    Garland Soccer continues to collapse due to the mismanagement, manipulations and dishonesty of David Arciniega. When he took over there were 4000 players. Now, there are barely 2000. Tournaments used to be huge. Even a few seasons ago there would be more than 100 Garland teams in the GSA tournaments. Usually at least 50% of the teams would sign up. In what looks to be the last tournament under Arciniega only 75 Garland teams registered out of a paltry 192 playing this season.

    Wylie has had awesome free tournaments as they have wonderful forward thinking leadership that works together. They had gobs of very generous and reputable sponsors. David Arciniega has refused to allow the directors to seek out sponsors. So, there are no sponsors for the Garland tournaments. Arciniega had to make serious price hikes in the tournament fess as with the rapidly shrinking numbers Garland is probably losing money and in serious trouble.

    Come fall the U19 teams will age out and not be playing and many more teams, coaches and players will join the mass exodus. The City of Garland and North Texas State Soccer (NTSSA) should have stepped in a long time ago and thoroughly investigated the safety and money issues in the program. The city of Garland now has no real viable soccer program and the taxpayers are forced to pay for a program that they don't want to play in or are barred from participating in. Anyone like me who demanded that David Arciniega follow, the by-laws, IRS regulations and state law concerning fiduciary duties and the like is harassed and sometimes forced out. So, the City of Garland has its own taxpayers being barred from participating in this city sponsored program for no legitimate reason. The total collapse of Garland Soccer in imminent.

    Kathleen Robinson and David Arciniega are both delusional and patently dishonest. On the tournament application submitted to the useless NTSSA people, they estimated that 175 teams would participate. That is a far cry from the 82 teams total and 75 Garland teams that signed up for this boring joke of a tournament with no sponsors and zero atmosphere.

    Breaking News!

    Discovery responses from David Arciniega and the Garland Soccer Association (close to defunct board) were due today. Just what does David Arciniega have to hide? Their attorney has not turned over a single piece of paper nor asked for an extension. There were also other documents that the GSA attorney had said he would file that have not been filed. Motions to Compel and Motions for Sanctions may be forthcoming.

    I would bet that the Garland Soccer board has no knowledge of any of this and have not even begun to gather the documents the court will require all of them personally to turn over. When I was on the board we were denied documentation and kept totally in the dark about everything by David Arciniega. Board members could not access any files in the soccer office either. That is in direct violation of the by-laws, state law concerning fiduciary duties, IRS regulations.

    Judging from the first lie-filled response to the lawsuit by the North Texas State Soccer Association (NTSSA) attorney that mysteriously bailed when it got a little hot in the kitchen, the only person with access to the lawyers is that liar David Arciniega. The original response claimed issues that I had must be heard at the NTSSA level. Obviously, that is not correct according to the by-laws of GSA and NTSSA, and if the board had seen that totally false information in that legal filing, it would have been corrected.

    The second attorney (paid for and working for the insurance company) told an outright lie in court as well. He claimed I had not been to NTSSA with my concerns. I have been to NTSSA, Region III, US Youth and US Soccer as warranted. So, again I am sure the attorney is only talking to that liar, David Arciniega and the board has no clue what is going on with the lawsuit whatsoever.

    Clearly the board is supposed to run the association and not the self-appointed dictator, David Arciniega. And, GSA should have immediately invoked its insurance to get an attorney to address the lawsuit. I think David Arciniega used the NTSSA attorney as he wanted an attorney that he alone would control and benefit from. As he is the main reason GSA has been sued, he should accept responsibility and not let his many misdeeds hurt the charity he had sworn to serve.

    Obviously, David Arciniega lied to the member coaches and families when he assured them that he had done nothing wrong and that the case would be thrown out in June 2015. Arciniega isn't winning, but rather completely destroying GSA. Instead of electing directors, the member coaches should dissolve the corporation at the May 26th GSA meeting and demand that US Youth step in and take jurisdiction and that the City of Garland be involved in forming a new governing body for the city program.

    Garland can't retain refs because most of the other associations pay cash at the games instead of checks that must be picked up on the fields only two days a week. Though writing checks is preferable for the charity's bookkeeping and Garland is doing what is the sensible thing, payment methods and amounts should be standard across North Texas Soccer. North Texas will not do anything to solve these obvious and long complained about issues. Garland also asks refs to come in with proxies and vote in obviously rigged elections and police the games for playing time and other issues that the board members should be handling. Garland is desperately short of refs due to these antics of David Arciniega.

