    Texas does not have any anti-SLAPP statutes on the books yet, but bloggers do have some important protections.

    § 10.001. SIGNING OF PLEADINGS AND MOTIONS. The signing of a pleading or motion as required by the Texas Rules of Civil Procedure constitutes a certificate by the signatory that to the signatory's best knowledge, information, and belief, formed after reasonable inquiry: (1) the pleading or motion is not being presented for any improper purpose, including to harass or to cause unnecessary delay or needless increase in the cost of litigation; (2) each claim, defense, or other legal contention in the pleading or motion is warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law or the establishment of new law; (3) each allegation or other factual contention in the pleading or motion has evidentiary support or, for a specifically identified allegation or factual contention, is likely to have evidentiary support after a reasonable opportunity for further investigation or discovery; and (4) each denial in the pleading or motion of a factual contention is warranted on the evidence or, for a specifically identified denial, is reasonably based on a lack of information or belief. Added by Acts 1995, 74th Leg., ch. 137, § 1, eff. Sept. 1, 1995.


    § 10.002. MOTION FOR SANCTIONS. (a) A party may make a motion for sanctions, describing the specific conduct violating Section 10.001. (b) The court on its own initiative may enter an order describing the specific conduct that appears to violate Section 10.001 and direct the alleged violator to show cause why the conduct has not violated that section. (c) The court may award to a party prevailing on a motion under this section the reasonable expenses and attorney's fees incurred in presenting or opposing the motion, and if no due diligence is shown the court may award to the prevailing party all costs for inconvenience, harassment, and out-of-pocket expenses incurred or caused by the subject litigation. Added by Acts 1995, 74th Leg., ch. 137, § 1, eff. Sept. 1, 1995.

    § 10.004. VIOLATION; SANCTION. (a) A court that determines that a person has signed a pleading or motion in violation of Section 10.001 may impose a sanction on the person, a party represented by the person, or both. (b) The sanction must be limited to what is sufficient to deter repetition of the conduct or comparable conduct by others similarly situated. (c) A sanction may include any of the following: (1) a directive to the violator to perform, or refrain from performing, an act; (2) an order to pay a penalty into court; and (3) an order to pay to the other party the amount of the reasonable expenses incurred by the other party because of the filing of the pleading or motion, including reasonable attorney's fees.
    If what the defendants in the lawsuits said is true that is a defense. If these are nothing more than harassment suits filed in an attempt to silence legitimate critics both Pierce and his attorney can be sanctioned.

    Stephen Pierce has many legal hurdles to overcome. First the court must decide if he is simply a private individual, a limited public figure or in fact a public figure (celebrity) type. I am not a lawyer and the laws vary from state to state, but the point is the standard Pierce must meet to win a defamation claim will depend on how he is classified. If he is a limited public figure, which is how the clown that sued me, Tim Darnell, was classifed, the bar to meet is in fact very high. Opinion and hyberbole are not actionable. Pierce is, in a nutshell, going to have to find false statements of fact made by those he is suing for defamation.

    To prove defamation he will have to provide clear documentation refuting what has been published about him. To prove damages his financial records, including tax returns will likely have to be produced. I suspect those will show he is down the commode financially and though he promises his marks great success he has had little personal success. I wonder if his attorney bothered tell him that those he sued will get almost everything but his used toilet paper?

    I would bet these suits were filed for the purpose of spending his critics into silence. That often backfires in the worst way. Ergo, this thread!

    Stephen Pierce’s Product Creation Laboratory PCL Scam

    I purchased a program called the Product Creation Lab (PCL) from Stephen Pierce (trading as Stephen Pierce International and/or Impulsive Profits) in March 2008. I made this purchase at his live training event, known as Unleash Your Marketing Genius (UYMG), which was being held in Sydney, Australia. I paid a total of $20,000 for the PCL, which was promoted as being a program whereby you would visit Stephen Pierce’s home in Texas and spend 3 days working with him on developing a complete internet marketing business. He would do the market research, work with you on designing the product, business plan and website, and then launch the product using his extensive list of contacts. In return he would ask for a set percentage of your profits for the first year after the business launch.

    I am writing this letter to express my extreme dissatisfaction with the level of service I received from Stephen Pierce, which has resulted in only a small fraction of the promised program actually being delivered. I will proceed to outline the events that have occurred since March 2008, and my repeated attempts to work with Stephen Pierce and his staff in order to realise the promises of the PCL program. I will also explain the negative impacts that this experience has had on my personal circumstances. My claim for a refund will be based on the clear gap between what was promised and what was delivered, and I will also make the case for an additional payment for personal damages.

