    Bringing it to federal court is the best thing to do for the mortgage company. It is the venue where Bella has had 0% success and the mortgage company can use all the previous case work to have their case easily handled.

    The latest court filing my birdy sent me will have folks rolling on the floor laughing. Not only did Bella's attorney not properly serve one of the defendants, but when the Defendant made a Motion to Dismiss Bella's attorney did not respond. Classic legal comedy at its finest!

    Well - in Bella's defense - as I keep saying, their ONE claim to fame is holding up the inevitable foreclosure in the courts for a period of time. Ms. Cooke earned 8 months longer in her home and Bella received 8 months of lease payments! Sounds like a true win-win to me! ............................ :)
    NOW - if Bella would simply get their clients and their resellers to understand that this is ALL what they are about then perhaps the future lawsuits for fraud may be kept down to a bare minimum....
    Again - I'm not understanding how the heck they are still at it - but somehow, someway they're either on borrowed time - or they are fooling not only clients and resellers but also the authorities.........

    Our dear colleague from Quatloos very kindly answered our questions about Bella and whether they could be labeled vexatious litigants. I am happy to hear that monetary sanctions are quite possible. It is high time this nonsense be brought to a halt. wserra thought the Defendant's latest Motion looked very good. I was impressed with the Defendant's attorney from what I found online. This will be very fun to watch.

    I pulled more docs on that Colorado case from PACER. So, I think I have the motion referred to in the post on Quatloos. That attorney Bella is using is in for quite a fight. He might as well get a ski boat and try to raise the Titanic!

    Note on pages 19-20 we learn that Bella paid $10.00 for the property and what the Defendant's attorney has to say about that. What Bella is doing is unconscionable to say the least!

    Wow, the best things out of the Motion to Dismiss are golden........

    Further, when Wells Fargo foreclosed its senior interest in the Property with the Public Trustee and obtained its Confirmation Deed, Bella Homes’s alleged
    junior interest in the Property was extinguished pursuant to C.R.S. § 38-38-501 as a matter of law. Under these circumstances, Plaintiffs have no standing to assert any claim for an interest in the Property.
    The biggest thing I have been saying (among all the other things that are flawed with their "program") is that they lack standing to bring any claim. In this case, not only do they have no claim, they waited 5 months to file the only thing that would have given them temporary subject-to ownership, well after the law cancelled any interest.

    As recently held by the Colorado Court of Appeals, a party asserting claims that its secured lender wrongfully foreclosed on its collateral must plead and prove that it was not in default under its loan when the foreclosure proceeding commenced. See Ball v. OneWest Bank, FSB, No.11CA0169, slip op. at 14-15 n.5 (Colo. App. Jan. 19, 2012) (attached hereto as Exhibit O); Fields v. Millsap & Singer, P.C., 295 S.W.3d 567, 571 (Mo. Ct. App. 2009) (“[a] plaintiff
    seeking damages in a wrongful foreclosure action must plead and prove that when the foreclosure proceeding was begun, there was no event of default on its part that would give rise to a right to foreclose.”
    Wow, that one throws their whole program out the door......a pretty good reason not to do business in the State. Furthermore, how can any respectable, knowledgeable attorney file any of this like they don't even know State law..........oh wait, never mind, Bella has some of the best legal minds under retainer, and this never happened....

    The clear pleading that Bella Homes engaged in unconscionable conduct under the Colorado Foreclosure Protection Act will speak for itself.

    Watching from afar, it appears to me people have got the wrong impression as to where the scam is being perpetrated.

    IM(very)HO, the "not serving" and "failure to respond" were deliberate on the part of Bella and/or its' non existent attorneys.

    Just as with a magicians' misdirections, we are being purposely directed to look for the BIG fraud, as in: the hundreds of thousands of dollar end of the field, when, IM(very)HO the REAL fraud has already taken place i.e. the fees and sham "lease payments"

    Whatever happens, Bella can't lose.

    It has the fees and lease payments and can afford to delay the 5 or 6 months.

    In fact, it WANTS 5 or 6 month delays, the longer the better.

    By the time the initial signups wake up to the reality of what's happening, gone through the process with the mortgagees and act (if, by that stage they have any money TO act) months, if not years will have passed and those behind Bella will be long gone WITH the multiple relatively small amounts of fees and payments.

    Likewise "not filing" is better for Bella, as well. "Filing" costs money and time, whereas "not filing" costs them nothing.

    AND the clincher is, as has been pointed out Bella has no standing, which means it's the homeowner/mortgagor who is in the hole and bears all the risk and penalties.

