    • Mike Anderson I would guess it is about a 50-50 chance. We are still waiting to hear something official from Contour. The land ownership phase is still being sorted out. I guess we probably won't hear anything until after the land ownership has been completely settled. McCrady said this should happen in June, so I hope we hear something within the next month or so.

    • Michael Mahle all of it would be sold to lennar homes with contour having the option of purchasing it from lennar. I personaly dont see contour needing all of the land. The portion of land along the creek was where the park was to be built in the first place so i could see contour purchasing that part from lennar and lennar building homes on the other part. I think astoworld was only on twenty acres so it should be more than enough land. I believe it would benefit lennar if the park is built so they could sell homes for a premium price. Thats just how i see it. Hopefully they see it that way.

    • Mike Anderson According to the master plan on the EarthQuest website, the east side of 59 is going to be homes and retail and the west side is going to be the theme park and resort area. I think Michael is right about the way Lennar Homes and EarthQuest will split the land up on the total 1600 acres. The EarthQuest side is to be 500 acres, but only about 100 acres are actually needed for the theme park. The AstroWorld plot was something like 104 acres total. But that included WaterWorld, the park offices, the concert stage area, the company picnic areas and a few acres that were left for future development. The actual area that the rides and paths were built on covered about 70 acres I believe. The 500 acres that EQ will have to work with is suppose to include the theme park, the water park, the hotel, the institute, the smaller 'green gadget garage' park and the 'earthwalk' section. Personally at this stage of the game, I would gladly settle for just the theme park to be built NOW and hope that the other stuff gets built eventually over time as the resort starts taking in cash. But the THEME PARK is the real money making attraction and that should come FIRST.- just my 2¢.

And why are you saying you don't like Astroworld, well I tell you my Story, Astroworld was an good darn theme park with world's greatest roller coasters, & when Astroworld closed, I was in the 6th Grade 12 Years Old upset for 5 years then, I didn't have any money to visit San Antonio, or Dallas, and Kemah improving, like I said Tilman Fertitta probably dosen't have billions on money, or he don't want to improve, but look at the land of Kemah see how small it is, & IT'Z is not even big enough to put in like Galaxyland from Canada, I wouldn't depend on Kemah, just sayin, cause Kemah is alright to me, at least there's two roller coasters in Houston right now!

It was written last Monday regarding the company who is purchasing the land the EQ is to be built one. This article says that the land the park is to built on (the 500 acres west of Highway 59) has a provision that is allow Whitestone to purchase back the land if an investor can be found with 18 months. That give Contour 18 months to find an investor. I think this is good news.     • Mike Anderson I can't wait to hear what Don Lessum had to say to the EMCID board. It's hard to imagine him going to east Montgomery county unless he had some good news about the project. If he didn't think the project was going to happen, I don't think he would have taken the time to personally attend and EMCID meeting. Maybe he attended the meeting to try to stop some of the negative attention the project has been getting lately. Keeping fingers crossed for some good news!

    • Michael Mahle Thats my thinking as well mike. I think don wants to see his dream built and is fighting for it. I think he is a smart man and has alot of respect by most everyone and has alot of influence. He knows its very close to being able to happen and also close to seing it slip right through our fingers. If it was bad news he wouldnt have bothered to come here and we surely would have heard something bad from the other earth quest page by now. I think she was sore cause they chose houston over dallas to build it.

    • Mike Anderson That person that runs the other Earthquest facebook page (Heather Dobrott a.k.a. soapboxmom) has some serious issues. I have read many postings by her on many different websites and forums where she has called the project 'stupid' and told people that 'it's time to stick a fork in it". She does not want the project to happen and has said numerous times that she doesn't believe the project will ever happen, yet she runs a facebook page to keep people informed about it. Am I the only one who thinks it is odd to run a facebook page about a project that you don't think is ever going to happen? She has written so many posts berating the project and the developers that it is downright disturbing. She seems obsessed with stopping the project. She only ever post stories and comments on negatives. The last article so far written by the Tribune is that the project developers have another 18 months to find a developer in order to buy the property. This is good news. It means that the project is still being pursued. But there is no mention of this on the facebook page she controls. Every time I try to post anything positive about EarthQuest on her page she deletes it. I won't have anything to do with soapboxmom or her websites.

    I was in no way trying to stop the project. I was hoping to stop the bleeding dry of the taxpayers, and see some real oversight on this deal. I delete personal attacks. I am still waiting for any real insight into the Earthquest debacle as it now stands. Imagine the tens of thousands in legal fees the taxpayers are paying on behalf of McCrady and his old clown crew!

I just think its weird to put so much energy into stopping a theme park in New Caney, Tx when she lives in Garland Tx. What difference could it possible make to her if New Caney or Houston gets a theme park or not. She talks as if she is concerned about the tax payers of New Caney not getting their money's worth out of the project because it has not broken ground yet, but I have hard time believing that she is really THAT concerned about people living in New Caney.

