Biggest China Job Scam Ever - Robs Foreign TEFL Teachers Via "Probation Period" Fraud!

This is the mother of all China employment scams stealing over $1 million every month from about 500,000 expats now working in China. This scam requires collusion between unethical China job recruiters and the actual employer, who if caught will just blame the recruiter! It works like this...

Well, consider all the newbie applicants for China jobs from abroad are being told the following lie... "You will receive 50% of your full pay during your 90 day probationary period". Unless they are signing a 3 year contract, this is 100% illegal. China labor law as amended now says:

"Probationary periods of employment cannot exceed 1 month for each year of employment specified in the labor agreement"

There is also no provision for "reduced pay" for any amount of probation period - unless the employee waives their rights and agrees to the illegal terms in their contract. And it is absolutely false what some recruiters tell people "You do not need a Z visa during your probationary period". According to the U.S. Embassy and SAFEA you cannot even tutor privately without a Z visa without breaking the law. See: http://answers.yahoo.com/question/in...2182642AAIiMXz

Also foreign employees are never told that according to Chinese Labor Laws "professional workers" (including expat teachers and expats with FECs) and "new mothers" cannot be compelled to work unpaid overtime hours "without consent". On average a foreign teacher in China works about 20 hours a month of overtime that they are not getting paid!

If you add up the phony 50% probationary period deduction and the unpaid overtime, many expats are forfeiting 25%-30% of their wages every year out of plain ignorance of the law! Google key words of "China, probationary, period, pay, scam" to get more info about other abuses of the "probationary period" in China by some unethical players. You can get free copies of the amended labor laws by contacting the Ministry of Labor, SAFEA, or visit the National Library but they are in Chinese. If you want them in English (but translation may only be 90% accurate) visit Home or send them an email.
