The fact some pseudo MLMs do so, and have done so in the past or some people have made money by "getting away with it" for a period of time has no bearing on the fact the FTC defines the practice as a pyramid SCHEME (not pyramid SHAPED scheme).

So, I pay in for one downline member in the amount of $47 and them give away the $47 position / package (100 worthless pieces of crap) to others to infinity. From there is it nothing but endless recruiting with each new member paying money upline. There is simply no way to have any retail sales whatsoever.