    • Mike Anderson My thinking exactly. Do we know for SURE that Don Lessum was at the EMCID meeting on Thursday night? I mean, the only person actually reporting it so far is soapboxmom. Even though I think she is a strange person for stalking the EQ developers and posting their photos all over the internet and I don't understand her motives, I must admit she seems to stay on top of what is going on as far as Tribune news articles are concerned. I think soapboxmom must have a very good relationship with Cynthia Calvert and some others at the Tribune and is privy to some information that people from the Tribune give her - which soapmom usually is very prompt about sharing with the online community (if it's bad news that is). I really expected to hear something on Friday morning and I certainly would have expected to hear something by today from the Tribune or soapmom if Don Lessum said anything important about EQ at the EMCID meeting.

It seems there is a provision regarding the West side of 59 that says "the West Land shall be used only for development as a theme park similar in concept to that contemplated for EarthQuest...     • Michael Mahle according to the tribune east montgomery county improvement district has voted to extend the employment contract of president frank mccrady and give him a $35,000 bonus. He was the one taking most of the heat over the park. He is the one who keeps working towards making it happen against all the naysayers. I have to think that something good is about to happen for the park. He wasnt expected to stay past his old contract.

    • Mike Anderson I don't care what anyone says. If EarthQuest ever gets built, it will largely be because of Frank McCrady. He seems determined to see that the project comes to fruition. I hope people remember his efforts. Most people would have given up by now. Nice to hear that the EMCID recognize his work. EQ will benefit thousands of people if it is built. Houston area theme park enthusiast should be especially grateful for his efforts.

    McCrady will be remembered just as Holbrook is in his old haunts. Controversy and mountains of legal bills are his legacy! Frank McCrady was determined to spend like he was successful and live the lifestyle of the rich and famous on the taxpayers dime. I wonder who funded the trip to Holbrook's IEDC Award ceremony were he received that phony Fellow Member award apparently based to some degree on his success with Earthquest (insert laughter).

    Holbrook started threatening posters / taxpayers on numerous websites in April. That is the biggest red flag of all. That is convincing evidence folks have something to hide. His refusal to turn over the charity docs for the Institute Earthquest as required by law also got me quite riled up. Why would I let Holbrook or anyone else threaten me into silence??

    • Mike Anderson I just read soapboxmom's latest rant about Frank McCrady. LOL! She is having a meltdown over it. Someone needs to tell her that the developers now have 18 more months to find an investor AND they only need 500 million dollars to build the ENTIRE project. If only the THEME PARK gets built during PHASE ONE it could be a LOT LESS! It is obvious she knows NOTHING about the theme park business or financing.

    • Mike Anderson I know. You guys are doing a great job at soapmom's EQ FB page letting people know that the project is getting back on track. But yes, Michael is right. Use caution. SBM HATES EQ and she will not allow that page to be used for much else except trashing the project, spreading negativity and stalking Don Holbrook. It's really sick over there. What a sad person she must really be. Theme parks are supposed to be a place of joy and she runs that page like a nazi death camp for theme park enthusiast. Best you can do is try to squeeze a little positive news items here and there without getting overly excited about it on the surface. That is where I made my mistake and am now banned. All I ever did over there was to try to show examples that the project was still viable. Thing is, the previous admin at that page had a nice following and the page accumulated a lot of 'likes' before SBM took over. I think most people who go to a FB page to check out the status of EQ are in FAVOR of it. I'm glad y'all are letting people know over there that the project is progressing.

    • Michael Mahle she has taken a stance against the park and those behind it. In her mind she thinks she is doing the right thing. She has lost touch with what is realy good for the people. She is out to expose coruption and wrong doins so much that she thinks everyone is doing wrong. I can see where a person can get caught up in that but geeze! The good of this park far out way the bad. This country wasnt discovered or built by people who werent willing to take risks. I applaud mccrady for not going with the status quo.

    • Michael Mahle Ill try and get some pics next time i go by there. The tractor was gone and the gate was closed and their were orange ribbons on stakes. Seen a truck parked along the road on my way back from library. I also talked to someone who works at e.m.c.i.d. Wich is next to the library. Told him how i support the park and tried to get some info. Couldnt get him to comment on some things but he wouldnt say much. He said to come to the meetings. Cant blame him given all the negative publicity by some people. He said they were still trying to get it going.

