    A terrible tragedy has occurred and if Nicole Kish is guilty she should certainly pay the price. My heart goes out to Ross Hammond's family. Justice, however, must be served for both the victim Ross Hammond and the convicted, Nicole Kish. Was Nicole Kish wrongfully convicted of second degree murder? What role did George Dranichak play in the tragic events that transpired and ended with his friend and employee Ross Hammond losing his life?

    On the stand, George Dranichak admits that he and Ross Hammond had responded with vile and sexually degrading comments, such as demanding oral sex for the money and numerous other names that were equally obscene and demeaning. As well Dranichak acknowledges that it was the comments made by him and friend Ross Hammond that fueled the ensuing confrontation that was to take place.....

    In addition, George Dranichak was caught lying about his past criminal record during cross-examination. While attending college in the state of Kentucky, George Dranichak was arrested for breaking into another person’s dorm and severely beating the individual, of which to resolve the issue, George Dranichak paid a fairly large monetary sum to the person he had assaulted. As he was on the stand however, George Dranichak tried to allege that his criminal record belonged to his father of the same name, until at last abandoning the idea after the notion was proven absurd by the defense.

    “One of the ways they [the media] shaped the case [is that] Nicole was always referred to as the panhandler despite the fact there was absolutely no testimony that she was a panhandler,” said Bivens. “Contrast this with the portrayal of George Dranichak, purveyor of porn, and his business associate Ross Hammond, whom the media referred to as internet marketers.”

    George Dranichak is an owner of a multi-level marketing porn company, which manages such sites as Uncaged Marketing and Guerrilla Traffic. Also, it came to light during the trial that while attending school in Kentucky, Dranichak settled out of court after violently assaulting an individual after forcing his way into the person's dorm. Being someone who runs a pornography marketing company and has a history of violence carries entirely different implications than being an “internet marketer,” and might have provided a very different narrative to the public discourse. However, these elements of Dranichak’s character were left out of media coverage.

    Adult-Site Employee’s Suspected Killer Bailed Out

    Woman free until court date for second-degree murder charge.

    TORONTO - Ross Hammond, who worked in the accounting department for adult site Guerilla Traffic, reportedly was stabbed to death by four panhandlers on Aug. 9 on Queen Street West in St. Catharines.

    All four alleged murderers were arrested, but Nicole Kish, 21, who was charged with second-degree murder for Hammond's death, was released on bail Tuesday afternoon. She also was charged with aggravated assault against Hammond's friend and co-worker George Dranichak, who was walking with the murdered man at the time of the stabbing.

    Kish is scheduled to appear in court in the next few weeks, when dates for her preliminary hearing and trial will be set.

    U.S. citizens Douglas Fresh, 22; Jeremy Woolley, 21, and Faith Watts, 22, were charged with aggravated assault. Woolley also was charged with assault causing bodily harm and obstructing a police officer.

    Police said Hammond, a 32-year-old resident of St. Catharines, was stabbed after refusing to give money to the panhandlers. The attack reportedly began when Watts slammed her bicycle into Dranichak's knee. Police said Hammond was stabbed eight times, but the preliminary report didn't identify who stabbed him.

    Toronto police are in possession of the knife used to stab Hammond; witnesses reportedly saw Kish holding the weapon.

    Dranichak reportedly escaped the scene in a taxi cab while Hammond was being beaten. Asked for a comment, Dranichak told reporters that he is working very closely with police and "is not really allowed to talk about the case in any way.

    "I lost a very, very close friend, and I need time to mourn," he said. "I can't give out anything else; there's an ongoing investigation and I'm a part of it. I'm sorry; that's all I can say."

    Sgt. Gary Giroux of the Toronto Police Department told AVN Online on Thursday that the investigation is "continuing," and that Fresh, Woolley and Watts were being detained on "immigration holds" and face criminal charges.

    "I know that it is ironic that the people not charged with murder are still in [jail and] the one that was charged is out, but ... the greater immigration hold, regardless of if they are granted bail, still holds them in custody," he said. "Even if they are granted bail, the holds will still take precedence over the release. They will appear in the next week or so in court again, or biweekly with regards to re-mandates. They are certainly entitled to a bail hearing, but it is a bit of a waste of time in the sense that if they are granted bail - and quite frankly, they just might be - they are still detained and will ultimately be sent back to the United States."

