Scoville can continue to construct, then tear down strawman arguments such as there being enough money to pay members, user agreements and Paypal being the cause of his problems etc all he likes.
The fact is, neither he nor Traffic Monsoon are or were licensed to sell securities.
No matter what sort of verbiage he uses, the AdSurf Daily, 12 Daily Pro, C.E.P. Zeek Rewards etc, etc, etc are all examples where the courts have chosen substance over style.
The use of the words "fraud" and "fraudulent" in the SEC complaint is in no way accidental.
IOW, what Scoville "says" happened bears no relation to what the SEC "knows" happened
They (SEC) have the records and Scovilles' own testimony, they're not guessing
They "KNOW" 99.6% of income came from the sales of "ad packs"
They "KNOW" Traffic Monsoon had no outside source of income
They "KNOW" Traffic Monsoon didn't and couldn't deliver the amount of ads it claimed
Therefore they also "KNOW" what Scoville said was fraudulent and was designed to defraud

But... as I understand it (ok, only from what Charles told the SEC), about 8,000,000 of these ad-packs have already expired - ie already paid out (mostly in imaginary compounding) ?
His numbers say that 6,000,000 were pending and 1,000,000 active...
Yep that's still heaps more money than TM has... but not $531 M ?

btw... "Shirley Scoville", supposedly Charles' mother, has just joined the TM Refund Support Group that I'm an active member of.
Clearly it's not his mum... and the style of writing, and the content does sound very much like the man himself.
There's been plenty of debate with "him", but he hasn't said much of interest on there, refusing to "argue the case". If he does then I'll report it back here...

There is no other possibility than imaginary back office balances showing millions of ad packs. Some of the 8M ad packs would have been paid out of the $207M, most would have had to be rolled over or Monsoon would have already collapsed.

Scoville's testimony also says he "shared" $600M. We know taking in $207M there couldn't have been 6M packs in existence plus 1M more active, another 8M that somehow expired and got paid in cash is beyond the realm of possibility.

If people understand the implication of calling 8M packs "advertising" is they get ZERO money back you are correct.
A scenario where people believe their total ad packs represent real money the SEC is holding is much more congruent with their actions. In the case of a collective 8,000,000 ad packs being expired my best guess is these folks think they are/were due some portion $440,000,000. Add 7M active and pending ad packs to all those that weren't paid out with expired packs and we have a fairly large number.

UPDATE
The United States District Court for the District of Utah originally scheduled a hearing on the SEC’s Motion for a Preliminary Injunction for September 23, 2016. New counsel for Mr. Scoville recently entered an appearance in this case, and the hearing has now been continued by the Court until November 1, 2016 at 10:00 am.
The Receiver is continuing her investigation. She intends to file an Initial Status Report with the Court shortly. When it is filed, she will post it on this website.

One thing I wonder is if folks like Sunil and Sharon James claiming to have 10,000 packs actually had that number? Sunil had about $100,000 in referral commissions which would purchase 2000 ad packs, did he really buy another $200,000ish and compound them over seven months? Likewise, it was claimed James was broke, but had a few hundred thousand in recruiting commissions. Did she really reinvest everything? Or was this a put on to entice others?
Scenario one - lying about 10,000 packs and $10,000 per day in earnings doesn't bode well for the advertising claim in the least.
Scenario two- these idiots are actually out hundreds of thousands of dollars (LOL if true) and are still going to have to explain why they "compounded" a service.
Either way the SEC is going to eat their lunch.