    • Mike Anderson Thanks for the update Michael. I don't blame anyone at the EMCID for keeping quiet these days. Any time they share any info some people come out attacking them and holding them personally responsible for the delay, which is not even fair. I agree they probably won't say much until they have some real funds committed to the project. I'd love to know more about what is going on behind the scenes, but it is probably best for the project if they stay quiet until they are able to release some definitive info instead of speculation. The perhaps 'overly optimistic' comments they have made in the past have come back to haunt them. The way I see it is that we should be happy that the project is still being pursued at all right now. So many things could have happened (and still could) to totally derail the project completely. O.K. so we still haven't found an investor - yes that sucks, but I can still find encouragement when I hear about little bits and pieces of news that prove that somewhere in the world people are still trying to get the project built. Getting the land ownership established was a HUGE breakthrough for the project. And has no doubt given EQ new life. Don Lessem's appearance at the EMCID is another encouraging sign. I also think that Frank McCrady still being in charge of the EMCID is a good thing. Without him pushing for EQ, the project might not be even on the table by now. These are all signs (however slight) that the project is moving forward - maybe at a snail's pace, but slightly forward movement is still better than backward movement.

    I have really bad news for Mr. Anderson. I grew up in the construction industry and the chances the park can be built for the originally quoted $500,000,000.00 I don't think are good. That figure may be way under what the actual costs would be and someone would need to address how they would publicize this thing if it ever gets built since it is an independent venture.

    The land being available for repurchase by those clowns at Marlin Atlantis who ate millions of dollars of tax money for their involvement in this and that property they lost hardly constitutes a huge breakthrough. The property issue shouldn't have been up in the air to begin with. What a circus!

    Knowing that Holbrook has gone lawsuit happy and there are numerous law enforcement agencies checking this out sure makes these posts trashing me much more ridiculous. Are these folks going to chip in to the legal fund when the tax dollars have been eaten through by McCrady and company paying the high dollar legal eagles to cover their butts while they turn over records???

But obviously people are still working on it - and that is good news. The article was pretty short. Lots of info missing. Evidently there was a closed door meeting that took place between Lessem and the EMCID and none of those details were reported. It sounds like Chris Brown of Contour is the person with the most control over EarthQuest's future as he seems to be the one in the position of finding the financing. To me, there wasn't anything in this article that will change anyone's perception of the status of the project. It's obvious, the EMCID, Contour and Don Lessem are still working to get EQ built in New Caney, but there wasn't anything in the article to shut the naysayers up either. It's just a continuing drama just as most half billion dollar projects are during their development. In short it sounds like Lessem was at the EMCID to try to provoke them into either getting this thing done or give him back is idea so he can try to sell it somewhere else (500 miles from Texas) wherever that is. EMCID said NO. It's OUR project and we still have a year to develop it. The project is still ALIVE at least for another year to 18 months. SBM will be a total basket case by then. I predict lot's of angry days ahead in her future. LoL

Seems like they are trying to put forth more action and less talk. Im sure the silent treatment is driving some people crazy.lol just means that its time to get down to business and thats fine with me. Gives plenty of time for speculation and trash talk but in the end thats all it is. Unless houstons economy collapses the park will most likely be built. Their are no major warning signs to scare of any investors. Makes perfect economic sense. Just have to reach out to those with the money and show them a well thought out plan. Texas has shown over time to have one of the most stable of economies and im sure the whole world knows that. Houston is about to pass chicago for third largest city in the u.s.     • Mike Anderson I saw an article in the Houston Chronicle last week that said the largest number of visitors in a decade swarmed to Galveston Island over the holiday weekend and the Pleasure Pier was a factor. I hope that potential theme park investors take notice of this kind of news. SBM has been saying the same thing for a long time and yet the official word is that investors are still being pursued. SBM has no access to what is going on at Contour and she is making leaps of assumption that no one in the world will invest in EQ - HOGWASH! Investors will invest if they think they can make a profit on EQ. Just because SBM would not invest in the project doesn't mean that no one else will. If you really read SBM posts it is clear she has very little knowledge of what is going on behind the scenes at EarthQuest. She has even less comprehension of business deals and the theme park industry. She makes her comments solely based on wishful thinking and no one should take anything she says too seriously.     • Mike Anderson SBM is one of the people that Holbrook is suing. And she thinks his lawsuits will scare away investors. That sounds like the over simplified analogy of a child. Holbrook is not associated with the EQ project now. Nothing he does will effect EQ moving forward. SBM is running scared and the internet is her only vent. No matter what happens with Holbrook's lawsuits and SBM's living conditions - it won't make any difference to EQ either way. The project will or will not move forward based on it's own merits - not what someone who used to work as a consultant for the project does after his job is done.

    • Michael Mahle I just wonder what her motive is to destroy earthquest. Is it because houston area would get it instead of the dallas area? Maybe she thinks if it fails here that she could campaign for it to be built closer to her. She has more of a beef with holbrook and mccrady than contour or lessum. It was said that houston edged out dallas for the project. Why does she insist on dragging mccrady and the park into what holbrook does? Investors will overlook what she is doing. They see through what she is doing the same as us. I agree with mike. It shouldnt have any effect on where they spend their money.