    Giroux said Kish's bail was $160,000 and had "numerous" conditions.

    "She is basically on house arrest and she must stay at a relative's home," he said. "She cannot leave the home unless she is in the company of one of the individuals who has signed for her - one of the people who have put up money.

    "Community members and the family of the victim are very upset about this verdict - that Kish has been set free - and have been voicing their opinions within the local papers over here," Giroux continued. "The defense council portrayed Kish as a nice girl. And when that happened, the father of the victim, Bruce Hammond, said something like, ‘Well, let me tell you what a nice young man my son was. He will get no second chances and he is confined to his grave.'"

    Toronto Sun reporter Joe Warmington told AVN Online on Thursday that "it's not uncommon for people to be let go on second-degree murder charges here."

    "There is a strange rumor circulating," he said. "I am not sure if there has been an arrangement made with Nicole Kish's family, who might have received decreased charges for their daughter in exchange for keeping the fact quiet that Hammond worked in the adult industry."

    According to Santa Cruz police spokesman Zach Friend, Watts is a transient with a lengthy criminal record that includes multiple crimes committed within weeks of one another.

    Ross Hammond's father, Bruce Hammond, said he and his slain son's wife, Kara, were displeased with the news that Kish will be free until her court date.

    "Sure, we are pissed off," Bruce Hammond said. "Sure, we are mad. I am not really sure what we can do about it. What can we say? Do you want me to say she shouldn't be walking the street? My son is still dead."
    Knowing that George Dranichak actually produces porn and from my experience is exceedingly dishonest, I would not be at all surprised to learn he provoked the altercation.

    Justice was served.
    Yet no one actually saw her do it
    But it was her knife and that was enough for the judge.
    The conviction of Nicole Kish, the young Toronto panhandler who got into an argument with a tourist who gave her lip outside a club, and in the resulting brawl between two male tourists and four panhandlers (who came to Kish’s aid), Kish’s knife was used, and Ross Hammond was killed.
    It was tragic event all around, but the court decision is a very dangerous precedent for the future of justice in Ontario.
    Not one of the twenty eye witnesses the prosecution brought forward saw Kish kill Hammond, or could testify against her.
    But it was her knife, and that was enough for the judge. She was convicted of 2nd degree murder.
    Maybe she did stab him. Maybe she didn’t.
    That she had a knife, as a woman, living on the streets of Toronto, shouldn’t surprise anyone. (Unless you’ve been there, you don’t know what the hell you are talking about.)
    But to convict her simply because she had a knife pushes the idea of guilty beyond its legal limits.
    The onus must always remain on the prosecution to actually prove, beyond a reasonable doubt, that their accusations are true.
    I don’t care if you think Kish was just a waste of space, as many people think panhandlers are. I don’t care if you assume she did it. That is beside the point.
    That the prosecution could not prove that she did it – even when they brought forward 20 eye witnesses, but then have the judge convict anyway, is not the practice of law in a democracy.
    A tragic incident, should not be followed up with a shameful decision.

    I wonder if she will appeal? I know if I was her I would. I think there would be a good chance of having this ruling overturned. But then I don't know what Canadian law says about appeals, etc..

    Here is a short quote from a witness whose testimony the judge considered in his decision to Convict Ms. Kish:
    When the street car stopped at Niagara, Mr. Paget heard yelling from outside. He saw two males in a fight at the front of the street car. One male was preppy looking with short hair and the other had long hair with street fashion clothes and appeared to be a street kid. The preppy male had the upper hand in the fight. The fight moved to close to where Mr. Paget and Ms. Stopford were sitting on the street car which was about seven rows back from the front. The fight continued.
    [26] Mr. Paget saw a female come up to the fight and the fight ended shortly after she arrived. He described this female as also dressing in street fashion. Mr. Paget had seen this same female with another female in front of the street car when he first noticed the fight. He says that she was able to stop the fight by getting the preppy guy off of the street kid but he did not see how she did that. He also saw the street kid pulled to the sidewalk where he was lying on his back. Mr. Paget next saw the preppy guy to the west of his location on the road and then saw him on a taxi. He says that the preppy guy was extremely agitated and that, at one point, the guy said "who's next?".
    This testimony does suggest that the young man was beaten unconscious by the murder victim and that the individual wielding the knife was using it in an effort to defend this young man.