    Comments: Dan Ptak the president with JEVIN has stolen $35k from my soccer league. He now will not answer any phone calls and refused to pay us the money we are owed. DO NOT USE JEVIN.

    The City of Garland and US Youth must remove David Arciniega immediately and investigate his involvement with and insistence on continuing to allow Jevin to handle the charity's money as he never produced any documentation in relation to the issues with Jevin in violation of state law, IRS regulations and the GSA / NTSSA bylaws. Now, besides the Garland money that went missing we have reports of other organizations that are out $39,000.00, $20,000.00 and $35,000.00 in just the past week alone.

    It is critical that a new group be brought in to run Garland Soccer that can keep the money safe and that will run it transparently.

    If David Arciniega had not lied to the Garland Police and refused to turn records over to them when I reported the Garland Soccer money that was missing in 2013, then perhaps legal action would have been taken before these 3 and God knows how many more entities had money allegedly stolen by Jevin / Dan Ptak. $39,000.00, $20,000.00 and $35,000.00 are devastating losses. David Arciniega must be held accountable for his lies and gross mismanagement of Garland Soccer.

    David Arciniega, Garland Soccer's president, negotiated a rate with Jevin sports management software of 10% in 2009. As in Jevin withholds ten percent of the registration fees for Garland Soccer players as payment to them. When the "missing money" issue happened in 2013, Arciniega negotiated an allegedly reduced rate of 8%. Other organizations that are smaller than Garland Soccer reported to me that 8% was the going rate for years and that they had paid that all along. Jevin claims the rates are on a sliding scale, so under that premise Garland should have been paying less years ago when Garland was 4000 players strong (now only 2000 remain thanks to David Arciniega.)

    Imagine my horror when a much smaller soccer club president told me today that they had been paying just 3.5% all along. David Arciniega is costing the Garland taxpayers and other local families thousands of dollars for bupkis! NTSSA and the City of Garland need to do a forensic audit and find out where in the heck the money is really going.

    Just looked over this last night...

    Actually, appearances and transparency are a big deal in the workplace, leadership and the board room- profit or non-profit corps-- especially when dealing OPM (other people's money). A lack of transparency and secrecy not only enable, but a symptom of misconduct. Executives and board members have an legal responsibility to avoid the appearance of misconduct or conflict of interest

    Personally, I don't like the format soapbox has chosen to use expose this isssue...the rolling charges, lawsuits are unseemly and make soapbox civilly responsible if allegations are false...Indeed, if her public allegations were frivolous, I wonder why it hasn't been addressed... But a countersuit would Dribble An opening of the books to disprove. It's totally possible soap has an ax to grind, possibly someone on a mission. Regardless, I think we all can agree soapbox is not doing this to win a popularity contest, is oblivious taunts and criticism and she most likely never see a penny of the $100 if her charges are true.

    However individual board members can be held legally responsible for board malfeasants. The $100k doesn't bother me bc monetary damages improves standing and usually is more helpful in enforcing action. Her attempt to involve police could have been futile police since police can't involve themselves in perceived civil suits.

    The NTX club fraud and missing money of the past decade do give me pause. It would be quite easy to divert a small portion of numerous small payments. I have been very surprised about how some of these clubs and organizations are run by the "owner", without oversight from their boards (which in turn, exposes individual board members reputations and possibly legally.

    I know I shouldn't do this, but... Soapbox (pls correct where I am wrong) is alleging...

    -So Jevn is a small credit card processor, who is buddies with David A...
    -David A gave Jevn the soccer group's credit card processing business.
    -Jevn transaction charge was 10% of gross proceeds, which was "negotiated" down to 8%.
    -$8000 initially has disappeared, and now $100k

    Just these "facts" alone are disturbing.
    -Sending work (or money that is not your own) to a known associate should be a very transparent process that is fully vetted by the board.
    -an 8-10% processing fee is absolutely outrageous; TOTAL fees (processing plus individual cards, bank charges, etc) over 3-4% is excessive.
    -depending on size of the operation, the missing $8k should have put the board into emergency investigation mode.
    -$100k should have warranted an hired outside audit.

    Who is responsible for bookkeeping & auditing garkand's books?

