    So would I, Wes. Other than him shaking his head in disbelief over all this, I have no idea how he's reacting or what kind of things he's been scorching John's ears with. Speaking of him, though, that reminds me of something. If, by chance, that property at 3600 Tolbert had been purchased using monies obtained via operation of a cash gifting programme, does that taint stay with the property should the Bains sell it to someone else?

    Now, I need to briefly move away from the Bains themselves to delve into a bit of history.

    Tom Yatar, mentioned above, was in 2008 part of an online community devoted to spreading cash gifting. He, his partner Ruth Sias, and Chris Bernardo have all been part of John Bains' gifting programmes, but in 2008 they were also part of a gifting group which, at the time, met all of the criteria for charges to be have been filed under the Racketeer Influenced and Corrupt Organizations Act. That organization was Elite Activity Resurrected, later known as Connecting Us All.

    Let's take a look at what Tom had to say about his brief membership, and what the few surviving ads promoting the tie between Elite and the "Furry Hat Guy" said. The ad promoter got Tom's first name wrong, but she definitely meant him.

    In 2010, they tried to funnel money into the Arizona senate race. Their sponsored candidate, Rudy Garcia, endorsed them in glowing colours before he found out that they were organized crime and quickly left the race & CUA.

    How does this pertain to the Bains? Well, Tom, Ruth & Chris were very minor in Elite. But someone else in TPP was in the inner circle, one of Elite's/CUA's leaders. Her name is Paulette Maria Peutz, in Oregon.

    Next subject: Lack of security & unprotected passwords.

    As you might guess, John has been livid about certain items published in this thread. I'm going to tell everybody
    how I acquired them, and just how badly John has handled it.

    First, back in 2011 or 2012, while researching some of Sally Darling's fraudulent activity, I stumbled upon a
    posting that contained her email account and those of several other online marketers. It had been published on
    March 15, 2010, and still easily found using a search engine today. In addition to the emails, it included the
    usernames and passwords with which these individuals logged onto ProFusionX. Around 2 years later, the key from John's
    ProFusionX adm1n account was discovered to fit the lock of admin@thepeoplesprogram.com as well... everywhere.
    The Alertpay Sins of John Bain was one of the results. On June 25, 2012, John showed here demending to know how I
    got it, and I told him. I also cited several sources and cases to him as to why TPP was a pyramid scheme. He
    blew them off. Between June 25 and June 30, 2012, he acted to have the portion of said file which had been posted
    on another forum removed, which was fine with me as it was the choice of that sites' admin to handle it that way.
    On Aug. 21, 2012, lutarian showed up and made noise for some time afterwards. What strikes as odd though, was that
    he had a video of the removed posting, http://screencast.com/t/ZBrwIDeINsl0, which I now suspect was of John Bain's
    own making seeing how he uses that site in his communicatins with Anjay. The tabs up on top suggest that quite a bit
    more was going on in the background. Now, if John had this for his own use or for use against me, that is
    understandable. But someone who claimed not to be him, yet shared a username with a number of his accounts, had it.
    Looking back, I feel like I should have delved into that matter sooner.

    Jump ahead to Jan. 4, 2015, and John happened to contact me here to comment on the thread about Soapboxmom's
    neighbors. I replied, and asked what was up with TPP's disappearance. He bullshitted about not having any technical
    problems, and we got into a bit of an argument. That was when I decided to take off the kid gloves and go after
    him like I had his members & victims, something which I had mostly avoided doing before thanks to certain things
    he said in 2012 which had led me to think he was trying to start up a real company of some sort. I started checking
    up on his known addresses, and low and behold, one brought up a most peculiar website.

    It was directly findable through a normal Google search, and had the username and password of one Chuck Guyett,
    a member of John's PWS program. By itself, that was inconsequential, but it also held John's mailing address and
    payment instructions. Seeing as it had an ID#, I tweaked it, starting from the beginning to see who was really in
    charge. Do you know what I saw? The admin account, and its' password. I logged in, saw the two accounts directly
    "invited" by it were identical to the pair I'd seen John use back when I looked into ProFusionX. He was the admin.
    I used the internal mail system to send a message or two to let him know that his security wasn't up to snuff,
    and tried both it and the old key on the various locks. A few responded, but not many. His mattchrisbain email
    account said that the password had changed less than 2 days ago though, telling me that this had been the password.
    I mean, something this obvious had been freely open to every PWS member since 2009? The next day I came back, but
    the problem hadn't been removed. The password had changed though. So I tried it on mattchrisbain again, and it worked.
    John had handed me the means to read his emails himself, fully aware of the page I was viewing.
    I saw who he was associating with, saw the kind of talk that went on in their social circle, and saw his plans for a
    new programme with grand theft dollar amounts. So I began this thread. As expected, John stormed in demanding to
    know what I was doing and for me to remove anything I'd acquired from his email account. However, the way Realscam
    is coded, I cannot edit or delete anything after ~40 min. He'd asked several hours too late; it was out of my hands.
    I do apologize to Kent Moore for violating his privilege as an attorney. However, I also hope that John realizes that,
    should he take me to court for this, everything in this thread and associated ones becomes unavoidable evidence that
    should be passing in front of a judge.

