Pantherdad and Soapboxmom, you guys sound like you should be together. I grant you this, you do a great job of digging into other people's lives but is that living? Your evidence isn't even evidence, it's articles written by the media or information you have found through your of so clever investigative skills... Life will go on with or without your "wise words of wisdom" into the life of Don Holbrook; if Don Holbrook was truly such a con-artist or fraud like you paint him out to be then he would never have had all the opportunities that he has had at creating jobs and working with multi-million dollar deals. To be honest, your stalking of Mr. Holbrook has been unsuccessful and you haven't done much but possibly cost yourself a lot of time you'll never get back. Also, watch your accusations about his financials because the man truly lives off of nothing right now and has no bank account in an offshore account. All you are doing is causing another person pain, harm, and false humiliation and one day you will receive the same in return but ten-fold. But pray to your God and hopefully he takes pity on you.
    If Holbrook (your alter ego, perhaps) hadn't threatened all the taxpayers commenting on Earthquest and then proceeded to name all of them (John and Jane Does) in a frivolous lawsuit, then he wouldn't be getting this deluge of publicity. His constant meltdowns about being stalked are also a sure fire method for getting the attention of journalists and bloggers. Those false criminal allegations might well be Holbrook's downfall. Those kind of fabrications and lies are certainly not going to endear him to the judge in Ohio. I suspect they will lead to his going down really hard in court.

    Holbrook, judging from the Red Wing meeting minutes, deliberately lied to the folks there about his qualifications. So, it looks to me like his problems are entirely of his own making. The negative media attention seems well deserved!

    The vast majority of scammers do not get prosecuted. Law enforcement is way too underfunded and understaffed. That is where the media and bloggers come in handy. The fact this clown hasn't been arrested does not mean what he has done is advisable or ethical etc. Holbrook is a smooth talker and that allowed him to continue his shenanigans for quite some time. Unfortunately for him, he ran into Cynthia Calvert, Craig Malisow, Frank Maurizio, The Pahrump Valley Times, numerous John and Jane Does taxpayers and little ol' me. His insane response, which was to threaten lawsuits and scream that he was a victim of cyber-stalking, cyber bullying and cyber-harassment, set off a firestorm. Holbrook single-handedly harpooned his own career with the negative publicity he generated.

    I don't serve here to make money. I am here to advocate for consumers and taxpayers. Only slime like Holbrook would want to turn everything in life into a money making scheme, right George????

    Who knows if Holbrook has an offshore account??? I do know from his bankruptcy that he appears to be drawing off one or more unnamed business accounts and that his creditors had no idea about that or the fact he was paying $35,000.00 a year for his sons' exclusive prep school while crying to them he can't afford to pay them. Disgusting!!!

    If Holbrook is now unable to milk any more tax dollars for "Blue Sky" projects, then praise the Lord as that is success in my book!

    Holbrook is the vengeful scum that filed a totally frivolous lawsuit in a desperate bid to silence his legitimate critics. I hardly think those that shared the facts, truth and their opinions in an effort to warn and inform the public need fear pain and humiliation in return for our good deeds.

    The car bombing story is quite fascinating. I took the liberty of calling the Red Wing Police department (records division) and no felony reports for any threatened, attempted or successful car bombings on Holbrook. There were 6 items from that time period though. Holbrook reported a burglary, suspicious activity, filed an information report and other civil nonsense. After suing the city of Red Wing, no doubt he had some enemies. As he has recently been fantasizing about being cyber-atlked, cyber-harasssed and cyber-bullied, I guess car bombs wouldn't be too big of a stretch. I assume our new friend George yel will be posting that police report and any news articles about this car bombing incident. That is a serious criminal matter and if it were true there should be quite a paper trail.

    Maybe the car he drives is a bomb. He got confused thinking since it is a bomb of a car that constituted it being car bombed.

    Standing Up for Principles


    Many times we are asked to conform to other folks expectations and what they believe to be the best route to achieve the best interests of the masses. The problem with this approach is that unless someone has been in the gauntlet and was engaged in the process they really can’t make a decision of how they would have approached the issue or solved the problem with their own version of a solution. Appearances are important to many folks, but the appearance of something can be deeply deceiving.
    Don’t Ever Give Up!

    I have found in my own life that many folks who have not stood up for their principles when all is at stake cannot comprehend the true measure of integrity and honor. It is easy to speak of such things when you are not called upon to defend your statements. It is even easier when you have nothing at stake to take a position of saying what is the best course.