    • Mike Anderson I bet it's even more petty than that. Did you ever noticed on some internet forums that some people just have to have to last word regarding a topic? Well, sometimes I think SBM has taken this 'last word' concept over the top. I have seen her post comments on every single web forum board or chat room discussing the project. She makes duplicate replies and post them on several forums. She has now been banned from most of them. When she switched from verbally attacking the park itself to the developers, many forums would not have that. She was posting photos of the developer's and their families, calling them 'goons' and 'crooks' and most respectable forums started getting a clue that she was using their web spaces as a place to run her own private smear campaign. I have seen SBM getting into 'pissing' contest on some forums and keep posting lame argument after lame argument and it appeared to me she wasn't going to stop until she got the last word. You may be right about a Houston/Dallas competition thing but I think its really that she can't handle losing an argument. Lets face it, all we really can do as outsiders is TALK about the project. SBM took a position and she won't back down for anything - not even if it takes money out of her bank account. The sad thing is she has taken it so far that she is now going to have to deal with an actual law suit and for what? Whether the project moves forward or not she is now going to be effected in some way by a project that she had no tangible interest in. What a stupid, stupid person. There are so many legitimate causes out there that might be worth taking a stand even if it gets you sued. A theme park built 300 miles away from where you live IS NOT one of them. I hope Holbrook takes every last cent from her.

    • Michael Mahle I think she has it out for holbrook realy bad and especialy now. If the park gets built then it will be a victory for him in some way and a lose for her. She is set on destroying the park for that reason. She wont handle loosing very well and if she wins it will be like i told you so and put a big feather in her hat. She found someone easy to find wrong doing and is going for the jugular. She has no real interest in the park or this community other than to turn people against it to destroy it for her own personal reasons. Now that the Tribune has already written so many stories about how taxpayer money was spent, they no longer have anything to say at all about the project. Eventually some news will trickle out and we may have something actually relating to the park to talk about. But for now we only have SBM's downward spiral into insanity to keep us entertained.     • Michael Mahle the cars could have been anyone. May have been the county could have been contour or friendswood developement. Sbm is just wanting it to be anything other than to do with the park. So far everything is going as planned as far as the sale of the land and contour looking to secure all the rites to the property and the park. These are all the steps that were said to have had to take place and sbm and others continue to put doubt in peoples minds.

    • Mike Anderson I'm not saying that there is nothing that could stop this project, but putting doubts in the minds of the online community is futile. Contour is still working on it and so is EMCID. The online community doesn't have any real power or control over EarthQuest's future - only opinion and observations. There is a new article out that show signs that the project is still moving forward. Slow as molasses, but forward is better than backward.

    • Michael Mahle Most of what has been reported in the last several months has been old news or election results or holbrooks legal matters. The last thing that realy had something to do with the park was that it had to go through the bankruptcy process and then contour could take it from there once the property has been purchased. Only thing thats different is who bought the land. That realy isnt important. Contour has to get things cleared up legaly before they can procced from here. That just means getting their lawyers to draw up contracts. May not get the other things that was gonna be on the property across the highway but who cares. It looks to be coming along as planned since bankruptcy was filled.

No matter how much they bray about it being immaterial, it is going to scare off any legitimate investors. Holbrook is screaming for money and has made a career out of threatening lawsuits. The intellectual property rights are obviously in dispute judging from Lessem's appearance. And, Contour first needs to address securing funds and there is no evidence that is in progress since the announcement of the investigation. Contour might also be wise to secure counsel in regards to the investigation going on. If McCrady got a lawyer that was charging $850.00 an hour years ago, then I take it he must be worried!

    Now, we have all this archived so folks can see the history of this Titanic as she sinks never to be raised!

    Holbrook's fan club noted I wouldn't back down. You bet!!!!!!!! Why would I back down? The guy has no case. He dismissed the case against the Houston Press, the lynchpin (Craig Malisow) and the Pahrump Valley Times, and as far as I can tell they did not remove a thing. The PVT just let the buffoon post a laughable rant. He won't be getting a cent from any of the defendants. I will continue to work tirelessly to see the public is warned and informed.

    I intend to stand my ground. I don't want this guy to get another penny in tax dollars with his dubious history. The Knights Templar Linkedin Group removed his egregious solicitations and he is no longer listed as a member. Hopefully, Holbrook will have his membership in that group proper revoked. Obviously, his money grubbing Kickstarter deal does not have their support or endorsement as they removed everything he spammed their Linkedin group with!