    Crown witness George Dranichak deeply regrets the way he and Ross Hammond reacted to a panhandler, agreeing with a defence lawyer’s suggestion that they were “stirring the pot” with their profanity.
    He was testifying in Ontario Superior Court on Thursday at the second-degree murder trial of Nicole Kish, 24. Kish has pleaded not guilty to fatally stabbing Hammond, 32, early Aug. 9, 2007, after an altercation on Queen St. W.


    “I don’t want to embarrass you, but there were some pretty rotten things said by you and Ross,” defence lawyer John Scarfe said in court Thursday. Scarfe then listed several nasty epithets as Dranichak, 38, sheepishly agreed those words were said.


    “There isn’t a day I don’t regret, definitely regret getting those girls angry,” the witness said.
    Dranichak has testified that a woman on a bicycle — a friend of Kish’s named Faith Watts — had approached him and Hammond, a work colleague he considered his best friend, at a bank machine on Queen and asked them for $20.


    After Hammond suggested she sell herself for sex, the situation went from “zero to 100” in seconds, Dranichak said Thursday. Watts started screaming and a crowd of people, including some of her street friends, “materialized.”


    “The impression on the street was you and Ross started this?” Scarfe said.
    “We never laid a hand. We were attacked,” said Dranichak.


    While Hammond was a consummate professional at the Internet marketing company where they worked, he could also be a “little stubborn” and “seemed to like having the last word,” Dranichak said. “Just like they didn’t want to be disrespected, we didn’t want to be disrespected.”

    • Free Nyki A factum is (in this case) a written outline of the mistakes in the verdict along with the testimony that supports it. It is what the Appeals Judges will read to learn about the case and to give them background for the oral arguements. If the Judges agree that there were mistakes Nyki could be granted a new trial.

    36. Provocation includes, for the purposes of sections 34 and 35, provocation by blows, words or gestures.
    I have no legal background, but looking at the law in Canada I think George Dranichak with his perverted demands and vicious verbal assault provoked those young people. I think they may have only done what had to be done to protect the vulnerable young women in the group that night. How did George not get charged with assault after what he said? It was so bad the papers have had to paraphrase it quite a bit from the numerous reports I have read. I bet the reporters had to use the Urban Dictionary to clarify all of it so they could do so. I can't believe George was out there behaving like that with a wife and kids at home waiting for him. If George had a daughter would he want her treated like he treated those young people? Would he film his duaghter for his websites and talk about her the way he does about his other "girls"?