    What Chase bank say about Jevin?
    The questions are not going to go away!

    Its official. David Arciniega's totally corrupt program has lost another director. The U6 Director had 1/3 of this league under him. I am hearing more reports of coaches leaving as the charity collapses under David Arciniega's evil dictatorship. Garland Parks and Recreation is a complete disaster. The Garland families can't even enjoy playing in their own hometown!

    David Arciniega used the North Texas State Soccer attorney wasting $15,000.00 that belonged to the children of Garland when the insurance would have provided David Arciniega and Garland Soccer an attorney for free. Arciniega should have been very well aware that the free insurance attorney was available as it is explained in the Garland by-laws.

    David Arciniega is obviously using Garland Soccer as his own personal pocketbook. The board is powerless. Many more coaches and teams are leaving Garland Soccer. The way it is going David Arciniega could ruin the program financially. With the numbers continuing to plummet, how is Garland Soccer going to be able to pay the bills?

    So, again why is David Arciniega forcing Garland Soccer to retain Jevin with these catastophic amounts not being paid to customers? And. lest we forget thses losses could have been prevented if David Arciniega had not stopped my filing of formal charges with the Garland Police when Garland was out over 8 grand. Arciniega claimed falsely at that time that Jevin had had $50,000.00 stolen from it by the payment processor and then he prevents the authorities from doing their job and investigating? Arciniega is as dirty as they get!

    Fall 2016 Recreational Begins Monday June 6, 2016 and ends Sunday July 31, 2016.
    Rowlett is almost done with fall registration and as we can see Plano closes their registration on July 31. Garland is collapsing with directors, coaches and families leaving in droves and has no safe software to use for registration with Jevin customers out tens of thousands of dollars and litigation, criminal charges and/or a bankruptcy all possible. David Arciniega has absolutely destroyed what was the second largest program in the state soccer group.

    Great Job! Thank you for documenting your crisis. I can tell you that minus the Level 2 sex offender, all the other patterns mirror our program in the Maple Valley Soccer Association. Getting people to publicly testify is very hard because the local soccer mafia will intimidate you and your kids at local parks. We have become a community of pansy a$$es that seems willing to accept corruption at all levels of society. Where are the John Wayne’s of the world?

    Piney Burch-Walser was tossed as VP. She came in 2 years ago and promised to clean up Garland Soccer. She never got the A & D Committee and Ethics Committee (required by NTSSA) that she must have according to the by-laws. She never filed the numerous charges against president David Arciniega that she promised all the coaches she would. So, missing money was never investigated and properly documented. The rigged elections were not investigated. Child safety issues were never addressed. The harassment and intimidation going on did not result in the necessary charges being filed. The coaches couldn't wait to send her packing.

    David Arciniega's goon squad / soccer mafia was sure they had Arciniega's flunky Kathleen Robinson in as the new VP. The coaches know she is nothing more than Arciniega's stooge and they nominated Rachel Beltran from the floor and got her in instead. She is tough, fair, honest and determined. She fought beside me while I was on the board to clean it up and do the right things, but the board was split between those that were voting to do the right things and Arciniega's goon squad which outnumbered us. Now, Rachel Beltran can file all the appropriate charges and orchestrate the investigations that should have been done years ago so those that are violating the by-laws, state laws concerning fiduciary duties and IRS regulations can be removed and banned from all soccer activities as they should have been when I filed formal complaints.

    And, for the record, David Arciniega's attempts to schmooze long-time coaches that are now speaking out is laughable. They are going to fight valiantly to see positive changes in the program and some will leave taking dozens of families with them.

    The only question now is who will take David Arciniega out first. Will the City of Garland select a new group to run the soccer program? Will the court case take him out? Will filings with NTSSA and or US Youth get him removed or will hearings by the coming Garland A & D and Ethics Committees take him out?

    The Jevin software program that David Arciniega insists on using though he is the only one using it in NTSSA is also collapsing. As I noted 6 of the few associations still using that software are owed around 150 grand. I can confirm that criminal charges were filed, but that 1 of those associations is recovering money by doing chargebacks. As that method has proven successful, I am sure the other associations will follow suit. Jevin couldn't pay them, so there is no way they will be able to handle tens of thousands in chargebacks

    The chargebacks could literally destroy that company. Imagine Jevin folding and not paying their hosting fees. All the associations on that software could lose all of their records, game schedules and referee schedules. No one in their right mind would register with Garland Soccer with all of this going on.