    After the UYMG event in March 2008, I made arrangements with Stephen Pierce’s staff to travel to Stephen Pierce’s home in Texas in June 2008. I was provided with a detailed schedule that outlined what would happen during the 3 days. Based on this document, I reasonably expected that the majority of the time would be spent working personally with Stephen Pierce on developing my product. The schedule certainly concurred with the original verbal briefing and written document that Stephen Pierce gave at UYMG.

    Unfortunately, my experience at Stephen Pierce’s home was vastly different to what I expected. During the 3 days, I spoke with Stephen Pierce on just 2 occasions, each conversation lasting for no more than 5 minutes. On the first day, he sat down with me and asked me what topic I had chosen for my product. I told him my idea of something related to low carb vegetarian cooking and education. He said he thought it was a good topic, threw around some ideas of a business name and what services I might be able to offer, and that was it. To my knowledge, he never did any market research to confirm that there was a market for my intended topic.

    The second time I spoke with Stephen Pierce was on the final day, just before I left. I met him in his home recording studio and he briefed me on what would happen next and what would be expected from me in terms of my promotion of my website. This conversation was recorded, but unfortunately I did not receive the recording, as I was told that I would.

    During my time at Stephen Pierce’s house it was in fact his wife, Alicia, who showed the most interest in me and my business. I estimate my total contact time with her to be no more than 2 hours. In my initial meeting with her, she explained that I would be developing a membership based website, delivering content to customers on a monthly basis. She sketched out a basic plan for the business, with ideas for topics for each month. I then met with her in the studio and we recorded the audio interviews that would be used for the website. There were 3 longer interviews, of around 15 minutes each, and 8 shorter ones of just a couple of minutes each. The three longer ones were later transcribed.

    Alicia also set me up with one of the staff members, who made videos of me in the kitchen, cooking low carb vegetarian meals. There were approximately 5 or 6 short videos recorded, also intended to go on the website. Unfortunately, these videos went missing and I never received them. So it was essentially a wasted effort, although it did fill in a few hours.

    For the majority of my 3 days at Stephen Pierce’s home, I was left to my own devices. I was given a desk where I could set up my laptop and I was expected to remain there and research my topic on my own. This was clearly different from the initial promise of full mornings and afternoons spent working personally with Stephen Pierce.

    So, I walked away at the end of the 3 days with no more than an hour’s worth of audio content for my website and transcripts of 3 of the audios. This was not even close to being enough material to get a website started. The impression given during Stephen Pierce’s initial sales presentation at UYMG was that the entire business would be almost ready to go after spending 3 days working with him. A reasonable person would have expected that someone of Stephen Pierce’s expertise, experience and industry contacts could definitely make this happen. So, it would be fair to say that I felt very disappointed with the experience at Stephen Pierce’s home.

    During the following 6 months, there was very limited progress made on my website. I received an email from one of Stephen Pierce’s staff members that listed the names the many different staff that would be taking charge of each aspect of my website. There would be a graphic designer, copywriter, audio person, transcriptionist, web designer, researcher, and someone who would put it all onto the website at the end. I was told to expect many emails to be sent back and forth. I was given no clear direction as to what I was meant to be doing or what would be involved in the process of launching my business. Therefore, I felt very confused and quite helpless in the whole situation, particularly since it was not even clear which of Stephen Pierce’s staff members was actually in charge and who was supposed to be my main point of contact.

    Despite the confusion and lack of direction, I managed to get a few options for a logo sent from the graphic designer, and the audio person added some music to the start and end of a few of my audio recordings. That was the extent of the progress made during that time. Hardly impressive considering my expectation that the business would be well and truly up and running by that time.

    Thankfully, in January 2009, I was contacted by one of Stephen Pierce’s staff members, called Marie. Marie informed me that she would take on the role of my Project Manager, and would be acting as an intermediary between myself and the various designers and writers, effectively overseeing and co-ordinating the completion of my website. This was exciting news, as I now had a point of contact and someone in charge. Plus, unlike me, Marie was familiar with the internet marketing industry and the process of getting a website ready to launch.

    Over the next 7 months, I worked with Marie and was able to make a little headway. The logo for my business was finalised, although it had to be done by a different designer, because the one I dealt with initially had already moved on. I was put in contact with Stephen Pierce’s copywriter, who produced the copy for an opt-in page, a sales page and a 5-part email series. Marie was then able to set up a basic opt-in page for me (this can still be seen on the web by visiting Low Carb Vegetarian Living by Sarah Cox), which then enabled me to begin collecting names and email addresses of people who could be potential customers for my future business.