    Can his 'friends' afford the kind of exposure of their financial activities which this would entail, or the
    effects of the discovery phase of a lawsuit? Omerta...

    On Jan 10, 2015, I made screen captures from John's mirror site, still with the administrator account
    and password visible. It is no longer synched to John's email, thankfully.

    What is truly funny is that when Luterian was posting in his thread he really didn't think that any of us knew who he was. Many of us knew exactly who he was, we just didn't tell him. If we had, he would have stopped posting a lot sooner and we needed him posting as it was a great education for those visiting RS. They were able to learn how these people think and all their circle-jerk logic they use, as well as all their obfuscation, red-herring comments and constantly changing the subject to keep from answering serious questions. But the funniest of them all was his claim he wasn't defending cash gifting when that's all he was doing.

    After all the froth and bubble threats have finished, John "Lutarian" Bain is still left with the fact he is a serial promoter of illegal cash gifting. and every time he pops his head out from under his rock, a few more of his followers drop off as they come to realize it.

    Personally I hope he continues to keep himself front and center in the public eye, so that when the inevitable happens, it will be all his own work

    Here are the lies he is trying to pass off in defiance of the laws cited above.
    Is Cash Gifting Legal?

    This is probably the number one question that pops up when people start to see the lucrative potential with this kind of activity, and it's certainly the first thing that I wanted to know too... after all, I have no interest in getting into any type of legal hot water, and I'm sure you don't either, so here's what I found out.

    In researching this activity, it's important to keep in mind that there's no book out there that tells you what is legal in our society, only what is not legal.

    If you do your research online, you're going to see there's really nothing saying that cash gifting is illegal. Most of the time it's people expressing their personal opinions, not facts. And after years of experience and thorough research, no one has been able to show me the law in black and white stating that giving a cash gift is illegal.

    In fact, I learned that both American and Canadian citizens have the Constitutional right to gift property, cash and other assets. Many other countries participating in cash gifting also have very similar gifting laws.

    In the United States we have the Preamble, the Constitution and the Bill of Rights to protect a private citizen's rights to earn, pay taxes and give away property and cash as long as it's done according to the laws and codes of this country. The U.S. gifting rules are found in the IRS Tax Code, Title 26, Sections 2501-2504 and 2511. "Click here" for this document.

    In 2008 in the United States of America, the law states that one or more individuals can give a cash gift to another individual of up to $12,000 each per calendar year without any tax liability to either the giver or receiver of the gift, because the tax on the gift has already been paid.

    I also found that most well organized Cash Gifting programs require each participant to use some form of a Gifting Statement and/or Non-Solicitation form, which when signed, become binding agreements between two private individuals. These forms are used, it's said, to ensure the longevity and legality of a gifting program.

    So giving a gift of cash to someone, be it a friend, family member or a stranger is legal according to IRS code. Again, there's no specific nation-wide law that I've been able to find to say that cash gifting is not legal.

    Now, that being said, it's important to note that not all Cash Gifting programs may be legal in their structure. Certainly there are some that may not be. Unfortunately, there are still some "old school" Cash Gifting programs out there (mostly offline) that weren't structured properly in order to sustain their efforts for any considerable length of time, and some of them use an illegal pyramidal type of structure.

    Consequently, many of these types of mostly offline programs in the past were closed by the feds because of this illegal "ever-widening base" pyramid structure and gave Cash Gifting a bad reputation.

    However, in recent years, things have changed and more and more people are benefiting through the use of these types of programs than with any other structure in the World.

    Is this a pyramid?

    I like to get the cash as a gift for a few of the services that I provide and the payment is coming via Paypal. The

    reason it works for me is not the same as the person that is paying however.

    Cash gifting has been around for years and just like you pointed out, the IRS has had a clause about it in the tax code