    A seventh group contacted me today as they are alleging that Jevin Software owes them a whopping $38,000.00. They found me through the thread on Realscam.com. So yet another organization that is out money thanks entirely to David Arciniega of Garland Soccer and North Texas State Soccer (NTSSA) putting the kibosh on my report to the Garland Police. As the CEO and president of Garland Soccer he stopped the police from investigating in 2013 and now a total of approximately $190,000.00 has been reported as funds Jevin owed, but could not pay to at least seven 501 c 3 sports organizations / charities.

    David Arciniega is so completely deceitful and irresponsible that he is forcing Garland Soccer to continue using Jevin for registration and scheduling. Garland Soccer started fall registration on Monday June 20 through Jevin. I advise all Garland coaches and players to carefully consider where they wish to play going forward. Jevin is clearly going under and money and data are not safe. The chargebacks and criminal charges are serious matters and if Jevin should become unable to pay its hosting fees all the data and schedules could be lost.

    David Arciniega needs to be thoroughly investigated by US Youth Soccer and banned from the sport for life!!!

    Youth football league says company collected about $45,000 in fees but won’t give them the money | fox13now.com

    CACHE COUNTY, Utah – A group of young football players and their parents are upset after they paid about $45,000 in registration fees only to learn their season may be in jeopardy.

    The Skyview Youth Football League includes about 250 kids from northern Cache County.
    The league uses an online service called Jevin to process registration fees, however the league says Jevin is not making those funds available. The money is meant to pay for equipment, uniforms and more.
    “We checked the accounts, no money,” said Jeff Young, a parent of a player in the league. “We followed up, no answers.”
    League Director Brianne Young said they are frustrated with the experience.
    "I want Jevin to do the right thing,” Brianne Young said. “I want our kids to get our money, and I want our kids to get a normal football season and not have to worry about this."
    League officials are meeting with Smithfield Police on Monday, and the league says they are not the only group in Utah struggling to get satisfaction from Jevin.
    "We received an email halfway through our registration from another group saying that they had, that there were other people having similar problems,” Brianne Young said.
    Jevin has not responded to FOX 13 News’ requests for comment on the issue.
    Members of the league have created a GoFundMe page to try and raise funds to help the children play this year.

    New Registration & Payment System

    BYA Registration/Payment processing will be moving to a new system starting with Fall Baseball/Softball registration this year. We’ve been testing a new system with our volleyball league (Sports Illustrated Play) and the feedback has been positive.

    – All participants will need to create a new profile in Sports Illustrated Play (SIP) as the information in Jevin will not be carried over
    – The system will require a copy of each child’s birth certificate to be uploaded at registration. You only have to do this once and the information stays on file for all sports.

    The Sky View Youth Football league is scrambling to raise money after they claim that a third-party software firm is denying them access to some the league’s funds, which total $45,000.

    Breanne Young, director of the youth football league, said the league had been using Jevin Sports Organization Management’s online registration services for three years, but that this year the company’s president told her only about a third of their $45,000 is available for use due to company errors.

    In previous years, Jevin collected registration payments from players’ families on behalf of the league whenever they were due. Jevin would then distribute the funds to the league to cover expenses such as insurance costs and equipment purchases.

    This year, players’ parents paid registration fees to Jevin as usual, but once the league needed to access that money, they were met with silence from the company, Young said.

    “We continued to ask for our funds without any response,” Young said. “Our calls weren’t getting answered, our emails weren’t getting answered, nor our text messages.”

    Since the start of May, requests for the use of these funds were ignored and parents were later notified that the money was not available, according to Young.

    After weeks of unanswered calls, league officials say they managed to contact the president of the website, Dan Ptak. According to Young, Ptak said that only $14,000 of the sum total was available for use.

    However, Ptak also reportedly stated that some of the Sky View Youth league’s funds had been mistakenly transferred to the Ogden Valley league. The latter reportedly waited two months for Jevin to return $7,000 of their registration fees, Young said. When Jevin finally did pay, Ogden Valley received $14,000. Ogden Valley sent the extra $7,000 to Sky View when asked, according to Young.

    According to Young, this week marks the first of many in which equipment orders have to be made in preparation for the season.