    Unfortunately, Marie resigned from Stephen Pierce’s company in August 2009, which was disappointing because she was actually making some progress for me. I was told that another staff member, called Chipo, would be taking over. Chipo already had a role within Stephen Pierce’s company, and it seemed as though her responsibilities for PCL were simply added on top of her existing workload. Also, a fashion designer by trade, it seemed as though she did not have the required technical or marketing skills to suit the added work she had been given.

    Regardless, I emailed her immediately as soon as I found out Marie was leaving. I also sent her copies of some of my previous email correspondence with Marie, and some outstanding questions that Marie did not respond to before she left. Unfortunately, maybe due to her high workload, or lack of knowledge, it took nearly 2 months to receive a response. During that time I had to resend my email and remind her that she had not responded. So, my questions were finally answered, however it was now late September 2009. As well as responding to my questions, Chipo asked to have a Skype phone call with me, so that I could bring her up to speed on my project and the overall structure and plan for my business.

    This call took place in early October 2009, and I had to basically explain my project from the beginning. By that time, I had completed a full 8 months worth of content for my site. Through my own independent efforts, I had prepared a mini e-cookbook which included written versions of my own recipes, 14 in total, along with photos and video demonstrations for each. I also had prepared 8 lessons with worksheets and resources to go with each month’s topic, plus a further 16 written recipes with photos and a video demonstration of each. I told Chipo that I needed help with the graphical and technical design of the e-cookbook. We also identified that the sales page would need to be graphically designed and then made live on the internet.

    Over the next 2 months, Chipo worked with the web designer, Karole, on the e-cookbook and the sales page. The work on the e-cookbook was less than impressive. All they did was combine my 14 Word documents (one for each recipe) into a single Adobe PDF document. No changes were made to the graphical presentation of the recipes, so the appearance remained very basic and unprofessional. In this PDF they added links which were intended to lead to the video demonstrations of the recipes. These links did not work and the problem was never resolved.

    Likewise, their work on the sales letter was also underwhelming. Using the sales copy that I had obtained previously from Stephen Pierce’s copywriter, a basic webpage was produced, with various colours and photos added throughout. Unfortunately the links in this webpage did not work, in particular the “buy now” link, and the page never went live on the internet. The beta version of this page can be viewed at Low Carb Vegetarian Living.

    During December 2009, I had 2 conference calls with both Chipo and Karole. They explained to me that they wanted to have my website completed and ready to launch by the end of the year, because they had many other projects due to start early in the new year and would have very limited time available once these started. So, I worked with them and made sure they had everything that they needed to complete my website before the deadline. Since I had provided everything they requested, I assumed that I would receive notification of my completed website very shortly thereafter.

    However, in early January 2010, I received an email from Karole who told me that my videos were in the wrong format, and that I would have to convert them to the correct format and upload them all again. This email surprised me a lot, because I had already discussed this issue with Karole, and she said it was okay for me to continue with the format I was using, and that she would organise for them to be converted. So, I replied to her email and reminded her of our previous discussions. She said that she would look into it and get back to me

    Another month passed and I did not hear anything. I sent repeated emails in February 2010, asking for an update on the progress of my website. By the end of the month I received a response stating that they were waiting on further information from me. Karole said she needed a full 12 months worth of content, testimonials, the monthly price, and what payment processing method I would be using. I was very surprised at this because I had already given answers to these questions. We had already resolved that 8 months of content would be enough, and that the remaining 4 months would be uploaded at a later stage. In fact, Stephen Pierce’s wife Alicia told Chipo, Karole and I, that I only required 3 months of content in order to launch the website. Furthermore, I had already provided testimonials, and I had told them I would charge $9.97 per month and would be using Clickbank for my payment processing. Despite this, I patiently responded and reminded them of this information.

    A month later and I received an email from Chipo, stating that she was leaving her job with Stephen Pierce’s company in order to pursue a career in fashion design. She left at the end of March 2010, and Karole took over full responsibility for my website.

    I finally heard from Karole again in mid April 2010, only after sending her repeated emails to see how things were going. I was shocked at the response. She told me she needed the exact same information that I had already provided to her back in February. I couldn’t quite believe it, but I recounted the same details, for the third time. And again I waited for my completed website. There was nothing more for me to do at that point, because I had provided everything she needed, and more.

    As time wore on, it became increasingly difficult to communicate with Karole. Over the next 6 months I sent numerous emails to her, whereby I would resend previous emails and ask for a response, sometimes adding in new questions for her. Over that time, I heard from her on just 3 occasions. I received one response in July, another in September, and the last email from her was at the end of October 2010. This final response was only achieved after sending a support ticket to Stephen Pierce’s customer service website, in an act of desperation. Each email response simply stated that she was working on my website and that she would get back to me soon. My questions were barely addressed, and it really seemed like she was not doing any work at all on my website. Furthermore, it had become apparent that Stephen Pierce’s company had suffered further staffing losses, including key web design and technical staff.