    How Living by my Values Got Me Framed with Murder

    How dangerous the life I led was to them, and how foolish I was for believing they would allow it. A rejection of the state of society, for five years I led a life in the fringes. A life in squats, in forests, on beaches, in buses and communes; shopping from dumpsters, growing food, driving on grease, riding trains, doing demos, tree-sits, volunteering, and denying any substantial contribution from my capable self to the capitalist system I abhor, I wore a uniform of dissent.
    I was labeled many things, from hippie to autonomist, vagrant to punk, and in hindsight, I was all of them. Officially, I denied them all believing society ought not have the right to package who I am and what I believe in into a word, an ‘ism’ or an ‘ist’ to be distorted and manipulated. I rejected even the term activist, as to be an activist implied an option to not be. Everyday was a protest, of private property, materialism and inequality, and a celebration of the sub-culture I was member to. Both my duty, and the only life I knew how to lead capable of satisfying my morals and values, there was no coherent option for me to support the main ranks of this hierarchical society whose dominant values I find criminal. Non-compliance coupled with the promotion of radical change through the growth of sub-culture was my past, and I loved it. When warned, as I often was, of how I was marginalizing myself, and of the dangers in doing so, I protested that whatever treatment I received by society, kind or cruel, was only an example of the state of its health, and that I would take it as it came. Well take it I did, an example I now am, though the force with which it came tests my strength everyday.
    Though the facts and details of the state’s corruption and the abuse I have suffered by its hand are harrowing in themselves, for the benefit of this perspective I will only summarize, as the larger question of why things happened as they did deserves attention.
    In short, I was used; my freedom stolen and identity manipulated, no- mutilated, to form the means to the very corrupt political ends I lived against. I was framed with a murder that I very clearly and demonstrably did not commit, in the case cited (before it was tried!) to prompt the enforcing of legislation that outright criminalized panhandling, under the safe streets act.
    The highly publicized, sensational story police and media doled out was that I, (a local panhandler) stabbed a tourist to death because of a denial of a request for money. I was labeled the ‘panhandler killer’ nearly instantly, and by global media, literally from here in Ontario to Malaysia.
    Unfortunately for the police and media alike, their claims held no truth. Yet with the long pushed agenda of criminalizing homelessness now justifiable, the ‘panhandler killer’ had to exist. Not one party thought to consider the validity of their bold claims, and especially pertaining to police (and eventually prosecutors) – not even when strong evidence began surfacing to the contrary.
    And why? How could several separate human beings rationalize the persecution of a person very obviously innocent? This question has grayed more hair on my head than the process its self, and ultimately, only one sad conclusion holds logic.
    By my appearance and by my lifestyle.
    My difference negated any compassion I may have otherwise garnered had I been considered the young women I was. Instead my dreadlocks, piercings, tattoos and pack evoked a dissociated mentality in them about me, plainly that I was guilty in anyway; if not of murder, then of being no good. Lead detective Gary Giroux often and openly referred to my company and I as ‘those people’ in the early stages of the case. Yet Giroux is far from alone in this fault.
    Hatred is the product of ignorance and historically the rebellious, the opposers’ of blind authority, and seekers of change have always been subject to be ostracized and criminalized (both openly and under many masks of unrelated reasons). For threatened by what many personalize, people view a rebellion against parts or portions of society as rebellion against them personally. By this and along side such social conditions as judgment, hierarchy and stereotyping, disregard, dissociation and hatred are easily fostered. Intentional abuses then become more easily rationalized and as abusers disregard the humanity of others, they begin to do so under the distorted perception that it is acceptable. Acceptable in defence of ‘their’ society, and especially acceptable when there is a substantial gain or profitable end to justify their means (abuse). Needless to say, in the circumstances in which my radical life met their corrupt but powerful political influence and agenda, their ends did (to them) justify their means, even though their means involved utterly destroying my life and manipulating the investigation of someone’s death to an irreparable extent.
    In hindsight, I stood no chance. The facts were clear; the evidence was exculpatory. But evidence was ignored, altered, and a substantial portion was destroyed, and after three and a half years on house arrest, by judge alone trial I was convicted of murder and sentenced to life. In his verdict, the man who embodies the patriarchy in society that I am against voiced his distaste for people like me, though in an attempt to mask his claim under the fallacies by which he convicted me. He declared with a sneer that in the name of degradation I ought to serve more than the standard time. That I was not a rebel, but a danger, and that society needs to rid its self of such people. And just as healers and midwifes past heard ‘witch!’ As they met their flames of hatred, so did I as I met mine. But to rebel is not to be dangerous (physically); just as to be hurt is not to hurt. Yet to descend from the norm, to reject all this madness is and always has been a sentence, though a worthy one to bare.
    For as long as I have been opposed to anything, the institution of prison has been high on my list. Now, an abolitionist imprisoned, and wrongfully, I have joined the long held tradition of non-conformist being punished for non-conformity, and that alone.
    And clearer now than it ever was is that the prison is not an institution of reform, despite all its claims, but acts solely as an insurance policy of the capitalist machine to obtain membership and revenue from all who would otherwise not contribute (in the preferable means and amounts).
    Here no help is offered. Here is a constant battle to keep any dignity and strength we can guard intact. To live by the morals and values I hold is more difficult here than it ever was; for in prison, non-compliance is condemnation. With out a warrant, my actions often prompt jailers to remind me that I am no candidate for parole. For parole, one must not only be guilty and sorry, but must acknowledge the prison experience reformed or bettered them in some way. And it does not, and I will not.
    They have taken everything I love. They did so intentionally knowing well that I did not kill anyone. They have taken all from me that they can, but from my bunk in my cell, where I am confined nineteen hours a day, I know that what they yearn to take the most they will never have; they will never take my spirit, nor sway my beliefs and values, which are against them.

