Trend Sound Promoter AMG Corp. filed a Motion for Declaratory Judgment on February 26, 2014 in the Second Judicial Court of Leon County, Florida. When some one publishes false information about a company under state and federal law that is called “Defamation”.
Under federal and state law a person is free to publish their opinion about a company. This right to free speech is protected, If the information is true. It is against the law for someone to intentionally write and share information publically that they know is false with the intent to damage the company.
The people who are spreading the negative information about TSP must hide behind false names and hidden identities because they know what they are saying is not true and would not stand up in court.
On April 1, 2013, the Florida court entered a default judgment. The court found that what was posted in RealScam.com is false and the person who posted it broke the law. They knew this would happen which is why they did not say their real name. If they “know” that TSP is so bad why are they afraid to step up, say who they are and let the facts show the truth.
Since court after court is ruling against them for spreading lies they have now started threatening and scare people and using their own faith against them. They do not care about the truth or what you believe they only care about what they believe and what they want you to do. Below are some of the documents from the Florida Court Ruling.

Problem with their headline is they never proved what exactly was defamatory so how could there have been a decision, much less in their favor?

The mention of "suing RealScam" made in the Trend Sound Promoter" announcement is a classic case of kite flying.
The action taken by Trend Sound Promoter was against a defendant known as "Anonymous John Doe" IN THE STATE OF FLORIDA and NOT against RealScam.com
In fact, Trend Sound Promoters own PLAINTIFF’S MEMORANDUM OF LAW IN SUPPORT OF MOTION FOR ENTRY OF A FINAL DEFAULT JUDGMENT IN DECLARATORY ACTION
points out quite clearly on page #10:

After they manipulated court through public announcement in local Florida newspaper that there is a CASE against Anonymous John Doe,
claiming by that the defendant was served.
Their plan was that nobody ever respond to it and court will grant them a judgement by default.

The Plaintiff asserts that the defamatory speech, which the Plaintiff seeks a declaratory speech on it, is commercial defamation and is expressly not political speech, but speech related to tamping down competition within the competitive space.
3. The Declaratory Judgment sought herein is only a declaration by the Court that the
defamation within control of Florida courts is, in fact, defamatory.
The early posts on that thread were made by folks with hundreds or thousands of posts here and across the internet. That makes the posters anonymous consumer advocates who are involved in exposing financial fraud. There is nothing to suggest that any of the posts that are included in the filings were made by a competitor. Strike one TSP and the sleazy attorney they hired.

A. Minimum Contacts
14. The allegations contacted in the Plaintiff’s First Amended Complaint allege that the Defendant has caused to be published defamatory non-privileged statements in Florida via the internet.
15. Florida Courts have held that a Defendant has sufficient minimum contacts with the State of Florida if the Defendant commits a tortuous act in the State of Florida. In Price v. Kronenberger 24 So. 3d 775; (Fla 5th DCA 2009), the Fifth District Court of Appeals held

Levinson, 648 So. 2d 240, 243-244 (Fla. 4th DCA 1994) stated that a: “Connecticut resident could reasonably anticipate being haled into Florida court where he sent a defamatory letter into Florida … that was “designed to have an effect” in Florida”.
In this instance, the Plaintiff has alleged that the Defendant through the anonymous posting of defamatory, non-privilege statements via the internet, published on Google.com, via a live URL link to Realscam.com, within the State of Florida. Applying Price and Silver, the Defendant has met the minimum contacts test for the Plaintiff to obtain long arm
jurisdiction pursuant to Florida Statute 48.193(1)(b) if the Plaintiff actually knew who Defendant Anonymous John Doe 1 was and where he was located so as to perfect in personam service. Unfortunately that is not the case here. In other words, a tort was committed in Florida, directed into Florida and the res, which is the defamatory statement,
is digital property (or, if printed, a written instrument) present in Florida and subject to the jurisdiction of this Court.