    By this stage I had started to become highly concerned about the progress of my website and was having serious doubts as to whether my internet business would ever come to fruition. I discussed my concerns with my family, and after explaining the situation and how frustrated and worried I was becoming, my father offered to take over the task of sending repeated emails. He sent two emails to Karole during early December 2010, and copied these to Stephen Pierce’s customer support email address. A third email, this one sent to Impulsive Profits’ customer support email, finally got a response. My father received an email from a staff member called Francis, who introduced himself as being the new Customer Support Manager. Unfortunately it appeared that Karole had left the company, without letting me know, which would explain why she was no longer responding to my emails.

    Francis promised to look into my case and to have my website completed within 7 days, giving a deadline of 17th December 2010. Not surprisingly, this turned out to be an empty promise. He did however assign a member of his “blog building team”, called Duane, to take charge of the completion of my website.

    Shortly thereafter, I received an introductory email from Duane. He requested me to fill out a form with details relating to my website, which I completed and sent back to him. Over the next 3 months, we exchanged about a dozen emails, and also had one phone conversation via Skype. I had to start again from the very beginning. As Duane was very new to Stephen Pierce’s company, he was not aware of the PCL program. So I had to explain to him what it involved and what Stephen Pierce had promised to deliver. I gave him a bit of background of the various staff members I had worked with and what progress had been made. I also had to explain about my intended business, how the website would be set up and how my product would be delivered to my customers. This was yet another setback for me as it took a good couple of months for him to get a grasp of where I was at and all of the work that still needed to be completed.

    During this time, there were a few occasions where I did not hear from Duane for significant periods of time, which meant I was forced to again start resending emails and requesting a response. My father also continued his discussions with Stephen Pierce’s office, maintaining pressure on them to continue responding to me and trying to confirm that I would receive all that I was promised. In amongst his discussions came an admission from Francis, the Customer Support Manager, that my case had indeed been mishandled.

    By mid February 2011 however, Francis had left the company and a new staff member, called Todd, was brought in to take over his responsibilities. Todd confirmed that my website was ready to be built and they had everything they required from me in order to get it going. He also confirmed that he had spoken with Stephen Pierce, and that Stephen Pierce was aware of what he promised as part of the PCL program and would be assisting and advising on marketing and promotions once the website was launched.

    By March 2011, I had finally reached the stage with Duane where he understood what had to be done and was ready to begin working on my website. I had some longstanding issues with my opt-in page that I really wanted fixed. I had brought up these issues in the past but nothing had ever been done. So Duane started making some changes, in beta form, he didn’t change the live site. Things were starting to move along slowly, however by the end of that month, Duane was no longer responding to my emails. It seemed that he too had disappeared.

    By May 2011, I had started to become even more concerned. I sent emails to both Duane and Todd in which I expressed my dissatisfaction with the level of progress on my website over the last 3 years, and stated that if the website was not complete within the next month then I would like a refund.

    In regards to the 12 elements of the PCL program, items 6 through 12 were certainly not delivered, nor were they ever contemplated. Items 1 through 5 were only partially addressed, however none were fully completed.

    As per item 1, I received the outline of my product content. This outline was completed by Stephen Pierces’ wife whilst at their home, at which time it was established that I would be creating a membership based website that would deliver content on a monthly basis. The topics for each month were planned out whilst I was there. In terms of developing the content, after the audio content was recorded, I was left entirely on my own. I received no assistance in any of the further work that I did, which included the recording and production of video content, design of written recipes, and research and writing of lessons and worksheets. Furthermore, the outline and all the work that I put towards it were basically cast aside when Stephen Pierce finally became involved, some 3 years later.

    Regarding items 2, 3 and 4, the audios were indeed produced. However, they were recorded with the assistance of Stephen Pierce’s wife, Alicia. I certainly did not have Stephen Pierce as my coach, engineer or producer at any stage of the process, let alone the whole time! All that was done in terms of “professional final mixing” was that a short verse of royalty free music was added to the start and end of a few of the audios. I received the audios in MP3 format, they were never produced in a physical CD format.

    As for item 5, all that I received in terms of “professional product design” was an extremely basic and visually offensive opt-in page, an equally ugly sales letter, and a rudimentary attempt at production of my e-cookbook. Thankfully, the opt-in page was fully functional. However the sales letter never saw the light of day on the internet. And the effort they put towards my e-cookbook is really not worth mentioning, because all they did was convert the original Word documents I had produced myself into PDF format, without applying any professional graphical design to it whatsoever.

