(1) without obtaining the other person's consent;
(2) with the intent to cause a recipient of the communication to reasonably believe that the other person authorized or transmitted the communication; and
(3) with the intent to harm or defraud any person.
(c) An offense under Subsection (a) is a felony of the third degree. An offense under Subsection (b) is a Class A misdemeanor, except that the offense is a felony of the third degree if the actor commits the offense with the intent to solicit a response by emergency personnel.
(d) If conduct that constitutes an offense under this section also constitutes an offense under any other law, the actor may be prosecuted under this section, the other law, or both.
(e) It is a defense to prosecution under this section that the actor is any of the following entities or that the actor's conduct consisted solely of action taken as an employee of any of the following entities:
(1) a commercial social networking site;
(2) an Internet service provider;
(3) an interactive computer service, as defined by 47 U.S.C. Section 230;
(4) a telecommunications provider, as defined by Section 51.002, Utilities Code; or
(f) In this section:
(1) "Commercial social networking site" means any business, organization, or other similar entity operating a website that permits persons to become registered users for the purpose of establishing personal relationships with other users through direct or real-time communication with other users or the creation of web pages or profiles available to the public or to other users. The term does not include an electronic mail program or a message board program.
(2) "Identifying information" has the meaning assigned by Section 32.51.
SECTION 2. This Act takes effect September 1, 2009.

Don’t mess with anyone in Texas online. Effective September 1, 2009, a new Texas law makes it a crime to engage in various activities on commercial social networking sites or by e-mail, instant messaging etc. You can read the actual text of the bill below. Although self-explanatory (to lawyers at least), it seems pretty clear that Texas lawmakers don’t want people impersonating others on the Internet in order to harm, threaten, intimidate, or defraud anyone. The law also covers text messaging. Note that depending on the activities involved, the crime can be either a Class A Misdemeanor or a 3rd degree felony.

All of this would be relevant IF Fiedur wasn't running a site which openly promotes, and accepts payment from, illegal HYIP ponzis and get-rich-quick schemes.

We can go 'round and 'round the mulberry bush all day long and talk about everything else under the sun and it STILL wouldn't alter the fact he does what he does AND accepts money for doing it.

While it might make interesting reading for those who like a bit of bullying with their breakfast, the point remains, in the unlikely event this saga should ever make it into court, Fiedur would have to prove to the satisfaction of the court that what he does IS legal and above board and that he had undertaken sufficient due diligence to prove it so.

Everything else is froth and bubble.

In what countries has Bogdan, Bernier or Bachman any legal representation?

Bachman promotes LGNProsperity as the Humanitarian bank based in Lagos and there may be a connection in Israel. Bernier offers degrees in computer science and other subjects to the poor in third world countries.

Has Bogdan's friendly society got solicitors who can represent them in all these countries and languages? My father was a solicitor before World War2. He spoke several Slavonic and European languages fluently. My mother who was born in South Africa had a smattering of Zulu and Afrikaans. I can remember a few words like the Zulu word for SNAKE and an Africaans word beginning with F.

In addition UK law defines harassment/Cyber-stalking as follows

Harassment In this legal guidance, the term harassment is used to cover the 'causing alarm or distress' offences under section 2 of the Protection from Harassment Act 1997 as amended (PHA), and 'putting people in fear of violence' offences under section 4 of the PHA. The term can also include harassment by two or more defendants against an individual or harassment against more than one victim. Although harassment is not specifically defined it can include repeated attempts to impose unwanted communications and contacts upon a victim in a manner that could be expected to cause distress or fear in any reasonable person. The harassment of another or others can include a range of offences such as those under: the Protection from Harassment Act 1997; the Offences Against the Person Act 1861; the Sexual Offences Act 2003; and the Malicious Communications Act 1988. It is important when considering this type of offending to look at all relevant legislation when formulating charges. Closely connected groups may also be subjected to 'collective' harassment. The primary intention of this type of harassment is not generally directed at an individual but rather at members of a group. This could include: members of the same family; residents of a particular neighbourhood; groups of a specific identity including ethnicity or sexuality, for example, the racial harassment of the users of a specific ethnic community centre; harassment of a group of disabled people; harassment of gay clubs; or of those engaged in a specific trade or profession. Perhaps you can tell Bogdan's solicitors that there are plenty of British members whom you will expose, if Brit's persist in supporting Fiedur's scams. Perhaps Bob Vaughan will explain what it means to be an Adlander Plus and a Gold Member.