The attorney for that nut, Don Holbrook, tried to twist case law to her liking and was laughed out of court. I would bet this attorney has taken great liberty with the minimum contacts and if an answer was filed would see this case dismissed just as quickly as the one against me in Ohio was..... almost instantly!
And, saying these posts are not "information with general public interest" is ludicrous.

I would say the 'affidavit of diligent search and inquiry' is a bogus document especially since they couldn't quote one false statement posted.

I'm guessing they did this to prepare to request that Google deindex RealScam pages about TrendSound Promoter. If that's true, then if somebody actually responded to their lawsuit it would throw off that gameplan. Again, just a guess on my part, but it seems like that's what they're doing.

Absolutely! Obviously TSP isn't bright enough to figure out that RealScam might not be receptive to being delisted due a a lawsuit filing that for all practical purposes appears to be possibly fraudulent. I have an alarming habit of moving and renaming threads and starting new ones when it suits me, so how is it they think they are going to keep discussions about their opportunity off of the first page of Google? I love a good fight and do have a bit of experience in that regard.

Since the only notice they referenced in the ridiculous court docs was a newspaper of some sort in Tallahassee, I am sure you have found the Defendant somewhere in there! LOL!!! I would bet the method of providing notice would be shown to be improper should a licensed Florida attorney answer this bogus suit. Seems TSP will do anything to avoid having a response filed doesn't it?

Elements of Defamation
Under Florida law, the elements of a defamation claim are:
- the defendant published a false statement;
- about the plaintiff;
- to a third party; and
- the falsity of the statement caused injury to the plaintiff.
Houston we have a huge problem. There has not been a single false statement of fact identified and properly refuted, so therefore there can be no defamation. If no defamation has been proven to exist then how can we have any injury? The filing doesn't substantiate this alleged injury either from my perusal. So the filings by TSPs legal eagle looks quite like a steaming pile of dung.

The Defendant posted the Digital Defamation anonymously and
the Courts jurisdiction arises from its “equitable chancery jurisdiction” and is

The TSP scammers didn't make any effort at all to find the posters on these fine threads. They even argue it doesn't matter where our fine posters reside. They could have come on here and published notice and used the private messaging system. TSP did not want any response to their garbage filings. They counted on this lawsuit flying under the radar and assumed no one would notice the results had fallen off of the Google listings. No such luck.

Thank you for wasting your time to try to bring down the scammers that decided to create trendsoundpromoter.com! Around July 2013, my friend presented me with a work from home oppurunity, that'll only take a few minutes a day and will earn me $0.40 per email, The more I invested in the company (I mean purchase "Ad-Promoting Package"), the more I would earn. This was last July.. I told him I'd pass on the oppurtunity.. Then he calls me up 2 weeks ago and pratically begs me to signup under his Promoter link.. I asked him what was going and he told me that he isn't meeting his 3% Music Sale requirement and the only way he can do that is is to signup a new promoter. Otherwise, he'd get terminated as a TSP Distributor.
This company is a huge ass scam and the only reason the government hasn't shut it down is because their taxes look in order.
Trend Sound Promoter sends a 1099-MISC form at the end of the year reporting how much money Trend Sound Promoter paid you. And TSP reports to the IRS they generated this much in revenue, paid out less, they make profit and all seems in order.
I honestly don't know how they continue to operate and why the government hasn't stepped in.
The State of Washington REQUIRES all businesses to report a actual STREET ADDRESS (e.g not allowing a PO BOX for a business location). Trend Sound Promoter doesn't actual rent, lease, own or have ever stepped foot in the "Corporate Offices" they claim to have in Miami FL & Bellevue WA. Can the Washington Secretary of State / Department of revenue require them to list their actual business location?

They filed quite the hilarious motion. TSP hopes the judge will agree that the reps they have defrauded will only get e-mails instead of snail mail as they apparently think the postage for sending out 5000 notices would be staggering.

I'm not going to demand anyone visit my website or call me but I will say victims need to contact Sarah at sarah.flynn@usdoj.gov. All I have as evidence is what has been posted. She needs first hand knowledge of the workings. It needs to be done now. I only suggested they look into the workings of this before just granting bankruptcy.