    And that is the sum total of what I received. My product was never made into physical form, never put on eBay or Amazon, and obviously no fulfilment house services were ever employed. I did not even receive a completed website from which I could sell and deliver my electronic content to customers, so therefore I could never receive any marketing services from Stephen Pierce such as mailings to his list, or consultations on how to generate 6 or 7 figure sales from my new product.

    Finally with regards to the bonus items mentioned in Attachment 1, I did receive access to the Instant Traffic Expert System (ITES), which was a series of videos and process maps describing different methods of getting traffic to a website. Stephen Pierce’s staff began setting up a site for me to allow me to resell this information, however they stopped working on it as they claimed it would be a distraction to my work on my PCL program. So, I never had the opportunity to make any income from this.

    The other bonus item was Myspace marketing, whereby Stephen Pierce would design and produce a Myspace page to assist in the marketing of your business. This never happened, because at that time, Myspace was starting to wane in its popularity. I believe that Stephen Pierce was going to set up a Facebook page instead place of the Myspace one. This unfortunately never went ahead either.

    I have worked very hard over the last 4 years to try to get my project completed. Over this time, I have experienced constant emotional stress due to the uncertainty and the doubts over whether my internet business would ever come to life, and whether or not I would receive any outcome from the significant financial investment that I made. This emotional stress and anxiety has taken a heavy toll on my physical health, and I now suffer with chronic fatigue syndrome as a result. Due to my illness, I lost my job nearly 2 years ago, and have been unemployed and unable to work ever since. I am certain that the experience of dealing Stephen Pierce’s organisation has been the main cause of the decline of my health and the loss of my job. I believe that if Stephen Pierce had properly managed his staff, and put a solid process in place to efficiently deliver the PCL program, then my business could have been launched within a matter of months. This would have allowed me to start making an income, possibly even replacing my employment income, which would have preserved my state of health, and could even have allowed me to resign from my job if I chose to do so.

    Internet Business Hopefuls Complain on Stephen Pierce International (5/18/2011)

    With millions of Americans hunting for jobs, some may be drawn to one of the many business opportunities promising ways to earn money at home through the Internet. The Better Business Bureau (BBB) warns that one business opportunity to “Make Real Money on the Internet”(MRMI) isn’t living up to its promises. Customer complaints on Stephen Pierce International, McKinney, TX, describe Stephen Pierce as a charismatic motivational speaker and convincing salesman. The complaints allege that despite paying $5,000 and up, customers didn’t get the counseling and training they were promised, haven’t made money as represented, and had difficulties getting in touch with the business and getting refunds.

    “The idea of working from home can be very appealing to anyone who is looking for a job, needs some extra income, or is just looking for a new career direction. But don’t let your high hopes keep you from evaluating earnings claims carefully and determining whether the business opportunity is right for you,” said Jeannette Kopko, spokesperson for the BBB serving Dallas and Northeast Texas.

    Stephen Pierce International has a BBB rating of F, the lowest rating possible. Although the business has responded to most of the 19 customer complaints presented by the BBB, three complaints remain unanswered and one complaint is not resolved. Complaints are from all over the U.S. – and two are from Australia. In addition, the business has not modified an advertising claim that was challenged by the BBB’s Advertising Review department.

    The business’s website, http://www.stephenpiercelive.com, claims that Stephen Pierce is the “World’s #1 Internet Wealth Advocate”. As part of its ongoing review of advertising claims, the BBB serving Dallas and Northeast Texas challenged the claim. The BBB Code of Advertising notes that claims such as “World’s #1” are objective claims that can be measured. “As statements of fact,” the Code states, “such claims can be proved or disproved and the advertiser should possess substantiation.”

    The BBB asked the business to either substantiate the claim, or to modify or discontinue the claim. Although Stephen Pierce International agreed to modify the claim, as of May 18, 2011, the claim remains unchanged on the website.

    A woman in Georgia complained: “I purchased the Gold MRMI package from Stephen Pierce International for $5,000 … The package was to include an easy step-by-step instruction book for creating the sites – and customer support was to be available by phone. The booklet was vague, incomplete and impossible to follow. … I have worked diligently from the date of purchase anywhere from 20-40 hrs. a week trying to create and launch the sites, and still have not earned one cent. For over 3 weeks I have been trying to call their office to complain – no one answers the phones. No one has returned a call to me from the messages I’ve left. And I have not received a response from emails I’ve sent.” SPI offered to work with her, but didn’t return messages she left. Some complaints allege that Stephen Pierce International hasn’t paid commissions to affiliates. An Arizona woman complained: “I have been a Stephen Pierce MRMI affiliate since March of 2010. It has always been a struggle to receive commissions by this company. After numerous phone calls and emails to try to contact someone about why I was not receiving my commissions, I finally received my first commissions of $118.00 on 5/18/10… The last commission payment I received was for $95.88 on 11/9/10. I have not received any commissions since.” The business responded that it was working on the problem and “we anticipate the affiliate receiving the November 2010 forward payments.”