    In the end, it is always those of us that ride out into the tempest and tilt our lances at the trials and tribulations that each day puts before us knowing each time we are completely exposed and all depends on our own abilities to survive, feed our families and live within the honor and integrity code that we feel befits our character. Some of us raise the bar and will not wither at public scorn and ridicule but will stay the course of what we in our heart of hearts know is right and just.

    This type of approach is not for the feint of heart. If you say you are honorable and just then you will be tempted and tested by live fire in real life. To those of you that choose this chalice I salute you, brothers and sisters. Stay the course the truth is always the best approach and being candid and true to yourself is absolutely most important in all such endeavors.

    One of the most trying situations I know for me has been my defamatory attacks by some very malicious social media bloggers. They think they are the jury and arbitrators of what is true and factual in matters of which they have no knowledge or factual evidence to support their claims. These vigilantes justify their actions because they believe the first amendment protects their freedom of speech. It does but they have failed to understand that while the First Amendment protects Freedom of Speech, it does not tolerate trampling on someones reputation and destroying their livelihood for the other persons own personal satisfaction. It does not allow for people to make up facts and allegations of their own making and purport them as the actual facts to support their attacks on someone’s reputation and good name.

    I have not responded to such malicious vigilantes demands for my own facts because in my opinion they would just distort them and/or more than likely they would begin to bombard my clients with their false and defamatory remarks and further damage my career with my current and former clients. These malicious folks have already denoted on their blogs that their intentions are to do just that, so I have not responded to such threats and will not. Furthermore, these folks have attacked me at my professional industry level by emailing my colleagues over a 100 of them about their meritless claims. These folks have emailed my professional membership in my social circles and attacked my reputation asking for me to written up on ethics violations and/or removed from the professional and civic membership.

    No, we must stand our ground against such scoundrels and not allow these cyber bullies to prevail. I know many of us would give up but that just makes them feel justified in their illegal actions. To any of you that stand for what is right and face such perils, I feel for you and salute your integrity and honor for standing up for your principles.
    Don Allen Holbrook takes neanderthal to a whole new level. He has sued numerous parties and in order to prove his case and prove damages, he will have to turn over literally every business and financial record in his possession or control. The defendants will be contacting everyone he has had any contact with for business purposes in order to get information from them, subpoena docs, depose them etc. So, if he thinks the research done by the media and bloggers so far has been trying, wait until the case really gets rolling and he has to turn over everything but his used toilet paper and is generating thousands of dollars in attorney's fees monthly.

    Mr. Holbrook has been mired in controversy for years having been fired or having had his contract not renewed in numerous jobs. The articles and blogs out there have just touched the surface of that. Now, all the details, archived articles and court documents will be brought to the fore and you will be under the microscope.

    Mr. Holbrook, if there has been a false statement by any party you have failed to identify such. And, though you are obviously hopelessly confused about it, opinion is not generally actionable and you aren't going to be awarded any damages because taxpayers and bloggers have a negative opinion of you. Of course, this frivolous lawsuit has achieved the purpose of those that publish articles and blogs. We are getting many more reads and much more attention to our fine work. And, you with your ridiculous rants and filings about being cyber-stalked, cyber-harassed and cyber-bullied, have shown your true colors. You will do anything to appear to be a martyr.

    Your frivolous case makes you look so incredibly foolish and most glaringly so as you had to drop it against the lynchpin Craig Malisow and two of the papers. You built your whole lie-filled laughable complaint around his phone call and the conspiracy accompanying that. Then your attorney against all logic claimed it was all related to and based on your problems with the city of Huber Heights, Ohio. I am still waiting for your lawyer wench to explain how damages in Pahrump, Ohio are related to your Huber Heights disaster.

    The best part is your silly little blog has virtually no traffic. The traffic is so low it can't be measured. But, your defendants are reading it and quoting it for its comedic value. I will be doing everything in my power to see the IEDC takes appropriate action against you. I will never rest until the Knights have revoked your membership and held you to the standards they profess to have. You should not be sullying their good name with your attacks on free speech and the worthy taxpayers of this fine country.