    Boy, this guy really doesn't know when to stick a sock in it, does he? How in the hell can someone "invent" facts? Facts are facts, plain and simple. Your past WILL come back and haunt you, won't it? As to your comment, SBM, "I have never been against the park, I am against tax money being wasted", that say's it all for a lot of people, and the reason for the Tribune's article in the first place. A huge tarp was thrown over the feeding trough in East Mont. Co., and some individuals don't like it. Too bad. Some individuals have had to get off thier lazy ass and prepare a hot, home cooked meal instead of tax-payers preparing it for them. Too bad. It's not our fault they only know how to prepare a tuna sandwich and Ramen noodles, with a pudding pop for dessert. Taxpayer- funded family vacations have ground to a halt in EMC. Too bad. No one is against a theme park being built in EMC, exept those that moved to Roman Forest and surrounding communities to enjoy the solitude, that's a FACT. Until investors are definitively lined up and ready to move forward with this project, not one stinking PENNY should be thrown at it!!! And speaking of INVENTING, Mr. gASSbag, who was it that said " (they) just re-invent the rules " Notice the "they". We wouldn't want anyone with extensive experience in re-inventing the rules to be included in with the "they", now would we?

    Don Holbrook • The alleged countless articles are simply reposts and blogging innuendo posted by a person with a severe God complex and who feels she has some right to spread unsubstantiated and false rumors about someone in a stated purposeful manner to harm their reputation and livelihood. Of course these are my own observations and opinions, but in my opinion someone has wronged this person and driven her to this inappropriate manner of expressing her hurt and anger.     contract between Huber Heights and Holbrook, LLC. Holbrook, LLC filed a third party complaint
    against several individuals and internet newspapers / blogs alleging, among other causes of action,
    defamation.
    Third Party Defendant Frank Maurizio is a Nevada resident who posted statements to the
    internet from Nevada. Id. ¶3; Frank Maurizio’s Motion to Dismiss, pg.1.4. Third Party Defendant
    Heather Dobrott is a Texas resident who posted statements to the internet from Texas. Second
    Amended Third Party Complaint, ¶2; Heather Dobrott’s Motion to Dismiss, pg. 3. Cynthia Calvert
    is a Texas resident and is the editor, publisher and chief executive officer of “The Tribune”.
    Cynthia Calvert’s Motion to Dismiss, pg. 1. Hartburg Publications, LLC is a Texas limited liability
    corporation doing business as “The Tribune.” Id. 3
    Holbrook, LLC asserts that “sometime on or before February 29, 2012, defamatory, untrue,
    derogatory and false statements about Don Allen Holbrook, LLC were posted by internet bloggers
    Dobrott and Maurizio and articles were posted on the internet by Malisow (subsequently dismissed
    as a party) and Calvert on various websites.” Second Amended Third Party Complaint, ¶26.
    Holbrook, LLC alleges that these internet postings prompted Huber Heights to breach its contract
    with Holbrook, LLC. Id. at ¶29. Holbrook, LLC’ Second Amended Third Party Complaint alleges
    the following counts against the remaining Third Party Defendants: (1) civil conspiracy; (2) tortious
    interference with contract and prospective business relations; and (3) defamation.
    STANDARD OF REVIEW
    A court may decide a Civ. R. 12(B)(2) motion without an evidentiary hearing. If the court
    reviews the 12(B)(2) motion without an evidentiary hearing, the plaintiff need only make a prima
    facie showing of jurisdiction over the defendant to withstand a motion to dismiss. Giachetti v.
    Holmes, et al., 14 Ohio App.3d 306, 307, 471 N.E.2d 165 (1984). A plaintiff meets the burden for a
    prima facie showing of jurisdiction if “reasonable minds could find jurisdiction.” Id. at 307. When
    reviewing a motion to dismiss under Civ. R. 12(B)(2) for lack of personal jurisdiction over the
    defendant, a court must evaluate the pleadings and evidentiary materials in the light most favorable
    to the non-moving party. Goldstein, et al., v. Christiansen, Judge, et al., 70 Ohio St.3d 232, 236,
    1994-Ohio-229, 638 N.E.2d 541, citing Giachetti v. Holmes, 14 Ohio App.3d 306, 471 N.E.2d 165
    (1984). The court, as indicated, may consider evidence in addition to the complaint, such as
    answers to interrogatories, depositions, or affidavits without converting a Civ. R. 12(B)(2) motion
    into a motion for summary judgment. Price v. Wheeling Dollar Savings & Trust Co., 9 Ohio
    App.3d 315, 318, 460 N.E.2d 264 (1983). 4
    LAW AD AALYSIS
    In order to determine if an Ohio court has personal jurisdiction over a nonresident defendant,
    courts have adopted a two step process: “(1) whether the long-arm statute and the applicable rule of
    civil procedure confer jurisdiction and, if so, (2) whether the exercise of jurisdiction would deprive
    the nonresident defendant of the right to due process of law under the Fourteenth Amendment to the
    United States Constitution.” Kauffman Racing Equipment, LLC v. Roberts, 126 Ohio St.3d 81, ¶28,
    2010-Ohio-2551, 930 N.E.2d 784 (2010).
    I. Long-Arm Statute:
    Ohio’s long arm statute, R.C. 2307.382, specifies certain actions which confer personal
    jurisdiction on Ohio courts. Holbrook, LLC asserts that jurisdiction is proper in Ohio under R.C.
    2307.382(A)(3)(“causing tortious injury by an act or omission in [Ohio]”) and
    2307.382(A)(6)(“causing tortious injury in [Ohio] to any person by an act outside [Ohio]…”).
    Holbrook, LLC alleges that the remaining Third Party Defendants published and posted articles and
    blogs, including defamatory, derogatory, and false statements about [Holbrook, LLC], on internet
    websites. All of the remaining Third Party Defendants are residents of other states, the actual
    internet postings were not written in Ohio, and the internet newspapers and websites were not
    directed at Ohio. However, Holbrook, LLC asserts that the remaining Third Party Defendants
    should have been able to predict that their postings would be viewed by residents of Ohio. Since
    the actions – publishing and posting articles, blogs, etc. on the internet – took place outside the state
    of Ohio, R.C. 2307.382(A)(3) is not satisfied and cannot be used to establish personal jurisdiction
    over the remaining Third Party Defendants. The only contact directed at Ohio that Holbrook, LLC
    points to is an allegation that a reporter from a town near Houston, Texas contacted the Huber
    Heights City Manager prior to February 29, 2012. Third Party Plaintiff’s Memorandum in
    Opposition (August 17, 2012), pg. 5. However, the Second Amended Complaint clearly identifies 5
    the reporter who made such direct contact as dismissed defendant Craig Malisow. Second
    Amended Third Party Complaint, ¶ 4. Based upon the Second Amended Complaint, the allegation
    of direct contact only relates to Mr. Malisow, a Third Party Defendant who has been dismissed, and
    nothing Holbrook, LLC points to creates a prima facie case that Mr. Malisow’s alleged
    communication can reasonably be attributable to any of the remaining Third Party Defendants. As
