    Huber Heights agrees to settlement with economic developer

    A settlement has been reached between Huber Heights and an economic developer the city filed a lawsuit against in April 2012.

    Huber Heights and Don Holbrook — a Dayton native who’s based in Las Vegas — recently finalized a settlement agreement and mutual release of all claims after the city spent almost a year trying to recover more than $50,000. City Council unanimously approved the resolution at its March 25 meeting.

    Huber Heights filed a lawsuit against Don Allen Holbrook, LLC in Montgomery County Common Pleas Court on April 24, 2012, claiming Holbrook did not fulfill terms of a $66,000 contract signed in December 2011.

    The contract called for Holbrook, a 1979 Vandalia-Butler graduate, to create an economic development business case for the city, looking at the potential of expanding The Heights project — the mixed-use development near the Ohio 201 and Interstate 70 interchange.

    The city paid Holbrook in two installments — $23,300 on Dec. 14, 2011, and $30,500 on Feb. 12 of last year, according to invoices. Holbrook turned in his final product March 13, 2012, before the city made the final payment of $12,200.

    The city withheld that payment because, according to the lawsuit, the product “wholly failed to conform to the terms (of the contract) and wholly failed to conform to industry standards.”

    The city accused Holbrook of breach of contract, conversion, unjust enrichment, fraudulent inducement and negligent misrepresentation. Huber Heights demanded its $53,800 back, as well as punitive damages and attorney fees.

    Holbrook responded by filing a counterclaim, a motion to dismiss four of the five claims, and a third-party complaint against newspaper reporters and bloggers around the country. The third-party complaint was dismissed by the courts Oct. 19.

    Holbrook alleged the city owed him the remaining $12,200 of the contract, and accused it of trade secrets and withholding public documents, notably “defamatory and derogatory material” circulated amongst city staff on or before March 14, 2012.

    In the settlement approved by council this week, no money was exchanged, but each party has to pay its own attorney fees. The city will pay for all court costs.

    Total estimated cost to the city was $12,750, according to city attorney Alan Schaeffer. He said if the case continued, it would have cost the city at least $35,000 to $40,000.

    “It reached a point for both of us where we were both going to have to spend a substantial amount of money to move forward,” Schaeffer said. “The parties got together and asked, ‘What do we want to do here?’ A settlement was considered as an option. This was a good result for the city.”

    The terms of the agreement also included: the city dismissing claims against Holbrook; Holbrook dismissing his counterclaims against the city; and the city not permitting any third parties to use Holbrook’s work product. Nothing in the agreement constitutes an admission of fault or liability by either party, it said.

    “We ended the lawsuit for the same reasons we filed the lawsuit, which were to seek redress and make a point,” Schaeffer said. “We terminated the lawsuit through a settlement agreement having accomplished substantially what we wanted to.”

    Holbrook said he spent approximately $20,000 in legal fees, and it would have cost another $20,000 to proceed.

    “I’m not going to chase something that has no ability to have a positive return on it,” he said. “I wouldn’t recover enough money to pay attorney fees, so this made financial sense. It leaves a bad taste in my mouth because it is my hometown. I have no ill will towards Huber Heights. I’m glad it’s over.”

    Huber Heights Vice Mayor Mark Campbell also said he is glad to be moving past the lawsuit. In recent months, the city has been focused on developing an $18 million music center and $22 million fieldhouse, which are scheduled to be completed by next summer.

    “Things like this, as they linger, continue to distract,” Campbell said. “The future that this city has in front of it is such that we need to take advantage of opportunities, not continue in the past.”

    Today is my birthday! It’s been very special because my family each put so much thought into their gifts to me. These weren’t gifts you pay for they were gifts of personal meaning and acts of kindness and affection. Those gifts are so priceless.

    Scammer Holbrook is having a whale of a good time with his fruity bankruptcy filing. The Assistant United States Attorney is insisting scammer boy pay every cent of the almost $200,000.00 in taxes owed on the ill-gotten gains from the Earthquest debacle. The blabber mouth has neglected to file his 2011 taxes as required. His 2012 taxes were not filed as of the filing date either. The creditors no doubt are still demanding to know how this big buffoon is paying $35,000.00 a year for the boys exclusinve private school when he is still not paying them.