    Stephen Pierce is also President of Impulsive Profits, Inc., Ann Arbor, MI. The BBB serving Detroit reports that Impulsive Profits, Inc., has a BBB rating of D-, due to an unanswered customer complaint.
    The BBB advises anyone who is considering investing in a business opportunity, whether online or offline, to look into the business, the details of the offer, and the market for the product or service.

    The BBB the and Federal Trade Commission (FTC) offer these tips:

    1. Consider a business opportunity carefully. If it claims buyers can earn a certain income, how many previous purchasers achieved those earnings?
    2. Check out the business. Contact the attorney general’s office, state or county consumer protection agency and Better Business Bureau where the business opportunity promoter is based to find out whether there is any record of unresolved complaints.
    3. Consult an attorney, accountant or other business advisor before you put any money down or sign any papers. Entering into a business opportunity can be costly, so it’s best to have an expert check out the contract first. If the promoter requires a deposit, ask your attorney to establish an escrow account where the deposit can be maintained by a third party until you make the deal.
    4. Take your time. Promoters of fraudulent business opportunities are likely to use high-pressure sales tactics to get you to buy in. If the business opportunity is legitimate, it’ll still be around when you’re ready to decide.

    Still Waiting for a Refund I was Promised OVER 6 MONTHS AGO

    After attending one of the Stephen Pierce Internet Income workshops, I purchased a program for $4,997 because I was promised unprecedented support and that I would be part of a “family” if I invested in this program. I followed the program exactly and was consequently threatened with legal action by another company because, by following the Stephen Pierce program, I was in violation of trademark law.

    On April 4, 2011, I requested advice and assistance from the support department via email. I did not receive a response until May 20, 2011, over 7 weeks later. In the interim, I sent an email to a Chelsea Morris (whom I had met at the seminar) on April 25, 2011, after not hearing back from the support department for 3 weeks. I received a response from a Craig Pettit who informed me Ms. Morris no longer worked for the company, and asked me when I reserved the domain names in dispute. I informed him it was in October of 2010, but again he did not respond.

    On May 7 I sent Craig Pettit another email and his solution was for me to transfer all of my websites over the Stephen Pierce, International. He also requested I send the complaints I received so he could forward them to their attorneys. I informed him I had already sent the complaints to him and canceled my websites from fear of more complaints. Again, he did not respond.

    May 20, 2011 I finally received a response from the support department and requested a refund. TaNoa Kemp in customer support informed me that he would forward my request to the president of the company (Stephen Pierce), and that the president would contact me. 10 days and no response, so I sent Tanoa Kemp another email asking if there was someone else I could forward my request to, and again received no response.

    In June I threatened to contact the BBB as well as share my experience with their company with others, and I received an email from Craig Pettit to a Sheila Watson asking if she had any news for me. The same day an email from a Jesse Frye informed me my refund request had been submitted and they were now waiting for approval, and that he should have an answer for me “mid-week”. I waited 10 days and followed up with Mr. Frye who immediately told me that my refund had not yet been approved.

    July 21 I asked for an update, and on July 25 Gina Watkins informed me that Mr. Frye was no longer with the company and that she was his replacement. She also told me that that Stephen Pierce had to personally authorize refunds but he was out of town so it could be another week of waiting.

    August 3, 2011 i explicitly asked Gina Watkins if my refund had been approved and she said “Yes.. he will be coming into the office tomorrow to physically sign-off/sign checks, etc. However you paid will be the way we process your refund.”

    This was 16 weeks ago. I have sent emails every 2-3 weeks requesting updates, but now no one from the company will respond to me. This has now been going on for 8 months. I have in writing that my refund has been approved, yet they refuse to refund my money.

    This company swindled me and my family out of over $6,000 after all said and done. I can only hope that me sharing my experience will prevent others from making the same mistake I made by trusting Craig Pettit and Stephen Pierce.

    Reading through the documents there it seems they have sued the wrong Dale Brown. The guy who received the summons claims he is an unemployed construction worker and knows nothing about "Coastal Vacations"! He also says he is about to get his electricity cut off!

    What happens in these cases? The guy obviously can't afford a lawyer, or even to travel to the courthouse by the sounds of it.