    such, the Court will next evaluate whether personal jurisdiction exists under R.C. 2307.382(A)(6).
    Pursuant to R.C. 2307.382(A)(6), “[a] court may exercise personal jurisdiction over a
    person who acts directly or by an agent, as to a cause of action arising from the person’s: [c]ausing
    tortious injury in this state to any person by an act outside this state committed with the purpose of
    injuring persons, when he might reasonably have expected that some person would be injured
    thereby in this state.” In order for jurisdiction to be proper under R.C. 2307.382(A)(6), the
    defendants must have had the purpose of injuring Holbrook, LLC and must have reasonably
    expected that Holbrook, LLC would be injured in Ohio. Holbrook, LLC asserts that Huber Heights
    breached the contract with Holbrook, LLC because of comments posted to the internet by the
    remaining Third Party Defendants on or before February 29, 2012. Review of the record before the
    court demonstrates that none of the remaining Third Party Defendants mentioned Huber Heights on
    or before February 29, 2012. All of the internet postings on or before February 29, 2012 related to
    Holbrook, LLC’s contractual activities with local governments in Nevada and Texas. While some
    postings on or before February 29, 2012 vaguely reference Holbrook, LLC’s involvement in other
    towns across the United States, only one article specifically mentions cities in Minnesota and
    Indiana. The vague reference to Holbrook, LLC’s involvement with various cities outside Ohio is
    not sufficient to confer personal jurisdiction over the remaining Third Party Defendants in Ohio.
    See Holbrook, LLC’s Memorandum in Opposition (filed August 17, 2012), pg. 4. Although, based
    upon the content of the postings, it may be concluded that the remaining Third Party Defendants 6
    intended to negatively portray Holbrook, LLC, the remaining Third Party Defendants, since the
    postings did not mention Ohio or any work Mr. Holbrook had performed or was performing in
    Ohio, could not reasonably have expected that Holbrook, LLC would be injured in Ohio by the
    internet postings. Since the remaining Defendants could not reasonably have expected to injure
    Holbrook in Ohio, personal jurisdiction in Ohio cannot be premised upon Ohio’s long-arm statute.
    II. Due Process:
    In addition to the inapplicability of Ohio’s long-arm statute, hauling the remaining
    Defendants into an Ohio court would not be compatible with due process. Even if the requirements
    of the long-arm statute are met, it must be established that the minimum contacts necessary to
    satisfy due process have occurred to subject a non-resident defendant to personal jurisdiction in
    Ohio. Specifically, the Ohio Supreme Court has stated the following with regard to minimum
    contacts necessary to meet the due process requirements for personal jurisdiction:
    ***the constitutional touchstone remains whether the defendant
    purposefully established 'minimum contacts' in the forum State. The
    nonresident defendant has purposefully established minimum contacts "* * *
    where the contacts proximately result from actions by the defendant himself
    that create a 'substantial connection' with the forum State * * * where the
    defendant 'deliberately' has engaged in significant activities within a State * *
    * or has created 'continuing obligations' between himself and residents of the
    forum * * * he manifestly has availed himself of the privilege of conducting
    business there, and because his activities are shielded by 'the benefits and
    protections' of the forum's laws it is presumptively not unreasonable to
    require him to submit to the burdens of litigation in the forum as well."
    Furthermore, minimum contacts are satisfied when the defendant
    foreseeably causes injury in the forum state if "'* * * the defendant's
    conduct and connection with the forum State are such that he should
    reasonably anticipate being hauled into court there.' * * *" (Internal
    citations omitted and emphasis added.)
    Kentucky Oaks Mall Co. v. Mitchell’s Formal Wear, Inc., 53 Ohio St.3d 73,77, 559 N.E.2d 477
    (1990) quoting Burger King Corp. v. Rudzewicz (1985), 471 U.S. 462 (1985). In short, irrespective
    of whether Ohio may exercise personal jurisdiction over a non-resident defendant based upon 7
    Ohio’s long-arm statute, an Ohio court must refrain from exercising personal jurisdiction if the
    defendant does not have sufficient minimum contacts with Ohio to make being hauled into an Ohio
    court compatible with due process.
    The Ohio Supreme Court has set forth a three part test for determining whether asserting
    personal jurisdiction over a nonresident defendant comports with due process: (1) “the defendant
    must purposefully avail himself of the privilege of acting in the forum state or causing a
    consequence in the forum state”; (2) “the cause of action must arise from the defendant’s activities
    there”; and (3) “the acts of the defendant or consequences caused by the defendant must have a
    substantial enough connection with the forum state to make the exercise of jurisdiction over
    defendant reasonable.” Kauffman, 126 Ohio St.3d 81, ¶49 quoting Bird v. Parsons, 289 F.3d 865,
    874 (C.A. 6, 2002). The remaining Third Party Defendants did not purposefully avail themselves of
    the privilege of acting in Ohio. As noted by the Ohio Supreme Court, “[t]he fact that [Defendants]
    could foresee that [their proclamations would be viewed] and have an effect in Ohio, is not, in itself,
    enough to create personal jurisdiction.” Kauffman, 126, Ohio St.3d 91, at ¶64 quoting Reynolds v.
    International Amateur Athletic Fedn., 23 F.2d 1110, 1120 (6th Cir. 1994). When evaluating
    personal jurisdiction over nonresident defendants in defamation cases, Ohio courts routinely
    examine whether the facts are closer to those in Calder v. Jones, 465 U.S. 783, 104 S.Ct.1482
    (1984) (focus of the story written and published by out of state defendants was California, the state
    seeking to assert jurisdiction) or Reynolds v. Internatl. Amateur Athletic Fedn., 23 F.3d 1110 (1964)
    (where the state in which personal jurisdiction was sought was not the focal point of the article).
    Kauffman, 126 Ohio ST.3d 91, ¶64. The Kauffman Court held that the Calder effects test is also
    valid when dealing with internet communications. Id. at ¶66. “While the effects of Internet conduct
    may be felt in many [forums], the intent requirement allows a court to find a particular focal point.”
    Id., at ¶66 (internal citations omitted). A review of the articles and comments at issue are not 8
    focused upon Ohio generally or, more specifically, upon Holbrook, LLC’s actions relating to Huber
    Heights. The focus of the postings, as indicated, was upon Holbrook LLC’s activities in Nevada
    and Texas. The remaining Third Party Defendants, in conclusion, do not have sufficient minimum
    contacts with Ohio to make this court’s exercise of personal jurisdicition over the remaining
    defendants consistent with due process.
    CONCLUSION
    The remaining Third Party Defendants’ (Cynthia Calvert, Hartburg Publications, LLC, and
    Frank Maurizo) motions to dismiss and quash service of process are hereby sustained.