    How sweet. Laurie wrote Lardbelly encouraging him to visualize happiness and stability in his second half of life. If the IRS gets their way,(which they will), that stability will come when BagBoy is leaning on a Kroger grocery cart at the ripe old age of 72. The happiness will come after his 200,000th trip for a dollar tip carrying old ladies groceries to their car, and he's finally paid the IRS for his 2010 and 2011 taxes.     Town board to hear latest Contour report

    Pahrump Town Board members and staff will get an update on the latest phase of a proposed tourist destination called “Adventure Springs” during next week’s regular town board meeting.

    Last year, Chris Brown, president of Contour Entertainment, who was hired to design the project, provided the board with his vision for a theme park to bolster tourism to the Pahrump area.

    The town has so far spent more than $255,000 on the first two phases of the project.

    Pahrump Town Manager Bill Kohbarger said a presentation by Contour Entertainment on Tuesday will include an interim report on the status of the project, tentatively slated to be constructed at the Pahrump Fairgrounds site on the south end of the valley.

    “We will learn a lot more next week. We are not 100 percent positive, but we would like to have it there at the fairgrounds because it is town property and we can get everything in there. There are other locations in town where it can be built, but the fairgrounds are number one. It could change though,” he said.

    During another meeting last year before the county, Brown did not appear to have any support from Nye County commissioners, who were at best skeptical about the project, which had already been pitched to the town board.

    Kohbarger on Monday said he has the utmost confidence in Brown and Contour on delivering what would be best for the town.

    He enumerated several projects that Contour has signed onto.

    “Contour is a phenomenal group. They are doing worldwide production and they have a project going on in India and they have a project in Dubai. They also have a project going on at the Fremont Street Experience in Las Vegas,” he said.

    Kohbarger said the Vegas project involves a zipline attraction known as “SlotZilla” in downtown.

    He noted that Fremont Street Experience President Jeff Victor said the attraction will be a permanent fixture consisting of an 11-story slot machine takeoff platform near Las Vegas Boulevard and Fremont Street.

    Victor in a recent press release said the attraction is scheduled to open sometime this year.

    “We wanted to take a ride typically found in the jungle, give it amusement park features and qualities, and build it in the middle of downtown,” the November 2012 press release states. “Designing a zipline to go across 1,700 feet with only a slight incline was a real challenge and required us to think outside the canopy and develop new technologies.”

    Town Board Vice Chair Bill Dolan, who was elected to the board after the Contour agreement was made, said he is still doing research on the feasibility and logistics of the project.

    Dolan is also the town board liaison to the Pahrump Arena Advisory Board.

    “We have to wait and see. I will say that the arena board is also working on a phase out there to get to the west of where the soccer fields are right now. They are putting plans together to present at a later date to the town board on some new arenas out there so we can start attracting and drawing in more events that will put people to work and generate some funds to move onto other phases,” he said.

    Meanwhile, on the issue of funding the Adventure Springs project, Brown told town board members that he estimates more than a half million dollars will be spent before ground is broken.

    On the funding issue, Dolan said he will be able to provide a more informed response following next Tuesday’s town board meeting.

    “I want to read the report and I want to hear what staff has to say about it. I just want to make a concerted effort to vote the way I think I need to vote while protecting the residents of this community,” he said.

    One person with an apparent dubious financial history will not be involved in the upcoming phases of the project.

    Don Holbrook, who was involved in the initial conception for a tourist destination in town, is out of the picture, according to Kohbarger.

    Holbrook came under scrutiny after it was revealed that his past business dealings were mired in litigation in both Texas and Ohio.

    “It was the grand opening of the fairgrounds and we just wanted to show everybody in the town what we are doing out there and how the money is being spent. We had some drawings up because we wanted everyone to know how the project was going,” he said.

    Dolan said the grand opening coincided with several other events occurring just adjacent to the fairgrounds site.

    “There was a culmination of a lot of things that night of the ribbon cutting. The raceway had a very big race that morning and there were a couple of 5K races at the raceway for cancer. Red Apple Fireworks did a two-plus hour fireworks display free for the community and they had people in from all over the country to see the demonstration. It was two and a half hours of fireworks and it was just a marvelous thing and the town did not spend one penny for anything there,” he said.

    Town board to hear latest Contour report

    Pahrump Town Board members and staff will get an update on the latest phase of a proposed tourist destination called “Adventure Springs” during next week’s regular town board meeting.

    Last year, Chris Brown, president of Contour Entertainment, who was hired to design the project, provided the board with his vision for a theme park to bolster tourism to the Pahrump area.

    The town has so far spent more than $255,000 on the first two phases of the project.