    Nicole Kish or Nyki to those who know and adore her is a talented singer songwriter, artist, poet, and dedicated community activist. Over the past few years, Nyki founded a non-profit organization dedicated to improving literacy and educational opportunities within Ontario’s correctional facilities. As well she co-founded Bound for Glory, a not for profit arts and literary magazine for talented and neglected artist. Sadly however, on March 1st 2011, Nyki was wrongfully convicted of 2nd degree murder for little reason more than that she was there and she was stabbed. Dismissing the complete absence of positive identification, the confession of a former co-accused in regards to having pulled the alleged fatal knife, the lack of any DNA on Nyki and the copious amount on others, and the two separately “lost” surveillance videos gone missing in police custody, which have been alleged to have captured the events of that night, the judge successfully undermined this country’s core judicial principal of having to achieve beyond a reasonable doubt for obtaining a conviction. In fact the defense breached that thresh hold in proving here innocent. In short, backed by a media complacent with the “official” yet inconsistent story of Detective Giroux and the crown, an innocent young woman temporarily if not indefinitely lost her right to a beautiful life. Nonetheless, an appeal is being put forth and we plea to all who have a good heart and poses a care for true justice to support Nyki through these dark times and to demand her release/ ultimate acquittal.

    Review of the evidence

    George Dranichak:

    Chronologically, it only makes sense to begin with the evidence of George Dranichak. George Dranichak is a liar and a coward.

    He left his friend. The only explanation he has for that is that he got beat up, and when he got up after, he thought Ross Hammond had abandoned him.

    He says that because of the pain he experienced in the attack, he didn’t stick around. He hailed a cab and went back to the office. When Ross wasn’t there, and when he didn’t arrive shortly after, he did nothing to locate his friend. He slept in his car. In the morning, he says he called in sick and went home. He says he assumed RH went back to the Big Bop to hang with his friends so he didn’t worry about him. After what happened, this seems a little preposterous.

    Mr. Dranichak made it pretty clear he couldn’t afford to get arrested. He is an American on a work permit since 2002. He has a house, a wife and two small children here. He does not wish to lose the right to live and work here. So he abandoned his friend.

    The defence has received disclosure. We agree that he telling the truth about going out with some other fellows from work that night. He is also telling the truth when he says he and RH broke off from the group and ended up at the Big Bop watching a band from St. Catherines.

    The defence also agrees he is probably telling the truth when he says that he and Mr. Hammond were approached by a girl on a bike who asked for money at the TD bank.

    He says he and Mr. Hammond were rude and very, very inappropriate in the vulgar, profane and insulting things they said to this girl. He was asked about some of the things he and Mr. Hammond said. For the most part, he agreed with all of it. I will not repeat the words these men used here. It is already in evidence.

    Clearly, he and Mr. Hammond were drunk. They could have just said no and walked on. But they didn’t. They called them a number of names and hurled insults at them. It was offensive. And it offended some of the other persons in the vicinity who immediately approached as a result of an escalating verbal dispute.

    He describes Faith Watts as the instigator. She was aggressive, persistent and would not leave it alone. He went on to say she was screeching, screaming, swearing, insane and psychotic in her protestations. He said her face was sweaty and she appeared as though she was on, or coming down off drugs. This dovetails with her admission that she had injected an oxycontin that night.

    He felt that, from the perspective of people on the street, it looked like he and Mr. Hammond were picking on the kids.

    He also made it clear that RH was stubborn. He was lecturing them saying things like “you don’t know who I am.” “you don’t know what Ive got” and words to that affect.

    He said Mr, Hammond just wouldn’t leave it alone. He was lecturing the kids.

    He clearly acknowledges that it may have appeared as though Mr. Hammond was taunting Ms. Watts and the other people on the street.

    He says the group grew in number very quickly.

    “It seemed like us against all of Queen Street.”

    At one point he agreed that there were as many as 15 people in the immediate vicinity.

    He told the police that he crossed the street and Ross Hammond followed. He never went farther west than a few doors from where he crossed. He is sticking with that story.

    He then says that he was suddenly and viciously attacked by a girl on a bike in front of a restaurant south and slightly west of the TD bank. He testified specifically, using the name, that it was Nicole Kish who ran her bike into him. This is quite impossible. Leave aside for a moment that there is no evidence that NK had a bike. What there IS evidence of is that she was wearing an ankle-length skirt. She could not possibly have ridden a bike into him as he claimed. After this, he says, he was down, being beaten by others, until he got an adrenaline surge and was able to get away.