    My reading of the situation is that Bella not only CANNOT but doesn't actually want to "be involved"

    Again, IM(very)HO, the same tactics of misdirection and capitalizing on the global financial and real estate crises are being used by Bella Homes as are/were being used by the fraudsters behind Property Wikia.

    I would fully expect to see a steadily increasing numbers of reports come trickling through of similar cases to those above where it "appears" as if Bella has overlooked basic procedures before people finally realize the "overlooking" is deliberate.

    Don't look for the large amounts, look for the multiple small amounts.

    GUESS WHAT?!?!

    The US Attorney's Office found me from one of my posts (where I used my real name) and they want to speak with ANY of us who are as incensed about what Bella is doing as I am. They want any information that they can track down on the Bella folks and program. They are looking for any and all info to bring an End to Bella!!! They already know quite a bit - but they need help in building their case. I for one am absolutely telling them everything I know and would really appreciate any of you stepping up and helping as well. They understand some of the info may be circumstantial but any lead is a good lead.
    Let me know how I can contact you (or you contact me) so that I can give you the contact info of the US Attorney's office contact assigned to the case.
    SoapboxMom- they would very much like to hear from you as you definitely are leading the pack on this thread with lots of great info and I said I would try to get you specifically to give them a jingle.

    Colorado and federal prosecutors have filed a joint lawsuit alleging a Georgia-based company and its principals ran a foreclosure-rescue scam, dating back to March 2010.

    Bella Homes is accused of asking struggling homeowners to hand over titles to their homes and then enter agreements to lease back their homes from Bella while the company worked to halt foreclosures and purchase their mortgages.

    Prosecutors allege Bella Homes accepted more than $3 million in "rent" fees from more than 450 consumers, affecting people in two dozen states, but didn't provide any meaningful assistance to homeowners to avoid foreclosure.

    An attorney for Bella Homes declined to comment Thursday.

    A federal judge ordered defendants Wednesday to cease operations and transfer $500,000 to the government for potential restitution, pending resolution of the case.

    Curiously - I hope you won't mind me sharing a personal journey I just went through as I think many on this thread will support me (at least I hope). I will admit to feeling much of the "I told you so" feeling that is not very humble - but it DOES feel good to be right about something as blatantly wrong as the Bella Homes program was.

    Admittedly I sent a very unkind note to my two EX supervisors at Real(ty) Funding Partners who at the time claimed to be the biggest reseller of the Bella Homes program (and how I was originally brought into the Bella Homes fray). As I have repeated I thankfully never placed anyone into the program as I could smell a rat early on and the more I dug the more I realized it just wasn't the smell. The note I sent to the ex-supervisors essentially stated that I thought that they should be "ashamed" for reselling the Bella Homes product and for taking advantage of all of those vulnerable folks facing foreclosure (especially after being warned that the program was a SCAM). I'd like to cut and paste one of the Director's responses to me and let you come to your own conclusions.
    Here is their quote:
    "I have not run across a more self righteous person who assumes to know more about our company than we do. We are a large corporation with good people doing good things.

    Bella Homes was not a part of our corporation and we did not develop or run their products or services."

    My reply was simply: "Oh my God. Really?"

    By the way - so that the RFP Director doesn't get the chance to say that I'm "hiding" behind a pseudonym - my real name is Linda B. and I'm very proud of the stance I took against this horrible program. Cheers!

    All the kudos go to the many that contributed to this thread. This one was such an obvious scam. Law enforcement action so rarely happens I consider a wonderful bonus, but either way what we post can and does help keep folks from being victimized and that is quite a victory in and of itself. Law enforcement is way unstaffed and underfunded, so everyone that has the courage to speak out is doing a wonderful service. The top folks pushing this should be getting chewed. Mortage, banking, legal and other experts should have been checking this out thoroughly before pimping it so aggressively. I hope those dear lads at RFP are enjoying that delicious humble pie! You, Linda, are one of my heroes for going the extra mile to expose this and bring them to justice.

    Thank you Littleroundman and Laidback for your comments. At first when I read what was sent to me by the RFP Director I took it the same way you are taking it - however - after additional thought I realized that what this high up (and influential) Director of RFP was most likely saying was: =Bella Homes was not a part of our corporation ownership-wise and we did not participate in the development of their products and services nor did RFP have any say on how their company was being run....i.e. <=all we did was resell their product - so don't blame us that what they were doing was fraudulent we were just an unknowing (unaware?? innocent victim????) third party reseller...................>. Then when I got the "threat" that I was going to be silenced by their attorneys for my "bashing of RFP" - I quickly decided to jump onto this forum and share......I don't recall "bashing" RFP...just telling the facts.....Hmmmmmm?