    Let's assume Holbrook's car WAS a bomb. We all know driving jalopies up north through numerous winters constitutes a serious buildup of salt under the floorpans. Salt eventually rusts away the floor pans of said jalopies. If there was the slightest exhaust leak coming through the floorpans, over time ,the continued breathing of those noxious fumes would cause serious brain damage and quite possibly severe delusions. If this is the case, and the root cause of your recent delusions, then please accept my sincerest apologies.............NOT !!! Hey Don, maybe you can use this scenario when you offer the Judge your sincerest apologies for bringing such a frivolous lawsuit against those who comment and offer thier opinion on how taxpayer's money is spent, ultimately leading to even MORE taxpayer's money being blown on you.

    Speaking of quoting things for comedic value, this one was hysterical and I still can't stop laughing at it. Mr. Yel, er...Sir gASSbag (logical assumption, Don), quotes, "Don Holbrook's deals don't go through, not because of his effort, it's because their are people out there who call themselves specialists, and have great credentials and references, however, they're sharks and liars THEMSELVES". Are you calling the Supreme Lord and Master of the Internet a shark and liar? And while we're on the subject of sharks, if birds of a feather flock together, would it not be logical to assume sharks SWIM together?     A Dakota County judge has denied motions made by the attorney for Don and Laurie Holbrook for a new trial in their suit against Paul and Marsha Brown of PMC Inc., owner of Red Wing Mall.
    Judge Thomas Poch, Hastings, also denied a motion to award the Holbrooks approximately $440,000 in damages. But he upheld a motion to overturn a jury's decision finding Laurie Holbrook liable for $7,500 in damages......

    he will file an appeal with the Minnesota Court of Appeals within the next three weeks to seek a new trial. "Now we are free to go forward on our claim against PMC that they breached the contract. Their defense for not performing on the contract was removed, therefore they have no defense, and we should be entitled to damages," he said.

    Holbrook, Port may settle for $160,000 08/24/2000

    The Red Wing Port Authority is faced with a $160,000-settlement in the Don Holbrook lawsuit....

    The proposed settlement does not include any admission of liability on the part of the Port Authority, said attorney Patricia Beety, who represents the Port Authority. The money would be paid by the League of Minnesota Cities Trust.

    "It's purely a means of avoiding future litigation costs and putting the matter behind them," she said this morning.

    In addition to the settlement amount, the Port Authority Board may write a letter that, according to Holbrook's attorney Ed Sisam, states that "a misunderstanding arose that led to Mr. Holbrook's separation and that the Port Authority acknowledges that it now understands that Mr. Holbrook has the degrees from LaSalle University that were listed on his resume."
    Beety confirmed both the settlement amount and the language of the letter this morning. But she added that the language in the proposed letter does not reflect that the agency believed Holbrook had the degrees at the time of his termination.

    Federal Magistrate Franklin Noel proposed the letter.

    "Mr. Holbrook has finally been vindicated, and the suit was about clearing his good name," Sisam said. "The amount represents the damages of lost wages and his expenses."
    "Economically it made sense," Beety said of the settlement amount. She added that it is less than the approximate $170,000 that Holbrook had alleged was the result of attorney fees and costs...

    The board's reason for his termination was that he did not have the degrees that he stated he had on his resume.

    "It's a fair settlement," Sisam said. "The Port Authority and Dr. Holbrook can both go on with their lives."

    To The Editor:
    I am dismayed that legal counsel has recommended a monetary settlement instead of accepting the challenge of arguing in court the termination of Don Holbrook as executive director of the Port Authority.

    Does he really deserve $160,000 on top of making fools of us all?We know his "whistle blower" lawsuit was nothing more than retaliation against the Port Authority Board when he realized they were on to him.

    As for the letter which the Port Authority may write as part of the settlement - let's be honest about Holbrook's degrees. La Salle University in Louisiana is not an accredited college, according to the University of Minnesota's registrar's office. They offer mail-order courses and degrees. So while Holbrook may have the paper "degree" which he listed on his resume, he does not have the education associated with those types of degrees. That was the whole point of firing him.

    For once, let's not cave in. We have the proof, so let the case go forward, and don't let Holbrook manipulate this town anymore. He should absolutely not be paid more money just to make him go away.

    An MBA and Phd from Lasalle??? What a joke! We have the history of LaSalle's being exposed to follow. There is no way that he completed coursework and received legitimate degrees after 1996 from that cesspool LaSalle. So much for clearing his name!!!