    EarthQuest was the choice of EMCID and Dino Don Lessem and the failure was the debelopers performance. My work was completed and performed 100% within the scope of my contract. Your saying that I have ethics and misconduct is not factual or true. Your focus should be on those that contracted and failed to perform not me. You have unfairly harmed my work ethic and that was why I sued you. If you would admit that and move on you could focus on the rightful scrutiny and possibly create something meaningful and true from your focused attacks. But when you misstate facts and attack me and thus my family unjustly you will never find justice just more anger. Just as you feel justified and validated so do I to protect my family and nothing you do will keep me from protecting them. Just think what you might have achieved if you focused on EMCID's board and Marlin the two that did make all the decisions and contract and promise to perform but did not rise to their promised outcomes.

    Who doesn't know this? Apparently his latest attorney didn't. Not to sure I'd feel very confident in her abilities when she's overlooked something so simple as well as not even investigating the allegations yet to properly advise her client in courses of action.

    Well, since Holbrook wrote off 1.29 million in attorney fees in his chapter 7 bankruptcy discharged in 2010 and wants to pay cents on the dollar for $20,000 in legal fees in his chapter 11 filed in 2011, I think he might teach his attorney a lesson by allowing her the privilege of working for free for at least part of this case. Some people learn their lessons the hard way! I bet the next attorney he approaches will do their homework on him and his adversaries before jumping in with both feet! All I can say is Ouch!!!

