Yeppers. The boards are being submarined and all sorts of shenanigans are going on behind their backs. The attorneys are not properly explaining things and the Holbrooks and McCradys are able to pull all kinds of antics. Hopefully, folks will learn their lessons from this and more rigorously check these clowns out before signing screwball contracts with them. In Red Wing, the company paid $15,000.00 to check out Holbrook admitted they did nothing and offered Red Wing a refund to avoid getting sued. Unbelievable!!!!

Luckily, in the future folks can do their due diligence on Holbrook right here!!!

Federal agents uncovered a diploma mill operation in the 1990s at the similarly named
“LaSalle University” in Mandeville, La. The school handed out phony degrees, usually for
just a few thousand dollars apiece.

Students could bargain on the price of a degree and sometimes even get two for the price
of one, John Bear, the author of a number of books on diploma mills, said Monday.

“It was considered, at best, a useless degree,” he said.

The FBI raided LaSalle in 1996 and found just three faculty members running the show for
about 15,000 students, said Allen Ezell, a retired FBI agent who created the agency’s
diploma mill task force.

Thomas James Kirk, who ran the LaSalle diploma mill, made about $36 million off the
operation, according to the (New Orleans) Times-Picayune. Prosecutors convicted Kirk of 18 federal crimes, including mail fraud and tax violations.

A judge sentenced Kirk to five years in federal prison.

New owners took over the school later and attempted but failed to achieve national accreditation, according to the New Orleans newspaper. The school changed its name in 2001 to Orion College. It closed a year later.

LaSalle purported to be a legitimate distance-learning institution but never received national accreditation, although the school claimed it had it in its marketing materials.

Class papers were graded by their weight on a scale, and faculty offered students credit for life experience rather than actual classes, Ezell said.

The average time needed to complete a degree at LaSalle was nine months, he said.
Some former students contend that they took correspondence courses and a test at
the end.

So, Hobrook is confirmed to have lied on his resume in 1996 claiming two fake degrees from LaSalle when seeking employment with the Red Wing Port Authority. LaSalle was raided and students were sent notification by the FBI and offered refunds in 1996. Holbrook whined that he had told the Port about the mix-up and was told it didn't matter. Holbrook then wants everyone to believe that after all that he did in fact earn the degrees from LaSalle that he had fabricated on his resume in just a matter of months from that same school that had in fact never been accredited.

The Port Authority should never have kowtowed to that lying, litigious goon. The doctor in Dr. Holbrook was the figment of an arrogant goons overactive imagination. Legitimate Master's degrees and the accompanying thesis would take at least two years full-time in the real world. A legitimate doctoral dissertation could take that long or likely much much longer working full-time depending on the dissertation. So, the story that Holbrook got these two degrees during his employment full-time with the Port Authority or shortly thereafter is beyond laughable. Holbrook seems to think everyone is beneath him and he can pull his antics and the peasants will eat up whatever bull he is shoveling. Unfortunately, for him most of us didn't just fall off the turnip truck.

Discovery and depositions will be a gas with sir GASSbag if by any chance his frivolous, harassment case should actually get that far. The Master's Thesis and Doctoral Dissertation would be delightful to request in discovery. If nothing else they might make fine toilet tissue!

Sue Seeberger sent me a ridiculous Cease and Desist letter and threatened me with a 13 million dollar case in Texas that had nothing in common with the frivolous lie-filled garbage she filed.

I will never cease and desist from making truthful fact filled postings and expressing my opinion. I would love to know if Seeberger holds her client to the standards she tried to hold me to. Did she make any effort to check out the facts surrounding this case before she filed and signed said filings? Did she require Holbrook to provide "complete evidence of the truth?"

We have been discussing a matter of public concern and where our tax dollars are being spent. Holbrook got a gargantuan chunk of tax dollars and I think it was misspent!!

The articles linked are an update to the horrific case Holbrook threatened me with. The 13 million dollar judgment has since been thrown out. Those folks were being attacked with false allegations of rape and had a real serious problem. Holbrook is melting down because the truth, facts and opinion about his spending of tax dollars is being discussed. Really?????

So, does Holbrook still think he can chase down anonymous taxpayers that are discussing matters of public concern and expressing their opinions about such and get anywhere in a court of law? He wrote off 1.29 million in attorneys fees in his 2007 bankruptcy. How much more in fees are his ridiculous cases going to be allowed to accrue??? The legal fees for his latest legal adventure are racking up and I think Holbrook should get saddled with the fees for all the parties involved in this outrageous suit in Ohio. His legal adventures need to be brought to an abrupt end.

She didn't send the letter again. I am just pointing out how ludicrous the whole thing was from the get go. She opened a can of worms without knowing the facts before she signed her name. Of course, signing a ridiculous letter like that is one thing and filing a frivolous case is entirely another. I can't imagine what possessed her to file that lie-filled, ridiculous complaint. I had up only a handful of posts before Holbrook got canned by Huber Heights and Seeberger should have checked that. She would also have done well to check a map so that she could see that Pahrump was in another state, Nevada. She should get her rear handed to her for those filings she has made.