    James Kirk diploma mills - Wikipedia, the free encyclopedia
    Federal investigators estimated that LaSalle, alone, had issued in excess of 40,000 fake diplomas, the bulk of them to government employees. In fact, LaSalle's sales and marketing materials highlighted the fact that many of its graduates occupied high positions in government.[citation needed] The school was shut down after a July 1996 raid by the FBI, U.S. postal inspectors, and the Internal Revenue Service.[8] According to John Bear, the U.S. Attorney wrote to every person in the LaSalle files, officially informing them that LaSalle was nothing more than a diploma mill. All were advised that funds were available for refunds, providing they turned in their diploma(s). Many didn't, presumably so they could continue to parlay their degrees for more money in the marketplace, with impunity (they could always claim ignorance, later). The FBI report stated that LaSalle had only one faculty member serving 15,000 students (and her only degree was a Bachelor's from LaSalle). Furthermore, the back of the student application forms contained a disclaimer advising students that their signatures simply made them Ministers of Kirk's World Christian Church, and that any degrees they might get would merely be religious degrees, regardless of the subject.[9]
    Kirk was charged with 18 criminal counts, including mail fraud, tax violations, and other crimes.[8] At the time of his arrest, the operation was discovered to have more than $35 million in bank deposits, current cash deposits of $10 million, and other assets.[5] Ultimately Kirk entered a plea agreement in which he was sentenced to five years in federal prison and was ordered not to operate any more schools.[8] Kirk did, in fact, serve five years for all charges relating to these diploma mills.[

    Moschella also described a diploma mill that was actually located in Louisiana, called LaSalle University. The organization was run by the "World Christian Church" and was not associated with La Salle University in Pennsylvania.

    The World Christian Church actually built a campus and had an enrollment of several thousand students around the world, but the correspondence "coursework" was graded by secretaries, and the school falsely claimed that it was accredited. Thomas Kirk, the president of the World Christian Church, pled guilty to conspiracy in the late 1990s and was sentenced to five years in prison.

    The status of LaSalle University “was not a secret to anybody,” Pendley said. “The board was aware of that.”

    LaSalle University, not to be confused with the Catholic La Salle University of Philadelphia, was operated by Thomas James Kirk III. Kirk became notorious for running “diploma mills” such as the now-defunct Bienville University, also based in Louisiana, and the Pasadena-based University of San Gabriel Valley.

    Merriam-Webster defines a diploma mill as “a usually unregulated institution of higher education granting degrees with few or no academic requirements.”
    Kirk received a five-year federal prison sentence after being indicted for fraud in 1996. The FBI raided LaSalle University, located in Mandeville, in July of that year, according to newspaper reports.


    The Louisiana Attorney General filed a lawsuit against LaSalle University in 1994, but it claimed a religious exemption to new licensing requirements for postsecondary education.

    LaSalle University’s website states that the Orion Education Corporation took over the school in 1997. It ceased operations in May 2002 “because of financial difficulties,” according to the site.

    If you Google “LaSalle University” you’ll see pictures of brick buildings, smiling college students and maybe even a link to a U.S. News and World Report story ranking it as a top 50 U.S. college.
    But those stories are referring to La Salle University in Pennsylvania — a completely unrelated Catholic liberal arts college in Philadelphia founded in 1863.
    The LaSalle where Pendley got his degree once claimed to be religious in nature, yet it had no campus and was founded by Thomas Kirk in 1989.
    To get an idea of what Kirk’s LaSalle was about, consider that the correspondence school had a single “academic advisor” to serve thousands of students and required no academic work of degree recipients. Or that five employees graded student dissertations, not by reading them, but by weighing them on a scale.
    That’s according to Allen Ezell, a retired FBI agent who created the agency’s diploma mill task force, “DipScam,” in 1980 and headed it until 1991.
    He said degrees were awarded to anyone shelling out a few thousand dollars.
    “It was a smash-and-grab type of place,” said Ezell, whose work was used by FBI agents later in building their case against LaSalle and Kirk.
    “LaSalle didn’t have the qualified people to render an opinion as to whether a paper had the quality necessary for a doctoral degree,” Ezell added.
    Kirk — who earlier ran a diploma mill in Southern California, Southland University — had long attempted to skirt tax and fraud laws by claiming his schools were religious institutions and conferred religious degrees.
    Kirk headed the World Christian Church, parent of the school, which advertised its degrees in the back of magazines like Popular Science.
    He thwarted a 1994 lawsuit by the Louisiana Attorney General by claiming a religious exemption to state licensing requirements for institutions of higher education.
    The July 1996 FBI raid effectively shut it down. Agents seized several truckloads of documents and $10 million.