    “There’s several things that come up, and we have to have funds to pay those just to function,” Young said.

    She also said that $30,000 is the approximate minimum for the league to be able to cover essential costs such as insurance and vital equipment like helmets.

    “The 45 ($45,000) was to buy new jerseys, new pants, things like that; that was the extra,” Young said. “I mean, we could cut out a lot of extra things, but the kids paid for those to make it a fun season.”

    However, despite the lack of funds, Young and the other parents have promised they would have the young athletes play in this coming season.

    “We will do everything in our power to make sure our kids still have a season,” Young said. “To me, not having a season is not an option, so I won’t let that happen.”

    While Jevin reportedly attributed the missing funds to error, Young said the league has filed a complaint against the company with the Smithfield Police Department.

    Smithfield Police Det. Brandon Muir confirmed that police met with the leaders of the youth league Monday, and investigators will be looking into the allegations. Muir said it is an active investigation so he could not provide additional details, but he did say that so far, police have not been able to reach a representative of Jevin.

    Jevin did not return phone calls from Herald Journal reporters by deadline on Tuesday.

    Most of you have been approached by a person making unfounded claims and accusations against Jevin.
    Really, Ptak??? Quote any false statements of fact (you know, something that would be actionable) and refute them. Simple enough right?
    To the best of our knowledge, neither Jevin nor any Jevin employee has ever had any interaction, conversation or email exchange with that person.
    So, your mad sales weenie, Charlie M. didn't tell you that he talked to me for an hour and 13 minutes? He referenced this very thread and said it was making it hard for him to sell Jevin. I suggested he get documentation on all the issues raised here. David Arciniega said and published:

The same fees would apply to both the recreational player registration and tournament for that season. The savings to GSA would at least $7k for the upcoming fall 2013 season and then about $3k for each season after that....."

Jevin/online provider owed GSA $8,061 (in June 2013) which was paid in full to GSA as of August 20th. To compensate GSA for this delay, Jevin will lower its rates resulting in additional revenue for GSA. Litigation is on-going between the online provider (Corduro) and Jevin so additional information may not be divulged per the North Texas lawyers."

    3. David Arciniega claimed at the July 2013 board meeting that Jevin (hence the 501 c 3 charities its serves) was actually missing $50,000.00 because of Corduro (the payment processor.)

    The "ongoing" litigation was never filed. So, did Dan Ptak or David Arciniega lie about that gem? And, I spoke to the president and CEO of Corduro at length. He said no litigation was filed or even threatened for that matter and that no police investigations or anything of that nature transpired. I don't believe that Corduro is the likely culprit for the $50,000.00 story that David Arciniega was blathering about.

    Folks should seek full, verifiable documentation. Garland Soccer was refused documentation by its president and your buddy, David Arciniega.

    The factual details of this issue date back to 2013 when the author of the emails was defeated in a general election for an age-group director board position with Garland Soccer Association (GSA).
    2013 is when Garland went from late payments to the 8 grand referenced already. I demanded full documentation and your buddy, David Arciniega refused to produce any documentation whatsoever. We saw no financial records from Jevin, check stubs, financial statements, court records, etc. I was pushed off the board in December 2014 because I was demanding that David Arciniega and his clueless flunkies follow state law concerning fiduciary duties, IRS regulations and the bylaws of Garland Soccer and our parent organizations North Texas State Soccer. There were many serious issues going on in GSA and one of them was David Arciniega forcing Garland Soccer to continue to use Jevin with all the financial issues and software issues going on. Retention of Jevin is addressed in the lawsuit.

    The author’s response was to file a lawsuit against GSA, the president of GSA and the North Texas Soccer Association (later dropped from the suit).

So, Dan Ptak has reading comprehension issues in the extreme or has been talking to his buddy, David Arciniega, the president of Garland Soccer and NTSSA's Chairman of Coaching Education (North Texas State Soccer Board Member.) NTSSA was never a party to the suit at all, so I could hardly have dropped them! NTSSA as the parent organization that has the power to take jurisdiction over GSA did receive a courtesy copy of the suit beforehand as I wanted to resolve the issues and keep kids and money safe and see Garland Soccer be able to move forward successfully.

