Will my personal bankruptcy affect my LLC?

My husband and I have an LLC in Nevada and we are looking into filing for personal bankruptcy. Will this affect our LLC or is it considered a seperate entity?

Answered 2 years ago. If you could sell the LLC, pay off all of the LLC's debts, and still have money remaining, then Yes, your personal bankruptcy would affect your LLC.
When you file bankruptcy, the trustee's job is to take any asset you have that has a value, sell it, and use the excess money from that sale, to pay some of your debts. If your LLC owes more in debts than it has in assets, then it is not an asset that has any value so the trustee will generally 'abandon' the asset and you're good.

An LLC protects you from the liabilities of the LLC but does not generally protect the LLC from your personal liabilities.....

Answered 2 years ago. The LLC will not be affected assuming it has outstanding debt that exceeds its assets or if there are no assets of the LLC at all.

We have Holbrook's accounts receivable from Huber Heights on pages 17-18 where his LLC Don Allen Holbrook LLC received $53,800.00:

Then we have the Holbrook's personal bankruptcy monthly statement where he is shown to have only $876.00 to his name:

Where did that $53,800.00 paid since December 2011 go? Is the LLC broke? Is Holbrook just leaving money in the business accounts thinking it does not have to be disclosed in the bankruptcy? Holbrook also had over $800,000.00 come in through that same Don Allen Holbrrok LLC in 2009, but he shows earnings on his bankruptcy of only $90,000.00 for that year and went on his grand tour of Europe that summer. None of this makes any sense.

King Holbrook vs. the peasant:



I wonder if King Holbrook will have to explain to his clients and the taxpayers why he removed his video. Aren't we all still waiting for those 100 + projects worth billions of dollars that created 50,000.jobs? Will that issue come up in the Huber Heights case? That video was a public representation that Holbrook used to lure in clients. Will he be forced to substantiate those claims as part of litigation?

Will his highness be forced to explain why he lied to Pahrump and wrote to them that Earthquest was breaking ground in December of 2011 or early 2012? Lots of questions and no answers from Holbrook. Until Holbrook's videos resurface, I guess it is back to Monty Python we go!

Holbrook pretty much guaranteed any lawsuit he files against any critic will be deemed a SLAPP and thrown out at his expense. From afar, there doesn't appear to be any "conspiracy"

Just a whole heap of citizens exercising their right to ask questions of and demand answers from:

1) Their elected officials

2) consultants employed by said elected officials.

So, he ain't gonaa get any 13 million. Due to SLAPP protection he will most likely have cases turned around on him and have to pay everyone's cost of court and attorney fees.

If i can easily find so much about Holbrook online, why didn't the EMCID and McCrady check all this out before spending millions of tax dollars at Holbrook's behest???

Holbrook’s employment history was also put under a microscope by the Texas newspaper.

According to the article, he was hired and fired on numerous occasions and rang up thousands of dollars in dining, lodging, and travel expenses.
In some instances, he was on the job for less than two years.
The article stated that in 1996, Holbrook was hired by the Port Authority in Red Wing, Minnesota and was subsequently fired in 1998 for questionable spending practices and falsifying his resume.
The paper also claims that in 2001, Holbrook was hired by the Lake Havasu Partnership for Economic Development, but less than two years later his employment contract was not renewed.
Holbrook said family issues at the time superseded his employment responsibilities.
“I chose to leave Lake Havasu because my parents were back east in Ohio. That was my choice. My mom and dad are in their 80s. I took a position 30 miles from mom and dad. I’m their only child,” he said.

I just quoted the Wayne County Indiana statements concerning the necessity of firing him. I will also note Holbrook is no where near his parents and hasn't been for years.

So, someone must not be doing their homework. Looks like some of what goes on in IEDC has a definite resemblance to Don Lessem's remark in the Houston Press. "His profession is about professional bullshitting," Lessem says.

Here is another interesting blurb by Holbrook. Where are all these huge speaking fees showing up in his earnings on his bankruptcy??? He claims less than 100 grand a year for the last three years and the only source of income named next to those paltry figures is EMCID????

Apparently, Holbrook is planning to sue me, an individual from Pahrump, the websites publishing comments and any posters who continue to dare to discuss his royal majesty, the Black Knight, and boss of the internet.

Hilariously, though we are discussing Earthquest and Holbrook's involvement with that and our friends in Pahrump are discussing their own project with Holbrook, Holbrook's attorney who sent me that lovely letter is in Ohio. Apparently, Holbrook's attorney knows of several Ohio residents that have been reading me. Gasp! Argh!

As I already noted, I have been sued for my blogging before and won in Summary Judgment. I sued that same clown for libelous statements about me and he was forced to remove them. This is nothing new to me.

There is nothing wrong with quoting newspaper articles and public record. Opinion and hyperbole are not actionable. So, I guess Holbrook better pop some popcorn and enjoy the Monty Python clips from Youtube.

I believe, since we are not in Ohio and our discussions are centered around projects in Texas and Nevada which have anti-SLAPP laws, that any suits filed in Ohio would be easily challenged as to the jurisdiction and venue. With that tough anti-SLAPP law in Texas, Holbrook, who has posted on numerous websites trying to frighten and threaten detractors into silence, would likely find a lawsuit quickly turned around on him. He would then be paying all costs of court, attorney fees and possibly punitive damages as well.

If EQ is never built, east montgomery county residents will be paying back taxes for 28 years with nothing to show for it. Not exactly the best way to attract quality residents. No EQ, east Montgomery county become a ghetto. This is assured.

I hope the new board members that come in will take a hard and fresh look at this debacle and determine if EMCID has any recourse to recover tax money blown on this. Holbrook's hideous threats designed to frighten the great State of Texas' citizens into silence has backfired completely. Kudos to our fine citizens who have the courage to speak out!!!