    He doesn’t seem to care that nobody believes him when he says he only went as far west as he said he did.

    We know from numerous witnesses including Shaun Park, Mystica Cooper, Laura Quiggley, etc…… (fill in) that he was seen going all the way to Q and N.

    Despite the obvious fabrication, the Crown had no choice but to call him. He was the only link to the narrative before Queen and Euclid, and the only one who could explain why Ross Hammond was walking west on Queen Street that night.

    But because he lies, because he refuses to tell us what really happened after the TD bank, we will never know. Clearly there is something about this story he is afraid to tell.

    As a result of his insistence on sticking with his original story, we will never be able to piece together his role in the massive confusion that exploded at Queen and Niagara that night.

    What really happened to him when he and Mr. Hammond were unable to get on the streetcar?
    Did he just drift away and watch from a safe distance?
    Did he go to the north side and end up engaging in a fight?
    Was it his presence on the north side that drew Mr. Hammond over there? Was Ross Hammond killed because he was trying to save George Dranichak?

    We don’t know, and we will never know?

    Another thing we will never know is whether he made up all those people he described in his interview, and whether he really saw a hip hop guy, a Middle Eastern guy and a blond guy who looked like Kid Rock.

    As a result of his lies, there is no way to accurate splice what is truth and what is fabrication. Clearly, everything he says happened after the TD bank cannot be relied on due to a lack of credibility.

    Are there little bits of truth mixed up in the things he says happened after he “allegedly” crossed the street? Maybe, but this is a criminal trial, not a murder mystery. I submit this Court must be very cautious in using any of the evidence of Mr. D in your findings of fact.

    With respect to his reliability, I respectfully submit that it must be approached with caution as well.

    He was unable to reconcile his original descriptions with his subsequent identifications based on his viewing the City TV video. He repeated that he may be mashing descriptions of different people together.

    He described the person he later says is Nicole Kish as having Portuguese features and a white t-shirt with little flowers on it.

    He says Ms. Kish and Ms. Watts were both on bikes. There is no other witness who identifies either female as being on a bike. There is a girl on a bike according to Mystica Cooper, but it does not appear to be Ms. Kish.

    Mr. Dranichak couldn’t recall whether he actually got money from the TD bank, or if Mr. Hammond talked him out of it.
    He couldn’t get straight how much money he had on him, and how he paid the cab driver who helped him make good his escape.
    He had trouble with what he himself was wearing that night. Steve Madden shoes vs. Hush Puppies. Jeans vs work pants. Exhibits 40 and 41 are photos of the clothes he turned in.
    Can we be satisfied that he turned in the right clothes? If so, shouldn’t there be some indication from these clothes that he was beaten up as he says he was?

    No matter how you slice it, Mr. Dranichak’s evidence lacks both credibility and reliability and must be approached with extreme caution when you decide what it is you find as fact in this trial.
    I am glad to see Ms. Kish's appeal is going forward!

    I want to thank every person so much for their support and for believing in me. Being imprisoned as a murder when I am not a murder is worse than any nightmare I ever could have imagined, and knowing that so many good people know that I did not kill anyone gives me the strength to continue. I put most of my energy in trying to talk about problems with imprisonment itself because if I see something wrong, I cannot look the other way. It seems that you cannot either.
    As more and more months pass, I am becoming more and more scared, each day is getting very hard to make it through. At least once everyday I have to stop, breath deeply, and think of each of you, who bravely stand up for me while I cannot stand up for myself. Thank you for being my voice. I cannot tell you how much I regret listening to my lawyers and not speaking out and getting on that stand and screaming as loud as I could.
    I wish I could buy an endless amount of stamps and write everyone, but I can’t. So I’m doing what I know how to do, and that is trying to give back by breaking the silence and distance between the justice system and our communities, by trying to ‘pay it forward’ and be a voice for all of the people in here who have no voice, like you have done for me.
    It seems like everything to do with the justice/penal system is a big, complicated mess, my case included.
    I want my life back more than anything. Everyday and night I wish that the person responsible for the crime I am convicted of would do the right thing and come forward. I wish that any of the people who know the truth would come forward.But I realize that’s probably never going to happen. And I also realize that each of you caring for and supporting me through this has saved me, if not from imprisonment then from losing my faith in humanity. So thank you, so very much.