Now, she has had to dismiss 3 parties and is in the embarrassing position of going forward with an almost sure loser of a case. And, instead of saving her clients reputation, she has created a storm of negative publicity. She also could have anticipated that if she had checked out me and the other journalists publishing more carefully. She has done her dishonest and dastardly client a great disservice. But, as he has an alarming habit of writing off bills in bankruptcy I doubt she will get paid for her folly either way!

The only reason there is an attorney for her to talk with is becuase she filed this frivolous harassment suit in Ohio and that made it difficult to respond pro se. If Holbrook is dumb enough to take me on in Texas his clown may just have to deal with me personally. I have been in court pro se and I would be happy to represent myself again if that should be necessary. Maybe we will get my favorite judge, Judge Ginsberg again!

That's the first time I read Sueberger's cease and desist letter, and after the second "strongly suggest" I could'nt stop laughing. I had a flashback of Demi Moore playing the incompetant attorney in "A Few Good Men" I half-expected the judge to butt in and retort with "The taxpayers would like to know what happened to thier money, and the jury and I would like to HEAR THIER OPINION!!!"

I have another humongous pile of articles that tell more of the sordid Holbrook saga. Talk about a string of firings and controversy in his wake. Holbrook's Affidavit at the bottom of the file attached is one of the most lie-filled pieces of tripe I have seen filed. I can't wait to see him exposed for the liar he is in front of the judge in Ohio!

The FBI is investigating the East Montgomery County Improvement District, its administrators and some board members.

Based on a series of investigative reports by this newspaper, which revealed millions of dollars spent on controversial items, along with equally controversial practices involving the creation of EarthQuest, a dinosaur theme park, The Tribune has learned that the FBI served federal grand jury subpoenas several weeks ago to those close to EMCID. While the complete list is unknown at this time, CEO Frank McCrady, EMCID staff members Suzanne Parmer and Sandy Seelye, and EMCID Board members Leon Cubillas, Leonard Rodgers, Isidor Ybarra, Connie Bloodworth, Vickie Thumann, Sue Rinehart, Linda Floyd and Fred Wetz have all been apprised of the investigation, with some receiving subpoenas. The staff and board were notified earlier this summer. The Montgomery County District Attorney’s Office and the Texas Rangers also are involved in the investigation.

Board members were called to the EMCID building for a series of meetings where they were introduced to several lawyers. One set, they were told, had been hired to represent the board members while a second set had been retained to represent McCrady and EMCID staff.

Brenda Webb, Marlene Idoux and Dale Martin, elected in May to replace Cubillas and Rodgers (one seat was open after Rinehart stopped attending meetings) in a voter outcry over the EMCID board practices, were not subpoenaed but were brought in to hear explanations by the lawyers.

“We want you to know what is happening with the investigation,” said one lawyer, who urged the staff and board members to keep the subpoenas quiet. He asked that everyone not discuss the investigations with anyone.

The attorneys, one of whom introduced himself as the former U.S. Attorney for the Southern District, went on to say the FBI has requested numerous documents including credit card statements, board meeting minutes, contracts, etc.

The attorneys said they were representing the board and the staff but warned that if anyone were to get criminal charges filed against them, they will have to hire their own attorney.

The Tribune has learned that EMCID has hired prominent Houston lawyer Rusty Hardin, who, according to his website, represents “major corporations, public agencies and high-profile individuals in both civil and criminal litigation.”

EMCID has spent more than $100,000 in taxpayer dollars in the last two months, with more than $75,000 going to Hardin alone. Several additional law firms have also been paid thousands of dollars. Previously, The Tribune noted that EMCID legal counsel David Marks receives more than $350,000 annually from EMCID.

FBI spokesperson Shauna Dunlap could not confirm the investigation saying the FBI does not discuss investigations that may or may not be occurring.

The Tribune has requested through the Texas Public Information Act, all invoices and check ledgers for year to date and will publish more information as it becomes available.

Russell (Rusty) Hardin, Jr. (born on October 6, 1941, in Durham, North Carolina) is an American attorney^[1][2] and head of the Houston law firm Rusty Hardin & Associates, P.C. which he established in 1996.
Hardin is a 1965 graduate of Wesleyan University in Middletown, Connecticut. He went on to earn his law degree in 1975 at Southern Methodist University in Dallas, Texas.
During the Enron scandal, Hardin represented the accounting firm of Arthur Andersen. His efforts resulted in the US Supreme Court unanimously overturning the firm's conviction of obstruction of justice in 2005.
Hardin has represented and won favorable verdicts for athletes such as Rudy Tomjanovich, Warren Moon, Wade Boggs, Rafer Alston, Scottie Pippen, Steve Francis, and Calvin Murphy. A current client is Roger Clemens, who has been embroiled in accusations of having perjured himself before Congress over alleged steroid use. Roger Clemens was acquitted on June 18, 2012, on all charges that he obstructed justice and lied to Congress when he denied using performance-enhancing drugs as a fast-balling pitcher.
Hardin successfully represented Victoria Osteen, wife of TV evangelist and bestselling author Joel Osteen, in a civil lawsuit filed by a Continental Airlines flight attendant. The flight attendant claimed that she had been pushed by Osteen, and sought civil damages, but a Houston, TX jury acquitted her in 2008. Hardin also won a favorable verdict for his client the estate of Texas millionaire J. Howard Marshall. A jury found that the estate owed nothing to Marshall's widow, former Playboy bunny and stripper Anna Nicole Smith, who married Marshall when he was 89 years old.^[3]

The attorneys fees to this big gun could make the Earthquest expenses look like a tiny drop in the bucket in comparison. The taxpayers better hope it turns criminal and anyone indicted is forced to pay their own legal fees!