    Two months later, a grand jury indicted Kirk on 18 counts of fraud by wire, fraud by mail and tax evasion. The government claimed he’d bilked students out of $36 million. Kirk maintained his innocence and took out ads in USA Today alleging “religious and academic persecution.”
    He accepted a plea deal that November, and was sentenced to five years in federal prison and surrendered his multimillion-dollar house.
    Ezell said the federal government took the $10 million and offered $3,000 to each of LaSalle’s 15,000 pre-raid “graduates” as compensation for being bilked. More than half refused the money. Some continued to use their degrees on resumes.
    John Bear, a diploma mill expert, said that fake credentials have allowed people to work in positions for which they’re grossly unqualified.
    “There’s just a huge number of professionals on that list,” Bear said. “Educators and therapists and ministers are the three big categories.”
    Bear, a Michigan State Ph.D. who has authored books on the subject of diploma mills, said that some LaSalle students were earnest, believing that the school was a valid “distance education” option.
    They may have done work, like writing dissertations, to fulfill graduation requirements that didn’t actually exist. But he noted the price should have been a red flag.
    “If someone offers you a Rolex watch for 10 bucks, you know it can’t possibly be real,” he said.
    “Someone familiar with the world of higher education would know that you can’t get a degree for $3,000.”
    In mid-1997, LaSalle University was reorganized as the “LaSalle Education Corporation” — later termed the “Orion Education Corporation.”

    In 2000, LaSalle University split into two parts, LaSalle University and Orion College. LaSalle allowed previously enrolled students to continue with their programs, while Orion College operated under a new curriculum introduced in 1998.
    Fake Dr. Holbrook knew the whole time he was suing the Red Wing port Authority that his degrees were bogus. No way he went back after he was hired in 1996 and obtained legitimate degress from LaSalle. Red Wing should never have settled with this litigious goon who didn't have a leg to stand on.

    I dare him to post his degrees online and publish his Master's Thesis and Doctoral Dissertation and let us see the thousands of pages of coursework he completed for the diploma mill. He won't do it becuase his work will not stand up to any real world analysis and critique. His colleagues in economic development that actually have done real research and written real papers have been published and can be read all over the net. They sure as hell aren't citing Holbrook that I can find. Holbrook hasn't published anything but light fluff pieces as far as I have seen.

    Consequences of Ignorance
    Individuals with superficial knowledge of a topic or subject may be worse off than people who know absolutely nothing.
    As Charles Darwin observed, "ignorance more frequently begets confidence than does knowledge."

    Ignorance can stifle learning, in that a person who falsely believes he or she is knowledgeable will not seek out clarification of his or her beliefs, but rather rely on his or her ignorant position. He or she may also reject valid but contrary information, neither realizing its importance nor understanding it. This concept is elucidated in Justin Kruger's and David Dunning's work, "Unskilled and Unaware of It: How Difficulties in Recognizing One's Own Incompetence Lead to Inflated Self-Assessments," otherwise known as the Dunning–Kruger effect.
    If one were very cruel, one could say the Dunning-Kruger effect was specifically targeted at a certain well known rogue member of our acquaintance, couldn't one ???

    Standing up to Holbrook 08/30/2000

    The financial settlement is difficult enough to swallow, but any proposed letter should be rejected outright.

    The Red Wing Port Authority finds itself in a difficult predicament when it convenes Thursday night to consider authorizing a payment of $160,000 and a letter of apology to rid itself and this city of Don Holbrook once and for all. For the Board of Commissioners, the economic argument to settle the whistle-blower lawsuit is compelling when considering the risks of a jury trial. If Holbrook would be awarded even just $1 in damages, the agency - and Red Wing taxpayers - would be liable for all of Holbrook's attorney fees. To this point, he reportedly has accrued $160,000-plus in fees.

    But is capitulating to Holbrook without a court battle really serving the best interests of Red Wing? Doesn't it only give license to Holbrook and others of his ilk, leaving a trail of dysfunction and disappointment in other communities?

    This is a classic case of principle vs. economics. Indeed, in this instance, the onus is not so much on the Port Authority as it is on the League of Minnesota Cities Insurance Trust, the insurance carrier that is representing the Port.