    Pahrump Town Manager Bill Kohbarger said a presentation by Contour Entertainment on Tuesday will include an interim report on the status of the project, tentatively slated to be constructed at the Pahrump Fairgrounds site on the south end of the valley.

    “We will learn a lot more next week. We are not 100 percent positive, but we would like to have it there at the fairgrounds because it is town property and we can get everything in there. There are other locations in town where it can be built, but the fairgrounds are number one. It could change though,” he said.

    During another meeting last year before the county, Brown did not appear to have any support from Nye County commissioners, who were at best skeptical about the project, which had already been pitched to the town board.

    Kohbarger on Monday said he has the utmost confidence in Brown and Contour on delivering what would be best for the town.

    He enumerated several projects that Contour has signed onto.

    Contour is a phenomenal group. They are doing worldwide production and they have a project going on in India and they have a project in Dubai. They also have a project going on at the Fremont Street Experience in Las Vegas,” he said.

    Kohbarger said the Vegas project involves a zipline attraction known as “SlotZilla” in downtown.

    He noted that Fremont Street Experience President Jeff Victor said the attraction will be a permanent fixture consisting of an 11-story slot machine takeoff platform near Las Vegas Boulevard and Fremont Street.

    Victor in a recent press release said the attraction is scheduled to open sometime this year.

    “We wanted to take a ride typically found in the jungle, give it amusement park features and qualities, and build it in the middle of downtown,” the November 2012 press release states. “Designing a zipline to go across 1,700 feet with only a slight incline was a real challenge and required us to think outside the canopy and develop new technologies.”

    Town Board Vice Chair Bill Dolan, who was elected to the board after the Contour agreement was made, said he is still doing research on the feasibility and logistics of the project.

    Dolan is also the town board liaison to the Pahrump Arena Advisory Board.

    “We have to wait and see. I will say that the arena board is also working on a phase out there to get to the west of where the soccer fields are right now. They are putting plans together to present at a later date to the town board on some new arenas out there so we can start attracting and drawing in more events that will put people to work and generate some funds to move onto other phases,” he said.

    Meanwhile, on the issue of funding the Adventure Springs project, Brown told town board members that he estimates more than a half million dollars will be spent before ground is broken.

    On the funding issue, Dolan said he will be able to provide a more informed response following next Tuesday’s town board meeting.

    “I want to read the report and I want to hear what staff has to say about it. I just want to make a concerted effort to vote the way I think I need to vote while protecting the residents of this community,” he said.

    One person with an apparent dubious financial history will not be involved in the upcoming phases of the project.

    Don Holbrook, who was involved in the initial conception for a tourist destination in town, is out of the picture, according to Kohbarger.

    Holbrook came under scrutiny after it was revealed that his past business dealings were mired in litigation in both Texas and Ohio.

    Holbrook's latest bankruptcy filing is quite a read as usual. He claims over $16,000.00 in income for the month of March for his work for BlueGreen Resorts. That sleazebag, who is pimping timeshares, should not be able to weasel out of paying his creditors with a fruity bankruptcy like this. While he made his fortune off of the taxpayers with his Earthquest scam, he wasn't paying his taxes. He was touring Europe and living like a king. His wife sports a Reverso watch while he parades around in Feragamo shoes. The boys have been attending that exclusive private school at a cost of $35,000.00 per year. Holbrook is a part owner of a winery and seems to quite happily partake from the pictures he was posting.

    From following the bankruptcy it appears his sole source of income is his BS presentations for BlueGreen, unless he is accepting payments to his business accounts and not taking draws. Certainly, Contour is not hooked up with that clown any longer. I haven't seen any evidence he is bringing them any of his destination theme park crap or soliciting it with that goof Chris Brown. Any business accounts should be made public as should an explanation about how someone who cannot pay their taxes and debts can enjoy an exclusive private school and a lifestyle of the rich and famous.

    So, one person with an apparent "dubious" financial history will not be involved in the upcoming phases of the project? What a crying shame. With "Dubious" Donnyboy, there were some mistakes and he is now out of the picture. Yeah, his biggest on my end was threatening this "Taxpaying Texas Trailer-Trash " <<< lol with a lawsuit for speaking out against the wasteful spending of taxpayers money.     Here's hoping Karma takes a bigger bite out of Holbrook than the numerous ones he took serving himself at Frank McCrady and the EMCID'S buffet line.     No if you read the contract he is still a sub contractor under the Contour brand.
