This is probably the number one question that pops up when people start to see the lucrative potential with this kind of activity, and it's certainly the first thing that I wanted to know too... after all, I have no interest in getting into any type of legal hot water, and I'm sure you don't either, so here's what I found out.
In researching this activity, it's important to keep in mind that there's no book out there that tells you what is legal in our society, only what is not legal.
If you do your research online, you're going to see there's really nothing saying that cash gifting is illegal. Most of the time it's people expressing their personal opinions, not facts. And after years of experience and thorough research, no one has been able to show me the law in black and white stating that giving a cash gift is illegal.
In fact, I learned that both American and Canadian citizens have the Constitutional right to gift property, cash and other assets. Many other countries participating in cash gifting also have very similar gifting laws.
In the United States we have the Preamble, the Constitution and the Bill of Rights to protect a private citizen's rights to earn, pay taxes and give away property and cash as long as it's done according to the laws and codes of this country. The U.S. gifting rules are found in the IRS Tax Code, Title 26, Sections 2501-2504 and 2511.
In 2008 in the United States of America, the law states that one or more individuals can give a cash gift to another individual of up to $12,000 (now it is $14,000) each per calendar year without any tax liability to either the giver or receiver of the gift, because the tax on the gift has already been paid.
I also found that most well organized Cash Gifting programs require each participant to use some form of a Gifting Statement and/or Non-Solicitation form, which when signed, become binding agreements between two private individuals. These forms are used, it's said, to ensure the longevity and legality of a gifting program.
So giving a gift of cash to someone, be it a friend, family member or a stranger is legal according to IRS code. Again, there's no specific nation-wide law that I've been able to find to say that cash gifting is not legal.
Now, that being said, it's important to note that not all Cash Gifting programs may be legal in their structure. (these would be the ones the mutants at Real Scum are referring to, NOT THE PEOPLES PROGRAM) Certainly there are some that may not be. Unfortunately, there are still some "old school" Cash Gifting programs out there (mostly offline) that weren't structured properly in order to sustain their efforts for any considerable length of time, and some of them use an illegal pyramidal type of structure.
Consequently, many of these types of mostly offline programs in the past were closed by the feds because of this illegal "ever-widening base" pyramid structure and gave Cash Gifting a bad reputation. (not to mention the bad reputation the LIARS and HATE TRIBE at Real Scum are trying to single handedly give to cash gifting!)
However, in recent years, things have changed and more and more people are benefiting through the use of these types of programs than with any other structure in the World.
SUMMARY BY BRAD KAMANSKI: It is dangerous to label or say that ALL cash gifting programs are illegal. And quite frankly it is stupid and ignorant! Commonplace for ALL members at Real Scam! However, the Internet has become a breeding ground for HATRED of successful people who try to help people experience the true freedom of pursuing a Work From Home lifestyle! Never Participate In Cash Gifting Without Knowing These 3 Things!
Three things You MUST know before sending someone a cash gift:

The most important thing you need to know when participating in a cash gifting activity is:
1. Are they REAL and are they SERIOUS?
You must know who you are participating with. He or she must be approachable. This means they need to answer their phone when you call, or at a minimum call you back that day if they were busy when you called.
They should also be able to be seen. This could be as complex as video chatting with them or as simple as them having a video of themselves posted on their website.
Both them answering their phone and letting you see them shows you that they are a real person and are not hiding behind some website. You can see we have a phone number that we answer and on the front page of this site a video of Brad.
If they are serious about this activity they will also have some form of Live Chat on their website. I am not saying they need to be on 24/7, but they should have a daily times that they are “manning” their website to answer any of your questions. When I say Live Chat, I mean LIVE! Not some program that gives you canned responses, I mean, me typing in the chat window answers to your questions.

The Second thing you need to KNOW before you participate in Cash Gifting is:
2. What level of participation is right for you?
This is very important. While we believe in this activity and know that it works, rather well as a matter of fact, we do not want you to gift your rent or food money to get started in this activity. In fact if we acertain that you are gifting us your last bit of money, we will not allow you to do that or participate until you are in a more stable position.
On the other hand if the money you are able to use in this activity is not money you need to survive then you need to figure out and KNOW what level is right for you.
This means if you have $1500 ready to gift but it is all you can gift, consider gifting a lesser amount to start out. Say start out at $1000 and keep $500 handy in case you decide you want to do a postcard mailing or some other form of participation to attract other like minded people. Another good reason is to have something just in case. In case, your car needs a tune up or you have to buy a tire, or in case, you have an unexpected bill pop up.
The third thing you MUST know before participating is:
3. What will you do when you receive money?
This could rank as the most important “MUST KNOW.” The reason I say that is, this is what is going to keep you going.
Will you use it to get out of debt? If so don’t just think about paying off debt, think about how it will feel when you can answer your phone without having to worry who is on the other end. Or what it will feel like to not have to send money out to any company each month.
Maybe your plan is to help others in your community. That is great but take the time each day to visualize what that means and how you will feel doing this. Will you help the homeless with a meal or some warm clothes? Will you make anonymous donations to you child’s school? Picture whatever you will do, daily.
I will not tell you what is the right thing for you to do, I can not possibly as I don’t know what drives your heart, but I can tell you that if you believe in the laws of Abundance and the laws of Attraction, you will have no problem giving part of the money you’re going to receive to strangers. Sayings like,”What goes around, comes around.” are out there for a reason.
Ok, so those are the three things you MUST know before participating in any Cash Gifting Activity!

It sickens me to see what this person did to you on the scam report website. He put your phone number and address on this website and he even put one other persons name and phone number on the website that joined your new cash gifting program.
Do you know the name of the person that did this to you or can they do this anonymously so you don't know their identity?
Is this hurting your business? The reason I ask is because I have two people interested in your cash gifting program. They did what a lot of people do. They google your name and saw what someone said about you on the scam report. I spent 30 minutes on the phone with each of them telling them what they read was a bunch of crap.
One of them believed what I said because he has been doing network marketing for a long time. The other guy didn't believe one word I told him.
Do you think this will hurt my response rate on the postcard mailings? The reason being with the internet about 50% of people who receive my postcard are probably going to google your name.
I am hoping people are smart enough to realize that much of the information on these scam websites are not true. However, from my experience it seems that there are a lot of ignorant people out there that believe everything they read.
MY RESPONSE:
The problem with the article is that they did a FAKE sign up for The People's Program at the $10,000 level to acquire my Name and Address. The RULES of the forum say that they can only use info found in the public domain. Well, that info was NOT in the public domain so they violated the law. I really wanted to go on there and defend myself but it can really backfire.
It has NOT hurt the program because I always explain to people that they are hiding behind FAKE names and if people will go through the forum they will find articles about thousands of good people. I think it is a crime. I could go on there and say that I had a hacker discover their true identities and found out they were pedophiles and that is why they use the FAKE names but they are friends with the Owner of Real Scam and she would take my posts down anyway. She has been sued several times for liable but it never sticks. Sad sad truth.
Another thing that really miffed me is that the one clown said I have Jesus on my team. Well, he is going to find out one day just how powerful my Team Mate Jesus is when it comes to judgement...Brad