    The league has recommended the settlement with only one thought in mind: Cut the potential losses and run. It's an economic decision, pure and simple, with little thought to the message that action sends to the community which suffered during Holbrook's tenure.
    The Port Authority is getting twisted and turned by the process. Instead, the agency's legal counsel should be focusing on the facts.

    Holbrook was fired in 1998 for resume fraud. He did his best at his termination hearing to explain why he did not have the degrees, trying to deflect the blame onto internal problems at La Salle University in Louisiana. But it remains he did not have the degrees at the time of hire; it matters little whether he has the paper certificates today.

    It's noteworthy that since Holbrook's termination, ABC-TV's "20/20" program aired a report called "Scam Schools." The investigation highlighted La Salle University and Columbia State University in Louisiana, where all courses are done by correspondence. The operations were fraudulent and, the report said, that fact was known by many students.

    The misrepresentation of his educational background was ammunition enough to dismiss Holbrook. But his education credentials represented only the tip of a pile of shenanigans promulgated by Holbrook. A blurring of the line between Port Authority business and personal business, badgering of clients, acting as a self-promoter who put personal priorities above community interests - all these allegations dogged Holbrook and have resurfaced in light of the proposed lawsuit settlement.

    Holbrook rendered himself ineffective by his own doing, and the Port Authority took the appropriate steps to get rid of him - period.

    It's unfortunate but the facts of the case have taken a back seat to the process. What is happening here underscores the dynamics and the enormous complexity of our legal system - a soap opera of what has gone wrong with lawmaking. The options for the Port Authority are unsatisfactory at best: Either pay off Holbrook or pay its own attorneys to fight the case with the risk - no matter how minimal - of losing and paying out bigger bucks.

    The priority for the federal magistrate at last week's settlement conference was to avoid a trial and get the case settled - in this instance, $160,000 and a muddled letter to Holbrook addressing a "misunderstanding" that let to his dismissal.

    Don't misunderstand who in the end will pay any out-of-court settlement. Yes, the Port Authority's direct exposure in a $160,000 settlement would be its $500 insurance deductible. But the pot of money in the insurance trust all comes from taxes in one form or another. Any settlement for Holbrook will contribute to the trend that has driven up Port Authority premiums in recent years.

    The financial settlement is difficult enough to swallow, but any proposed letter should be rejected outright. The wording matters little. It will be interpreted by all as a misfire by the Port Authority and will give Holbrook a license to take his trade elsewhere and boast that his poor performance in Red Wing was a failure on the part of the community and not himself.

    As a final note, the Port Authority should not consider any financial settlement until it has a certified and itemized copy of Holbrook's legal fees and expenses. The settlement, as we understand it, was intended to cover legal costs associated solely with the whistle-blower lawsuit and not to put any money in his personal pocket. The Port Authority has been told of his costs, but has no documentation. There's reason to examine the amount, given its enormity compared with what the Port Authority has spent to date.
    The base fact is that the system stinks. Minnesota law makes it difficult to fire public executives who perform poorly. There are too many loopholes through which failed officials can pot-shoot their bosses. General reform is needed so that governmental agencies can more easily toss some apples out of the barrel.

    The Red Wing Port Authority has put the ball back in the court of Don Holbrook after it rejected a proposed $160,000 settlement on a 6-1 vote Thursday night.

    A day after voting 6-1 to forward a counterproposal to Don Holbrook's attorneys, the Red Wing Port Authority board learned that the lawsuit was, in fact, dismissed a week ago through the order of a federal judge.

    Unknown to the other commissioners, Executive Director Myron White, Port Authority Vice Chairman Roy Harley and the agency's attorney apparently approved the monetary amount at an Aug. 23 settlement conference at U.S. District Court in Minneapolis, the day before Judge James Rosenbaum order was signed.


    The out-of-court settlement in Holbrook's whistle-blower lawsuit against the Port Authority was made without prior approval by the full board......


    Commissioners voted Thursday night following a closed meeting to reject a settlement that included $160,000 and a letter of misunderstanding to be sent to Holbrook, the agency's former executive director who was fired in 1998.....

