I've had more than a few people tell me that Chris Johnson is "going to be charged in federal and state court soon". No longer possible, the Statute of Limitations has run, not only has she beat the rap, but if, as I strongly suspect, she did manage to keep some money from the scam hidden, its hers to keep now.

Charis Johnsons' 12 Daily Pro was way back in 2006.

A lot has changed since then, the launching of the Financial Fraud Enforcement Task Force, being a major step forward.

It's no coincidence, in my opinion, that every subsequent major ponzi prosecution has involved one or more members of the FFETF.

With the SEC, FBI, Homeland Security, IRS and Secret Service being major players in the task force, the strategy seems to be to use the SEC emergency civil action to halt the / a ponzi scheme and freeze the assets, allowing other members time to collect the evidence necessary to ensure the criminal case which follows is a slam dunk certainty.

IM(very)HO, it's also worth noting while Johnson / 12DP faced only civil securities violation action, which can only result in administrative fines and disgorgement, virtually all criminal charges preferred since then have been for fraud, wire fraud, money laundering and conspiracy, which result in financial penalties AND incarceration.

I'd have to disagree with Gregg.

IM(very)HO, Scoville is looking down the barrel of at least 6 to 7 years in a Federal gaol, on top of what eventuates from the SEC action.

The SEC had to do an emergency freeze due to Charles moving as much money as he could into his personal bank account. They were afraid he was going to move it into foreign bank accounts that would have made it harder to seize. At the time of the asset freeze Charles was in the UK, and he had bank accounts there as well as in Dubai. They have plenty of time for the criminal investigation to be conducted, and I think they are waiting until the civil case is heard before any criminal charges will be filed. Having a conviction in the civil case makes it easier to obtain a guilty verdict in the criminal case. His TM was not selling securities and members were not investing defense is eliminated.

When Charles said he was going to fight the SEC action I knew he had boxed himself into a corner. He had to portray himself as a martyr fighting against the "Evil SEC" to his followers, while at the same time knowing in court he would have to tell the truth, and finally all his members would learn the truth he had been lying from day one of launching TM. Now he has compounded the issue with the donations to his legal defense fund which was based on a total lie, which is taking money under false pretenses. Depending on how much money was totally donated, this could possibly be another civil felony charge. We won't know what the final charges will be against him until no more appeals and the SEC is ready to go to trial. I am expecting more charges against him by the time this gets to trial.

I just hope the Appellant Court rules soon so we can move on to the civil trial before summer. In the meantime, Charles will ramp up his inane posts trying to bolster his I am not fit to stand trial as I cannot participate in my own defense ploy he is trying to pull off.

As far as Scamville's sad attempt to influence his fitness to stand trial.

As I understand it:
At the time of the crime was he sane?

If found unfit now, he will be committed until his caretakers find him sane.

The trial resumes, then he still has to serve his entire sentence.
(a very valid argument can be made that turd for brains Charlie doesn't need to be present for a trial on the merits)

If they find him unable to function in his defense, then he would be ordered for treatment and then upon completion of the treatment and certified competent, then the trial would be scheduled.

I'm pretty sure that competency issues only apply in criminal cases and in a civil case wouldn't come up. Certainly won't come up as to the company, which is the main defendant in the SEC case instant.

But back to criminal charges. The Statute of Limitations on financial crimes is, depending on what they may charge him with, is from 2 to 5 years, so for some charges its half run already, they would only have until this summer to bring the charges. Obviously, the charges that go 5 years gives them more time, but again, name me any major "program" where the admin was charged criminally, in which no agency outside of the SEC was involved in the investigation prior to the SEC bringing a motion for C&D etc.... because I can't find one. Anyhow, the crazy defense (according to the lovely DME, sitting here with me over the eggs) doesn't apply to a civil case, you can be as nutty as a Snickers Bar and still get sued for commercial acts.

I'll bet Ice Cream in Times Square for any Thanksgiving Weekend that we don't see criminal charges. The drop dead date for when they would have to indict him is August 1st, 2021, but if they were going to do it, and they don't within a few weeks of when the civil trial ends (not counting the appeals, just the first trial court verdict), its not going to happen. And if anyone knows of any involvement by any agency besides the SEC, I'd love to hear it, its not something they'd be keeping secret at this point, and is absolutely mandatory to any future criminal prosecution. The US Attorney isn't going to take a 2 year old civil case and ask the FBI to go digging, its just not how these things work.

And speaking of people who stole a few million bucks and walked away without ever seeing a criminal case, when Ray Charles could see she was guilty, my own favorite neighbor, Nancy Jo Fazier!!! (I can't believe she slipped my mind) Another reminder that just because pretty much everyone agrees an admin is guilty, and a civil court makes them pay through the eyes for it, they don't always get charged with a crime.

Nothing happens.

He was mentally competent at the time of the offences and was mentally competent at the time of the upholding of the SEC complaint, as evidenced by the fact he clearly understood the charges and could advise his legal representatives.

The SEC CIVIL action, which resulted in the appointment of the receiver is totally and utterly separate from any resulting criminal action

Sorry for the confusion, but I am talking solely about the civil trial and his ploy to appear he is incapable of participating in his own defense to delay the start of his civil trial. You have to remember this is all an act. It is just for show. He knows once the civil trial s tarts everyone will know he has been lying since day one about TM and what TM was all about.

No such animal, a felony is a class of a criminal charge, a civil charge is just a civil charge, in some states they have "Over $25,000" or some other amount, but a civil case is just about money and injunctions to not do stuff, and a felony means people can go to jail (for more than 180 days)

We won't know what the final charges will be against him until no more appeals and the SEC is ready to go to trial. I am expecting more charges against him by the time this gets to trial.

Absolutely not, I would buy the idea that they may wait until the civil trial is over, but the appeals could run years, hell, decades, and the statute of limitations started running out the day the Receiver took over and any criminal charges have to be brought before a Judge one way or another (either an Indictment or a Criminal Information) within that statute of limitations date, which could be as short as 2 years but is definitely not more than 5 years.

Although most of the programs that make big headlines are shut down with civil charges and the criminal case is brought later, that's actually backwards on how the trials work out. Most of the time, the SEC asks for and gets some kind of order that stops the activity and turns the business over to a receiver, and then some time after some other agency brings criminal charges and a criminal case proceeds. The civil case, most of the time, isn't that big a deal, they usually don't fight too hard to stop the receivership and that for the most part is a concession of the civil side. The final disposition of the "Civil Case" actually was after the final criminal disposition in all the big cases I can think of, Andy Bowdoin went to jail before the receiver closed up shop, as did all the other people in ASD.

Charles is different because he's

A) Not obviously being investigated by any agency besides the SEC which cannot bring criminal charges
B) Is actually fighting the appointment of a Receiver, and still trying to maintain that running a Ponzi Scheme is perfectly proper and legal the way HE was doing it.

B above is the novel part, most people, when caught red handed, don't try to say they didn't do it. Chili Dog tries this when the plate of bacon is missing and she's on the dining room table, and is less obvious.

Really, every time I get drawn into thinking about Traffic Monsoon and Charles Scoville, I think of another reason he's never going to be charged with a crime, and the more speculation I see on how he's acting crazy to avoid it, the more I'm convinced that he's not faking it, and he doesn't need to. He's batshit crazy, and he's going to get away with it.