    Pierce-ing the veil of lies: getting even with Stephen



    As reported on the Salty Droid blog last week, there is a class action lawsuit brewing against Internet marketer Stephen Pierce. And it's about time. For far too long, too many "success" gurus have been peddling their frauducts and flopportunities online and on TV infomercials, persuading thousands of vulnerable and desperate people to fork over millions of dollars that most really cannot afford to spare. Once they realize that they've squandered time, money, and mental and emotional energy for squat, most of these unhappy customers have little legal recourse. Some are too ashamed or perhaps just too stubborn to admit they've been taken, so they swallow it, or they turn a blind eye and order more frauducts, hoping the next one will be the key to the realization of their dreams. Others may own up to being swindled, but they simply don't have the resources to pursue legal remedy.

    Now, with this developing case against Stephen Pierce, we have what could be a notable exception to this sad scenario. It may even inspire other similar actions against serial scammers -- at least those who haven't made themselves sue-resistant by setting up their scams on obscure offshore isles. But perhaps even those hucksters will get their due, someday.
    First things first, though. Says Salty, regarding the lawsuit against Stephen Pierce:
    Dallas Attorney Alan Rosenberg is preparing to bring a lawsuit against Stephen Pierce International {and affiliated companies and individuals} for the victims of SPI’s various scams :: fake opportunities :: and boiler room soul crushings. Alan and his firm :: Chamblee, Ryan, Kershaw & Anderson, P.C. :: have agreed to take the case on a contingency basis … which is super awesome of them because people who’ve just been scammed for insane monies don’t tend to have lots of cash lying around.
    If you’ve been scammed by Stephen Pierce {or a phone room calling in his name} you should consider being a part of this suit. Not just for yourself :: or for the money {which you deserve to get back} … but because it needs to be done for the greater f-----g good. Because it’s not going to stop unless we all step up and do our part to stop it.

After all, on one level, this founder of the defunct Black America Online (it seemed like such a good idea at the time!), and co-founder of the hustledork clearinghouseSANG, is just one of hundreds of smarmy pitch men (and women, though women are a very small minority in the upper echelons of this dodgy industry). Although by many reports Stephen Pierce treats his family, friends, and employees shamefully, there is still nothing particularly exceptional in that; lots of egomaniacs and sociopaths are equally reprehensible. But Stephen Pierce has made himself stand out in a very big way. Writes Salty:
    ...he decided he needed to hire the classless act attorneys at Vorys Sater Seymour and Pease to sue everyone in sight … mostly people he’d already made to suffer … mostly people who can’t afford to hire an attorney. That awesome move was enough to bump Stephen Pierce up to number one on my list … so well done there champ.

    According to Salty’s investigating, Pierce not only has scammed tens-to-hundreds-of-thousands from people buying biz-ops, but he also flexes his lawyer on them, and sues people all the time. It doesn’t take a genius to do a little web searching and find tons of complaints on Pierce – but these are common in the stinking, scuzzy world of biz-op Internet marketing. What is not common is to sue people as much as Pierce does, and this is pretty unappealing by most standards. It’s like stealing the wheels off wheelchairs, or raping the wounded.
    Couldn't have put it better myself.

    And by the way, I've addressed this point before but will go there again for the benefit of any new readers. Some people are put off by the "salty" language on Salty Droid's blog. Some are confused by his sometimes cryptic writing style, and they end up scratching their heads and wondering what the heck he's talking about. (Following the many links he provides would actually clear up much of that puzzlement, but some folks don't bother.) One person whose work I respect even warned me that by quoting Salty so much on my own blog, I might be damaging my own credibility (such as it is). And some simply dismiss Salty as a hater hiding behind a fake-robot persona.

    Well, he is a hater -- of scams. But he's hardly hiding. As I am doing with my Cosmic Connie persona, Salty is hiding in plain sight. He reveals his real name -- Jason Jones -- and other personal information right there on his site. And while some of the profanity might make you flinch, I urge you to stick around for the real information about real scams and scammers. As I've said many times before, I believe that Salty-aka-Jason's heart is in the right place, and so is his head. I am far from the only person who thinks he's doing good, especially with his latest series about Stephen Pierce -- a series that is still ongoing. If you really want to get up to speed about Stephen Pierce, follow this link. And don't worry; you'll get used to the language. Just try to put it in perspective: A few cuss words here and there aren't nearly as bad as the real harm that is being done by the folks being cussed.