When I figure out how to "like" your comments, I'll be tapping a tune in your general direction, Soapboxmom. Boy, won't that thrill George and draino. Or should I say Don and Laurie? It is the same articles in that tiny newspaper, the Tribune, that peaked my interest in EarthQuest in the first place. EarthQuest and the expenditures related to it are but one example of the cesspool that is government and a shining example of the greed that is taking down this once great nation of ours. I e-mailed the Tribune back in March concerning my sons frequent trips with the McCradys back in '09, concerning said numerous meals and who might be paying for them. When I made a comment to my son about how all these meals are being paid for he replied" Oh, he (referring to either Frank or his son Philip), just whips out the Am-Ex card. (EMCID's Am-Ex, perhaps?) I can't remember if I've posted on this site, but I know I have on the Underground about the first time I met "the Bank" My first impression and comment to my son was " He seems like a greedy politician (referring to Frank) to me". Of course, my son did'nt like this, (what 310 lb. Div 1 college defensive lineman , after eating numerous meals at nice restaurants with no money in his pocket, would?) ......another question- Why in the world would Sir gASSbag and Frank "the Bank" take Brian Blanchard on thier "investigative tours"? I found that gem again today and I couldn't help but laugh. I wonder how Holbrook will explain the astounding success he claims for Texas to the FBI and enforcement agencies now involved in cleaning up the mess he created. Oh to be a fly on the wall!

A corporation that fails to maintain financial records, prepare an annual report, or make a financial record or annual report available to the public in the manner prescribed by this article is guilty of a Class B misdemeanor.

All records of the Earthquest Institute or The Institute Earthquest that are required to be publicly available including, but not limited to financial records, records reflecting the activities of the charity as outlined on its website EarthQuest Institute - Programs, a list of the currently active managers and board members of the Institute, information relating to Dr. Gardner’s proposal to house the Institute on EMCID property until it could be moved to the theme park, filings with the IRS or State of Texas and any other information concerning fundraising or activities of this charity.

The videos of the town meeting from March 2012 gets more ludicrous with each listen. Frank "The Bank" McCrady is the king of tall tales. He blames Hillcrest bank for Marlin Atlantis defaulting and costing them a fortune saying that Hillcrest didn't do its due diligence. Then some really brainy lady asks him what due diligence he did on Marlin Atlantis. I guess Trey White and John Marlin plied McCrady and EMCID with that cancer curing Evolv water spiked with something really really good. Marlin Atlantis was not well respected and had done little but a few tract housing developments before they waltzed away with the EMCID vault.

An interesting discussion about the Institute ensues. Leon Cubillas seems to forget the gargantuan amount of tax dollars from EMCID taxpyers sunk into that ridiculous thing. And, he seems to have quite the memory loss about the rest of that whole sordid saga. There is mumbling about those numbers are in the 990's. The very forms that the IRS requires be made public that Don Allen Holbrook, the lying buffoon that he is, refused to turn over. Again, I bet the FBI will have no trouble getting copies of every last scrap of paper related to that scam.

So many juicy discussions. Not hard to see why numerous agencies are looking into this

P.S. lest we forget one of the greatest comedic moments. Frank "The Bank" McCrady parrots the dubious consultant, Don Allen Holbrook, and mumbles about two developers waiting in the wings who he assures us will satisfy all of the almost 8 million in bond money up front when they get the investors lined up to fund this $500,000,000.00 plus boondoggle. Well, I am Santa Claus and will be the next Pope as well!!!!

I just love it when the wheels start coming off the bus when going downhill with no brakes and running on just the rims. The impeding wreck is going to be entertaining to watch, and it is going to happen in living color and in slow-motion to boot. But a wreck it will be.

What will be interesting is to see what is left after the smoke clears. Hey maybe they can get a discount rate at the local prison for volume occupancy.

I can remember saying way back at the beginning of this sage that the inevitable outcome would be that the project would never get off the ground and that the developers would at some stage apply to have the area rezoned for housing, claiming it was the only possible way for them to recoup their losses.

“They haven’t come to us because of the rates,” says Hardin. “Clients get increasingly concerned about the number of lawyers that a large firm throws on the case. With our firm, when you get into large document cases, which increasingly we are, you have to manage it with the resources you’ve got. You can’t just throw everybody on there you think you can get away with billing.”

That was 4 years ago. With the firm's stunning success I am sure the rates have gone up. Why would Frank "The Bank" McCrady and company need such a dazzler just to facilitate turning over documents to enforcement agencies??? Perhaps, our boy has come to the realization he is dang well going to need some big guns!!!
