So, he had to bully his lawyer to file that lie-filled motion in less than a week after taking the case. But again, why fight this any further in a court of law when I have the wonderful court of public opinion at my disposal. The brainless idiot has given me everything I wanted and totally humiliated himself once again in court. As usual I am getting the last laugh! Will Timmy ever have the moxie to respond here???

I think a hard look at this hilarious and lie-filled response is in order. As to # 1 he is outright lying. I was banned for 3 days at Scam for sticking up for a poster that objected to Len Clements being made an administrator. I left and George Dranichak permanently banned me when I came here as he perceived this (wrongly) to be a competing forum. Timmy talked George into removing the posts I made as hundreds of other scammers have done as well with the right threat or proper incentive.

As to # 2, to use discovery for any other purpose than the lawsuit at hand is abuse of discovery. I have never done that in any of the 3 cases we have been tangled in together. Unlike Darnell, I followed the judge's order to return all discovery to the producing party. I am still waiting for Tim to do that for the previous case we were in concerning Advantage Conferences.

As to # 3, any pictures online are ones that Timmy himself had posted publicly and I shared. Very poor judgment on his part to use his children's names and images, but if he does so he can't complain if people comment on them as he himself invited it.

As to # 4, if Timmy could prove I "continually and grotesquely distort facts and fabricate damaging assessments about every aspect of Darnell's professional, personal, family and spiritual life," then he would have won his suit against me filed in June 2008 and he would have filed and won a counterclaim against me in the past eighteen months when he could have done it for free in the case we are now discussing. No court is going to withhold discovery from a Plaintiff (me in this case) because a delusional Darnell has his panties in a wad! He should know that from the previous cases where the judges routinely ruled against him.

As to # 5, I am not abusing discovery. Darnell turned over not even a fraction of what was requested and we had not had the hearing on the motion to compel said discovery as I had already for all practical purpowon. You pulled down everything and more than I requested in my original petition. And, you can bet I am still e-mailing like crazy Darnell. I will not sit back while innocent people are defrauded from a slick con like you. Christian Millionaire Mentor my @$$!!! I non-suited him because he is a freakin' pauper and I would waste months more in court chasingyou when I couldn't collect in Texas. I would rather watch and see if the IRS or taxing districts take Darnell out. Those folks can collect and / or take castle Darnell!

As to # 6, Numerous attorneys have looked at the case Darnell's Advantage Conferences filed against the BBB and lost.

All relief as between Advantage Conferences, LLC and Better Business Bureau of Metropolitan Dallas, Inc. not expressly granted herein is denied.

The attorneys who had actually read the case documents had no trouble figuring it out. You boys (Darnell and Jack Weinzierl) stiffed the attorney, Sandifer, well over $20,000.00 and his lack of preparation in that case Darnell is referring to was quite apparent. Did he forget the BBB put the pyramid scheme notice up about Advantage Conferences, continued to note that its advertising was being reviewed as it was misleading and reported it had sued them and lost in Summary Judgment.

If Darnell could have proven that Advantage Conferences was not a pyramid scheme and that his case had merit ( i.e. he could find even a single false statement by me) he would have won his case against me. That has already been litigated and cannot be re-litigated, so he is hosed on that one. The truth is Advantage Conferences was a pyramid scheme!!!

As to # 7, Darnell is really pissed that he can't silence a legitimate critic with his threats and vicious lies. Every dirty tactic he has employed against me has back fired and made him look like the lying dirtbag that he really is. I don't cater to scammers!

As to # 8, the police were investigating that site as a felony and believed Darnell was behind it. They were about to seize his computers when the investigation was outed by the Collin County Court inadvertently. They noted there were numerous proxies used and were tracing those. So, no doubt there were also phony e-mail addresses used as well. Darnell is dirty, but certainly not stupid. Jack's meltdowns tell me he knew more than he was sharing and that he was the one obsessing and panicking over that site.

As to # 9, Darnell knows full well the information about that slam site could not be uncovered prior to filing a lawsuit. Legitimate companies don't turn over their records without a court order or subpoena. One must file a proper lawsuit or be a member of law enforcement to get that. Darnell, apparently believed he had covered his tracks very well.

As to # 10, Darnell knows discovery doesn't work that way. He can't respond at his leisure or predicated on something being proven conclusively first. If he really believed that the subpoenas from the NJ hosting service only showing a fake e-mail address and proxy server IPs would excuse him from further discovery he is indeed a lunatic. He has no understanding of the law. He was spared sanctions and a judgment because I didn't want to devote another year and thousands of dollars to chasing a lying pauper. He removed everything I requested in the original petition and then some. I triumphed over him again. Darnell is just a complete moron, liar and loser. His nonsense has wasted untold tens of thousands of dollars in law enforcement investigations into numerous legitimate complaints and the courts being clogged up with his cases.

Darnell has always postulated that he had claims against me and through his attorney kept up that laughable mantra. I refused to sign anything his attorney cooked up as Timmy had already removed everything I had litigated against him to have removed and I would never sign anything preserving his imagined claims. By closing the lawsuit with a non-suit without prejudice to refiling I took away his one chance to litigate those claims with a free filing as a counterclaim.

Of course, since he sued me and I won, he is going to have to find fresh material as he will not be able to re-litigate things that the court has already addressed. So, come on Darnell let's hear about all your claims. You can posts all about them here for free! What are you waiting for scammer boy? It is free. That is the only price you can afford.

By the way, have you thrown more correspondence from the IRS in that trash? I can't wait until your wifey, physical therapist Cathy Darnell gets garnished for the $97,265.17 IRS tax lien that was the direct result of you two love / scambirds tax protesting together. The couple that scams together stays together???

Thank you for this summary SBM. I have tried to get a picture of this in my mind's eye for a long time and you have come up with what appears to be a first class "abstract" of the case. WELL DONE YOU!

The abstracts were so complex that it took a very specific mentality to unravel anything. I was too impatient to read it carefully.

I will publish a link to your abstract of the Tim Darnel case when I start promoting my own web pages that I have been forced to put on ice for almost four years. The Smirnow thugs did their best to claim that my attempts to be an effective naysayer were unreliable. They claimed that my domain path2prosperity was part of Smirnow's pathway to prosperity Empire. They were wrong and time has proved that as fact.