    The lawsuit requested over $100,000 in monetary damages – yes monetary damages – because the claimant failed to win an election for a volunteer board position.
    Dan Ptak needs to talk to a competent attorney (not his clown of a friend, David Arciniega) about why a monetary demand would be made in a lawsuit.
    Let me reiterate, the suit does NOT include Jevin and neither Jevin nor any Jevin employee has ever been deposed or subpoenaed….the issue is strictly between the author and GSA.
    That all remains to be seen.

    Since there was no real basis for a claim, the author listed nearly 100 bullet items alluding to improprieties within GSA. Those articles ranged from ‘one time, one person….’ to two items that listed Jevin.
    Those bullet items you are talking about are from the original petition filed on 3/6/2015 and are in reality the items requested as discovery that you are probably referring to. David Arciniega is still ducking discovery even though he lost the Plea to Jurisdiction and knows the lawsuit is going forward (despite him publicly telling the Garland coaches that my suit had no merit and would be thrown out in June 2015.) Wrong again, Arciniega! Motions to Compel and whatever else is needed will be filed. I will be seeing this suit to the finish and then work to establish a safe, transparent and quality soccer program in Garland for our precious kids.

    The first Jevin item claimed that the GSA president was an employee of Jevin – this is a false statement…the GSA president has never been an employee of Jevin and has never been paid by Jevin.
    Dan Ptak best read the suit in its entirety.

    The second item alleges that Jevin did not pay GSA all of the money due to GSA – this is also grossly untrue.

The issue is there is no documentation to back up all of the claims by David Arciniega such as Corduro being responsible for the money issues, Jevin being unable to get a loan for 8 grand, a total of $50,000.00 being missing from several charities and Jevin having been in ongoing litigation with Corduro due to all this.

    So why is this person emailing all of Jevin’s customers making these false statements and what does she hope to gain from this? No one really knows and there is no rational explanation. At a minimum, it appears to be a desperate cry for attention.
    I was on the board of a charity out money and no documentation was ever provided to substantiate any of the issues surrounding that. I was told by GSA President, David Arciniega, that fellow sports charities were out 50 grand due to Corduro. I am not going to sit back quietly and let charities lose money when they are struggling to serve our precious children and knowing that many of these families really sacrifice to see that their kids can participate. And, again quote and refute said false statements and provide all of the documentation related to the financial issues for the past decade with Jevin. What is the secret?

    The only other theory is that since her original suit with GSA was dismissed by one court, maybe this is a misguided attempt to try and find something in her suit with GSA that might hold up in the new court filing.
    My suit against GSA has never been dismissed. Again, I have to assume that Dan Ptak has been talking to his buddy David Arciniega. I did file and amended petition (a quite common practice, I might add.) If there had been a suit dismissed, there would be a complete case file online and an original petition, answer by the defendants, a motion to dismiss and an order from the judge at a minimum would be in that record. Never happened. The records in Dallas county are all online and one can click on the links here and see documents for more recent cases for free! There are 4 results for my name, Dobrott, Heather. This case, Tim Darnell of Advantage Conferences suing me, me suing Tim Darnell and then an issue with some work on our home.

    Other than that, no logical person can begin to understand why attempting to discredit a company and its owner would provide any benefit to her. But, as many of you have already pointed out, if you do your research on this person, you will find that she has a very long history of filing suits against nearly everyone for nearly every reason. This appears to be yet another one of those imprudent undertakings.
    In addition to those 4 cases I helped an elderly rep to sue Advantage Conferences / Tim Darnell and to cut out the attorney fees I assumed her claims and represented myself in district court to finish that case. I was sued in Ohio by Don Allen Holbrook along with half of the planet (other journalist, newspapers and all the taxpayers in Texas that dared to comment in the failed billion dollar Earthquest theme park that will cost the Texas taxpayers 24 million for bupkis.) All these suits except the home repair issue are related to my volunteer work on Realscam.com to protect taxpayers and consumers.

    Why hasn’t Jevin responded sooner? We have been diligently exploring all of the various options that are available to Jevin. I am not allowed to get into specific details but we were waiting for a certain event to occur. We have now initiated efforts on all fronts.     Are you, Dan Ptak, saying that you are filing suit against me? File quick! I want discovery yesterday on all these issues. I will get financial records and well... pretty much everything other than your used toilet paper. Are you suggesting David Arciniega lied? If so, then you will naturally be called as a witness in my suit against him and Garland Soccer and be sinking your buddy in court big time. If you are saying David Arciniega was correct about you claiming to be unable to get a loan, being out $50,000.00 due to Corduro, you being in ongoing litigation against Corduro (a lie as obviously there was never an ongoing lawsuit in 2013,) and that going to Chase for payment processing would solve all these payment issues, then you are again winning my lawsuit for me as it is obvious David Arciniega should not have forced Garland to retain Jevin. I am the top dog either way.