    My crystal ball sure worked great. Numerous scambuster's including myself predicted Holbrook's idiotic case would blow up in his face. I laughed at Holbrook's attorney wench dismissing 3 parties that had not even had the opportunity to answer. And, I made an especially big stink about Holbrook dismissing the lynchpin for his whole case. The judge, hilariously, pointed out just what I had been saying! My psychotic powers and time travel broomstick at work again!

    Holbrook made a complete fool out of himself. His ding dong attorney gave him the ammo to shoot himself in the foot. What could be funnier!!! What competent attorney would have filed a likely loser like this dud??? What client would demand a frivolous filing like this and submit an Affidavit filled with exaggerations and a whopper or two for good measure?

    And, by the way, we are still waiting for Holbrook to make those Earthquest Institute charity docs public as required by law. Why should the FBI agents get to have all the fun!!!

    The middle paragraph has to do with Holbrook and Front Site experts giving the Town of Pahrump and Nye county Nevada officials a one sided picture of Sir Gasbags Public Private partnership and Special improvement District has the one in a mess in Texas.

    Limiting of Free Speech and One-sided Experts

    Ted Kennedy said to Mitt Romney, "When two politicians disagree on a bill only one of them has read the bill." To Mr. Waters and Mr. Kulkin, facts are facts. They come from all kinds of studies that the Town of Pahrump and Nye County paid for. The following facts about incorporation is from the below mentioned study. It is obvious that you, Harley and other board members have not read Pahrump Incorporation Feasibility Analysis (January 12, 2010) by Economic & Planning Systems, Inc. (EPS) Feasibility of City Operations. Table 1 compares Town revenues and costs to the initial budget for a new city. The bottom line shows a net increase in costs, after accounting for additional revenues; of about $220,000 annually (pg. 4) “Net increase in costs” is the spin language to cover up the “Excess deficiency of revenue over expenditures”, a Loss, or deficit spending. The estimated City Total Revenues is $12,723,659 & estimated Total Expenditures of $12,943,293. (pg. 6) Total Revenues subtract Total Expenditures is a Loss!
    $12,723,659 - $12,943,293 = ($219,634). (pg. 6)

    Mr. Kulkin you quoted, “You have a pattern of assuming things when you could easily ask and obtain information”. I’ve submitted an Open Records Act request for that same report but can’t get it because I’m told “it is not available to the public by Mr. Kohbarger”. Well it’s a public document, paid for by the public funds. Mr. Kulkin you stated, “Do you really think you are the expert and people like Gov. List, and the other people last night, Senator Brian Brown etc. are inferior to your financial knowledge, experience and vision”? If I was allowed to read my statement which was not a personal attach on anyone, you would have understood that a good and knowledgeable expert tells the whole story. Not just the upside of a Public-Private Partnership and a Special Improvement District. A true and knowledgeable expert would include the downside of the PPP and SID. An expert should not tell only a one-sided picture but the whole truth of the matter. There are serious questions being asked by the taxpayers of the Town of Pahrump. Why are these experts coming to the Town of Pahrump for a letter of support when Front Site is not within the borders of the Town of Pahrump? Is this Special Improvement District (also known as a Taxing District) for the whole of Nye County or the Town of Pahrump? Will this SID have its own Board members? Is this Board another layer of Government we do not need? Will this Board be paid? What is the footprint of this project? What is the Front Site Consultant, Mr. Don Holbrook, capacity in this project? Where is the Water coming from? Have any Water Rights been purchased or transferred from Nye County or the Town of Pahrump? There has been no full disclosure by these experts on this project.

    Harley, why do you and other board members call the quotation of the facts from documents that board has paid thousands of dollars lies? Face it Harley the facts are not lies no matter how many times you call me a liar. By the way, why don’t you, Mr. Waters and Ms. Parker MAN UP and tell me what lies I tell. You, Mr. Waters and Ms. Parker kept saying that but do not elaborate on what lies I supposedly tell.

    What a hoot! They have been saying that for years now except Chris Brown called it the fundraising stage in Pahrump! Don Allen Holbrook should continue to do everything he can to upset the apple cart. If he files another slew of lawsuits he will get all the people involved in Earthquest dragged into court. I would love to get more documentation on that, Holbrook's hundreds of projects, his employment history and of course his financial records. That is just the brilliant negative publicity the project needs!

    Don Holbrook • Just to be clear Taxpayers have no right to lie, misquote, allege unsubstantiated malicious comments or make up their own facts to suit their own statements and intents. The first amendment does not allow for defamation or libel. It's as simple as that.
    Holbrook isn't even making sense. I have said it before and I will say it for the last time. Find any false statements of fact and they will be edited, removed, retracted and /or apologized for. Otherwise, piss off Mr. Holbrook!! Opinions are not actionable!