    In addition, the board never voted formally to give White and Harley settlement authority.
    Still, in the July 14 notice of the pretrial and settlement conference, Noel stated that attorneys who will actually try the case should be present, and that "each party must attend through a person who has the power to settle the case upon the opposing party's last stated settlement terms."
    Len Kiecker, chairman of the Port board, said Friday, "As far as I know, they were just to go up there and to listen to the arguments." Harley was at the conference in his place because Kiecker could not attend.
    White invited him to participate, Harley said. "I understood that we were observers to report back to the Port Board. There was a big enough difference that ... it didn't seem like there would be a resolution at the hearing."....
    So, it was rushed into settlement without the legally governing body / the board given the chance to vote on the issue. The attorney did not properly inform the board.

    Port Authority abuses open meeting law 09/06/2000

    Port Authority commissioners met in closed session Thursday night on the stated basis of attorney-client privilege to discuss litigation pending against the agency by former Executive Director Don Holbrook.

    The fact is that the case was dismissed a week earlier by U.S. District Judge James M. Rosenbaum. The court order, dated Aug. 24, stated, "The court has been advised by counsel that the above entitled action has been settled. Therefore, it is ordered that: This action is dismissed with prejudice. In the event the parties wish to file settlement documents, counsel are directed to do so within 15 days."

    ...At the time of the meeting, commissioners claim they were unaware that the $160,000 payment to Holbrook had been finalized a week earlier at a pretrial settlement conference attended by Executive Director Myron White, Board Vice Chairman Roy Harley and Beety. In fact, commissioners apparently did not learn the judge had dismissed the case until the day after the closed session, when informed by R-E reporter Mike Fielding.
    The Red Wing Port authority really didn't settle with Holbrook. Their attorney did not explain the court process to them and she settled without giving the board a chance to vote and decide. Very poorly handled by the attorney!!! The board learned that the case had been settled and subsequently dismissed by this fine paper. Thank God for such fine reporting!

    the correspondence school had a single “academic advisor” to serve thousands of students and required no academic work of degree recipients. Or that five employees graded student dissertations, not by reading them, but by weighing them on a scale.
    Well. Mr. Litigious goon, for the record, I spent years in college and was pursuing Graduate Degrees in Music Education and Russian history when I had to quit school and move with my husband for his job. I hold Bachelor's degrees in Music, Secondary and Higher Education and have a minor in French. I had academic advisers that held Masters or Doctorates in the subject areas I was studying. You had a LaSalle Bachelor's degree holder advising you on Master's and Doctoral level work in fields she was not degreed in and secretaries evaluating your work.

    It could not have been a surprise to you that you were not working with any qualified individuals in your field of study. Publish the Master's Thesis and Doctoral Dissertation you wowed them with. Everyone reading here needs a good laugh and I am sure that would be a doosie of a read. I routinely wrote papers in my graduate classes. Anyone else get all lathered up by French organ music???

    Holbrook should keep filing frivolous lawsuits and garnering a deluge of publicity. His adventures into academics are even more amusing than his 100's of projects worth billions of dollars that created 50,000 jobs. Fascinating fiction. Maybe that should be the subject of a book and movie!!! Maybe we could dig up John Candy and give him the starring role!!!

    ....they went into that closed session at least believing they had some control over the settlement - that, if they wanted, they could take the risk and advance the case to trial. In reality, the meeting was a farce and discussion was fruitless. Most incredible of all, no one apparently had the fortitude to level with board members - even during the closed meeting - and acknowledge they already had signed off on the money. They evidently continued to perpetuate the sales job that it was in the agency's best interests to roll over and play dead.....
    You may have successfully ripped off the tax payers in Red Wing, and the board may have been fooled into rolling over and playing dead. But, you, Holbrook, will have no luck getting the very astute folks you have filed against now to roll over and play dead. I fully intend to challenge you publicly at every opportunity. You should have checked out the frivolous case Tim Darnell filed against me.

    Here is a good look at the "destination attraction" that Chris Brown and Don Holbrook cooked up for Pahrump. Holbrook waddles in at the beginning of the tape and Chris Brown speaks starting at the 5 minute mark. This is another "Blue Sky" deal as the city of Pahrump cannot issue bonds and the Nye County Commissioners have already nixed the deal. Scumbag Holbrook is suing the John and Jane Doe taxpayers and all the other remaining third party defendants for $80,000.00 + on that fruitcake deal (in Ohio mind you, though his attorney wench claims the case only pertains to his disputed contract in Huber Heights, Ohio.) Holbrook needs to be taken out of commission so he can never collect another dime in tax dollars nor file any more of his frivolous suits.