    Some of you have probably received an email in the past day or two referencing a news story from Utah. The actual facts of that situation are that Jevin mistakenly setup a bank transfer account that resulted in Jevin sending the funds for one organization to a sister organization’s bank account (same bank – different account number). While it was clearly a mistake on Jevin’s part, Jevin did everything possible to rectify the situation immediately once it was discovered. Jevin even offered to pay for uniforms via a Jevin credit card. The offers for immediate resolution were declined and the organization turned to the media (not the police) making claims that the funds were stolen. I have spoken with their local police department and since the organization did not contact the police until two days after they reached out to the media, the police are still investigating and, contrary to what you have been told, no charges have been filed. The sister organization has since transferred the funds and Jevin has transferred the remaining balance so the organization is paid in full. In fact, the organization now owes Jevin over $7,000.

    Of course, this explains why that group has been fighting valiantly to get paid since the beginning of May, right, Ptak? And, this explains the 11 other groups reporting payment issues in May and June 2016 alone, rightio? Some of those have reported being paid as is shown below, but they fought hard to chase you down, Ptak.

    I spoke to 2 of the reporters directly and talked to the other media outlets news tip people. All of them now have a copy of this letter. After several days of leaving messages, I caught a representative from the Sky View Football program in the story that made time to update me on this fiasco. You never informed them you had paid, Ptak, nor did you bother to contact the media outlets and inform them so that they could update their stories on this fiasco. They had all been chasing you down.

    The football group had filed a formal report with the police and it was in fact being investigated. After they filed they heard nothing from you, Dan Ptak and certainly never heard anything about any "offers for immediate resolution" as you are bragging about from what I was told. They also instructed all of their parents to use the police report number to initiate chargebacks from what I understand. They had to spend money on legal fees as well. So, they spent two months in hell thanks entirely to Jevin. Now, it will get comical for Jevin as the company will have to accurately document the money involved in the chargebacks and probably pay more in fees to fix that huge mess. And, the football league received no notification of over-payment yet either. They noticed the payment of money owed entirely by accident and of course immediately closed that account and opened a new one as they are changing software providers.

    David Arciniega is trying to get me to agree to drop this issue. I bet the board has no idea what is going on behind the scenes. There are plenty of board members that know the decision letter on this or any A & D charge is required and that Arciniega cannot refuse to have it issued. Honest board members that fulfill their fiduciary duties according to state law would want this heard and dealt with according to the by-laws.

    I will never let this issue be set aside. Arciniega is obviously in mortal fear of the consequences of this issue being adjudicated at hearing before NTSSA or US Youth as he flagrantly violated numerous by-laws and rules and filed this purely to harass me and the now Vice President of Garland Soccer.

    The Motion to Compel was filed on July 8th. David Arciniega and Garland Soccer are more than 2 months beyond the due date for discovery (May 8th) that was in their hands since March 2015. I would bet a million dollars that David Arciniega is the only one talking to the attorney from the nonsense going on and what the attorney has been saying in court. As usual, I am sure that Arciniega is throwing the board under the bus and appears to be using the attorney as his personal one only.

    Arciniega is so dishonest, dirty and desperate to save himself. He no doubt fantasizes that his delay tactics and antics will get me to give up and drop the case. He is obviously crazy. I will see this through to the end. Garland's families deserve a program that is well run by honest people and totally transparent. They should see safety and money issues being handled and their voices heard.

    Notice item #6 in the motion. Thanks to David Arciniega no doubt, the board has now waived the right to object to discovery requests. Every last shred will have to be turned over. I see more motions to compel and sanctions in the future. The Every board member better turn over every last page that is responsive. I kept every e-mail and know what should be turned over!

    The judge already made it clear he expected both sides to be ready for trial on Halloween. He will be very displeased with Garland Soccer due to their antics and delay tactics. The judge has no complaints with my side.