    It wasn't too long ago that, like millions of other people, I'd never even heard of Stephen Pierce. My blog had always focused on those whom I considered to be the higher-profile New-Wage/selfish-help/McSpirituality gurus and some of their minions -- you know, the stars of The Secret, Oprah's darlings, and the like. Reading Salty Droid's blog opened my eyes to other, intimately related, factions of the industries I'd been targeting for many years.

    But Stephen Pierce still wasn't really on my radar until I heard from a former employee of his. Without mentioning any names at the time, I wrote a post about that person's experiences a few years ago:Whirled Musings: The lies that blind. In retrospect, knowing what I know now, I see that my post barely touched on the atrocious behavior and hypocrisy of Stephen Pierce. My main point in writing it was to bolster my contention that hypocrisy, appalling behavior, and train-wreck personal lives are par for the course with all too many motivational, marketing, and pop-spirituality "stars." The people who make millions telling us how to live our lives are the ones whose own lives are sorry examples.

    Now it looks as if Stephen Pierce may really get what's coming to him. Perhaps in the process, some of his colleagues and enablers, such as the notorious Utah-based "coaching" mill and boiler room Prosper Learning, may get a little karm-uppance too.     The good news is that you can help with the effort to pursue justice for the victims of Stephen Pierce. First off, I'll reiterate what I cited above: If you -- and/or someone you know and care about -- were scammed by Stephen Pierce or anyone representing him or Stephen Pierce International, contact attorney Alan Rosenberg at arosenberg@chambleeryan.com. Even if you were not directly affected, you can help by spreading the word. In Texas, attorneys are not allowed to solicit clients. So it's up to all of us interested lay folk to get the word out.
    You can use social media, for example. Tweet about this matter, and write about it on your Facebook status. Of course, you can also blog about it if too you feel so moved. Some of my favorite bloggers and scam fighters have already gotten in on the act, including:

    You might also consider writing comments -- again, as appropriate -- in some of the discussions following reviews of Stephen Pierce's work on Amazon.Here's a page for one of his books. But please don't spam. Don't just copy and paste the same comment on dozens of threads, as that doesn't help the cause at all. As Salty noted on a thread on his blog, we have to take the high road -- both legally and morally -- all the way.
    But I do urge you to do something. If not for yourself, do it for the thousands of people who feel they have been scammed by Stephen Pierce, those who have been maltreated by him, and those who haven't yet awakened from their fever dream of being led by the hand to unlimited wealth by this blustering blowhard. There's sweet little Mrs. Saunders, for instance, hand-painter of Christmas ornaments, who was still apparently enamored at the time she put this video up in 2010:

    In the video, there is a very conspicuous cross on the wall behind Mrs. Saunders, which for me just raises the question: WWJD? (Maybe he'd get behind this contemporary effort to throw the moneylenders out of the temple?) I can't help but wonder if Mrs. Saunders has since joined the ranks of the disillusioned. Whether she has or not, however, thousands of unhappy people are decidedly in those ranks, and would like to see a little bit of justice. Here's hoping they get it. As Lynn Edgington of Eagle Research Associates wrote:

    We want to wish everyone who has been a victim of Stephen Pierce, and his companies/programs all the success with getting some of your money back through this lawsuit. This attorney firm is not a firm that is interested in “settling” the case. They are trial lawyers, and they relish going to trial. The mere fact they are doing this on contingency is saying they will try this case.

    Having looked at the document provided by Pierce's lawyers of the website that allegedly defames Pierce, I can't see anything that could be called defamation, or am I missing something?

    The site seems unfinished, (the About page still has the default WordPress message), and contains just images of Pierce's adverts and embedded YouTube videos which mainly praise and hawk his products. I have a feeling it is an unfinished "Is Stephen Pierce a Scammer? Don't buy anything until your read my review" type site, which then goes on to offer all these "amazing bonuses" if you buy a Stephen Pierce product through the (always positive) "review" writers affiliate link.

    I think I'll try emailing Mr Brown and mention the brewing class action lawsuit to him. Either Mr Brown is lying or Pierce's lawyers, Vorys Sater Seymour and Pease, haven't done their homework very well.

    We should turn that into a poll. I would not be surprised to find the attorneys had not done their homework. I have personally sat in depositions and courtrooms where that was quite obviously the case. I think they are betting on winning by default or Summary Judgment as the Defendants won't know how to answer and / or spending their opponents into silence.
    I am not a lawyer, but I do know that Stephen Pierce could be considered a limited public figure in a Texas court and the standards for defamation in that instance are quite high. Pierce and his flunkies better find some false statements of fact they can document and do so quickly before some savvy counsel turns them into hamburger meat! Judge Ginsberg does read everything and he is quick with his pen!!!

    And, needless to say I might show up for some of the hearings and would love to publish the court papers as is my alarming habit!