    I believe several of you commented on the possible "risks" of being an active reseller of Bella earlier on in this thread....kinda sucks when the **** hits the fan with Bella when RFP boasted as being the biggest baddest reseller for them......(Ie. it isn't much fun now is it Robert Valentin???)

    By the way - to set the record straight, the Director who sent this email to me was not Robert Valentin - this person is much "higher" in the corporate ladder which makes it all the more telling to me. It appears to me this may be the current "corporate" stance in defense of their active reselling work for Bella.

    Ooops sent my last post before I saw your post Soapboxmom....I'd like to add a bit more ....YOU spent a HUGE amount of time providing all of the links that tied the knot for those of us trying to put the pieces of "proof" together. All of the background on the owners, the boilerplate lawsuits, the jumble of mess that kept coming up. You were our sleuth. YOU provided a place that I sent literally 40++ folks to who PM'd me on Trustlink who were looking for more background info on Bella on why NOT to sign up. Remember when it was almost impossible to find anything on the net except resellers' garbage? And then there was that one thread on Scam.com that I was so happy to find...and then POOF...we were hitting way too close to Mr. Dranichak's pocket book and we got erased. And then you and this thread popped up. Thank you again as this forum helped me/us to feel like a "team" and not a scared rogue person attempting to individually stand up to wrong.

    You are right - legal action is rare - and it just shows how NASTY this one was that they were able to jump in and shut them down. Going full circle - had you not provided all of the meat of the proof - I wouldn't have actively prodded the ex-Bella client who contacted me many months ago that they SHOULD contact their attorney general. They did - and were told by the US Attorney's office who took their testimony a couple months ago that they were instrumental in helping to lock down the Gov'ts case.....and shut down Bella. I received the wife's email early Friday morning on "our" victory and she ended the note by saying JUSTICE PREVAILED HERE!!! :) So good for them as well - it was a total TEAM effort - but I will come back to you Soapboxmom - YOU have made a HUGE difference in this country by your tireless work on this particular topic and I for one KNOW that you personally had a big indirect part in shutting Bella down. And I really want that not to go unnoticed!!!!! Thank you from your grateful fan, Linda.

    It is just fortunate that there was enough information for authorities to act as quickly as they did. This just as easily could have ran much longer and harmed many more people. Luckily they attempted to expand too fast and move into states where they clearly did not understand the law. It still amazes me how much the people that push these sort of things, knowingly or not, right up to the very end no matter what evidence is/was presented. With that in mind, it is also startling how fast the MLM pushers have taken down the Bella links and program details from their sites like it never existed.

    On a similar note, of all the people that attacked me on scam.com, saying I didn't know what I was talking about (despite working in the capital markets for years as well as having firsthand knowledge of some of these state specific and federal laws) only one person came back and PM'd with an apology. Everyone else seems have disappeared into the wind and now I see their e-mails and ID's popping up elsewhere for the next big thing.

    With that is mind, is there any way to go after these serial MLM'ers directly? As I was gathering research for the postings on the other site, I noticed quite a bit of them had associations with other failed MLM's that were clearly scams, (and I include the Trump BS in that as well). Despite pushing all these programs, taking money, defending everyone like it was the Holy Grail of MLM's and that this one is "different", only to see it fail, people lose their money, potential opportunity, and for the people on the ground floor, potentially their family, friends, business associates, et al; these pushers move on without any type of consequence to the next "opportunity".

    Out of all these failed scams, has there every been an attempt to create a master list at some level and prevent them from pushing something new? I know you cannot stop someone from making a living, but can you not take the approach most of these civil injunctions do and prove public harm?

    You guys have way more experience doing this than I, so I will leave it to you to reply. It's too bad people had to be scammed on top of losing their homes to foreclosure, but I'm certainly happy Bella Homes, LLC and it's operators have been shut down. Hopefully this thread and the associated exposure will go along way in helping prevent the next Bella from popping up.

    The best chance for the sleazy MLM heavy hitters to be held accountable is for the duped downline members to file suit. The authorities occasionally round up the top promoters and worst offenders, but law enforcement is way too understaffed and underfunded to close them all down. Thankfully, folks like you have the courage to take them on and stand your ground. MLM heavy hitters are quick to declare anyone with the sense to question their latest and greatest deal as stupid, dream stealers and worse.

    The best way to stop the MLM scoundrels is threads like these that scare off potential marks. RS also serves as an archive of all the many MLMs these top people have pimped. What we have posted is not going anywhere!!!
