The SEC can only file Civil cases. If the SEC wants to charge someone with a crime, they go to the Justice Department with their case; and, the Justice Department or the U.S. Attorney's office will prosecute.

In the US only a 'prosecutor' (ie. District Attorney [DA], etc..) can file criminal charges. Even a Judge can not file charges (except for contempt, basically) against someone.

Okay, but every SEC case I've been involved in ALWAYS ends up in criminal charges, so there's that. I get the feeling they don't even bother unless they can get a criminal prosecution out of it.

'ALWAYS' means without exception.
I'm pretty sure that if I did enough digging I could find at least 1 (one) US Federal Court case in which criminal charges did not follow a SEC civil case.
Instead of the word 'ALWAYS' may I suggest using the words, 'most often'.

At this stage, the focus is on protecting the assets
This can't be done as easily if the charges are criminal and not civil.
In a civil court, the assets can be frozen and therefore protected.
In a criminal matter, the defendant is presumed innocent until proven guilty, which can take years, giving him / her the opportunity to conceal or dispose of the profits of crime
TM is stopped, the assets are protected no more damage can be done, stage one of the mission has been accomplished
The only thing necessary for the triumph of evil is for good men to do nothing

I sincerely apologize if I offended anyone. My point is, in my experience, the SEC doesn't file a lawsuit unless they have enough evidence to convict someone criminally. They don't "get" anything out of it, and the resources expended are large. They're not just doing this for the fun of it, and I'm sure they've already put a hold on Charles' passport. If he somehow escapes to Dubai, he'll be captured eventually.
In the meantime, let us all bow our heads once more with Sunil, and contemplate the meaning of a scam.

Yep, even through I'm not really up on these kinda cases. I do believe that the amount of monetary returns to the participates is something like, maybe 15% of the initial investment.
If that, it mainly depends on the funds/assets that are recovered.

I hope he runs, the crazy could only get better. I would say it will be a long weekend for Monsooners to see if he comes home, but these folks have waited for six months, been shown they were lied to and still think its all good.
Charles seems almost delusional in some of his responses, it would not surprise me if he really figures he has this thing beat. If he had a stack of loot and an escape plan why keep running his mouth for the past month other than to be a jerk? He could have faked his death or claimed total body paralysis and these saps would eat it up.
Then again, maybe he is riddled with guilt and looking forward to a slap on the bum while showering with Kevin Trudeau in club fed?

Hey, ribby, seems like a losing proposition trying to figure out what is going on in his obviously malfunctioning cranium! reminds me of an English Literature professor I had in college. One of her assignments was to look at Van Gogh's "Starry Night" painting and write what we thought was going through his mind. Now this was a guy that took a straight razor and cut off his own
ear! Sounds like a job for a Psych Major to me!

Like night follows day, this long period of will he / won't he speculation follows every SEC civil action against ponzi / pyramid fraud and fraudsters.
It should be remembered, the SEC is part of the much larger Financial Fraud Enforcement Task Force.
I'm in no doubt Scovilles' passport has been flagged and the other agencies involved in the FFETF are on the case as we speak
