I think this Woods guy is in the founder's club as he seems to be in MyBidShack with Darryl Douglas and may have migrated to ZeekRewards without actually paying money into it.

I put the question to some of the legal eagles over at Quatloos and there does seem to be some validity to the improper service argument. But unlike what Robert is explaining if the existing subpoenas are found to be defective (in form or service) it doesn't mean that Ken Bell will dry up and blow away, it just means a corrected subpoena will be sent.

Just got word from a solid source that the head of the SEC has been forced to resign due to the major pressure that the SEC is dealing with now in the wake of over 1700 lawsuits fighting against the SEC wrongful allegations against Zeek. I wonder if the SEC will now find a way to end this sooner rather then later and give us our company back.

Hi Glim,

Maybe Kettner was talking to the same solid source who told the ASD folks (in the early fall of 2008) that the government secretly had admitted ASD was not a Ponzi scheme and was clinging to the case in a bid to save face.

There were many amazing things about the ASD claim, not the least of which was that certain ASDers continued to make it even AFTER:

* The government went back to court and filed a second forfeiture complaint (December 2008) alleging a Ponzi -- and then a third (December 2010).
* The government revealed that Andy Bowdoin had signed a proffer letter and admitted the government's material allegations were all true. (April 2009).
* Bowdoin was sued under the RICO statute by some of his own members. (January 2009, AFTER Bowdoin initially consented to the forfeiture.)
* Bowdoin was indicted. (November 2010).
* Bowdoin pleaded guilty. (May 2012.)
* Bowdoin was sentenced to prison. (August 29, 2012, 12 days after the SEC brought the Zeek action.)

Back in September, Kettner advanced these myths:


* We (the SEC) are not able to find a victim in this case. We are not able to find anybody at this time that has been harmed by Zeek Rewards.
* We (the SEC) are having a hard time finding a security. In the complaint, it said that Zeek was selling securities and was an investment scheme.

Of course, the ASDers advanced similar myths.

Now, Kettner appears to be advancing a myth that Mary Schapiro "has been forced to resign due to the major pressure that the SEC is dealing with now in the wake of over 1700 lawsuits fighting against the SEC wrongful allegations against Zeek."

And he's apparently advancing this myth AFTER Paul Burks consented to a judgment, a matter of public record for more than three months -- and AFTER the receiver announced his intention to pursue clawbacks.

As for the "1,700 lawsuits" claim, well, they must have been secretly filed. As of today, I can find no record of any Zeeker suing the SEC (or the receiver) for anything.

It would be interesting, though, to see if 1,700 pro se kit pleadings suddenly show up on Judge Mullen's Zeek docket. There were several dozen in the ASD case, including one that accused the judge of 60 or so felonies and implied she owed a certain ASD member $30 million.

This level of disconnect almost defies description.

OMG, I made a joke about this earlier this morning to a friend that this would happen by somone in the Zeek camp, but never thought they would be dumb enough to try it. I think I need to start up a psychic website for predicting the Zeek idiots next comments like Ms. Cleo used to have. On second thought, why press my luck. At least I got one right.

Now what is truly funny is the claim there are 1700 lawsuits filed. Don't these idiots know that can be verified? Don't answer, it is a rhetorical question. I still cannot stop from laughing at this. Absolutely the funniest thing I have read in a long, long, long time.

Sad part about it is that there will be some members who will be so desperate that they will believe this. Anything rather than face the fact that they have been taken for a royal ride and are now up to their necks in deep do dah.

Burks denies allegations from Zeek class-action suit

Former Zeek Chief Executive Officer Paul Burks said he denies allegations that his company was a large Ponzi and pyramid scheme.

In a formal response filed Monday in North Carolina Business Court, Burks addressed a class-action lawsuit filed against him and his company in Davidson County in August. Going through the complaint paragraph by paragraph, Burks largely denied allegations that he defrauded millions throughout the world through unregistered offers and sales of securities through Zeek Rewards and penny auction site Zeekler.com.

This is the first time Burks has directly addressed accusations against his former company since mid-August, when he quickly settled securities fraud charges filed by the U.S. Securities and Exchange Commission, without admitting or denying anything. Burks, a Lexington resident, was forced to pay a $4 million penalty and relinquish his reigns to the company. The case has since gone into receivership, and Charlotte attorney Kenneth Bell is actively pursuing what he estimates is hundreds of millions of dollars to eventually return to nearly 1 million people who lost money in the alleged scheme.

This might be a violation of the agreement he signed with the SEC and if it is, it's a band new ballgame.

Greetings good people:

Its official, the e-wallets are now starting to allow Zeek Affiliates access to their funds. Here is the latest. And how this mess was created; NXpay uses a company called LST Financial to do the transfers from you to the bank. The money is sitting in Four Oaks Bank in Charlotte NC, and waiting for an accounting from LST Financial on what is really valid to be in which account.

If you can imagine when the events of August 16, 2012 unfolded there was money sent by Credit Card transfers and so on, some of these transactions were challenged by people not wanting to have their money frozen, in addition others found other ways to access the funds which caused additional confusion.

As of right now $10 million has been made available and they are making blocks of 5 million at a time available to the Zeek Affiliates and we do not have a list but we can only recommend that everyone go and log into their accounts and when you see it is available use your funds wisely and place it in an account you can control.

We will be giving more updates in the next few days.

Again, we are happy to finally be providing this news and are extremely sorry for the hardship this has caused so many.

I can't imagine what's going through the minds of the Zeeklers who think for one moment they've had some sort of "victory" over the receiver via the "invalid subpoena" defence.

The receivers' expenses are paid from the receivership and there's no "double jeopardy" clause when it comes to the issuance of subpoenas.

As irritating and time consuming as it may be, there's no way it is going to affect the outcome.

Still, it's their money and their time, I suppose.

I thought I had a chance to scoop the Wizzard this time, someone e-mailed the files to me about an hour ago. But the knower of things is a faster reader than I am.

Check out the typo in document 78 page 2 section 3:

For example the receiver has deposited numerous (he estimates 60,000) financial investments received by the receivership defendant

I'm sure they meant to say financial instruments, after all no one invested anything in Zeek.

All in all it's an interesting motion, I don't understand how one "Examiner" could represent the interests of both the winners and the losers at the same time but hey, at least they finally filed something.

Not only that, they want the receivership estate to pay Mr. Quillings fees. Looks like the Fun Club will do anything it can to get other people to pay to fight their clawbacks.

When Troy Dooly was sticking his foot in his mouth over Zeek we were giving him a lot of attention, and rightly so. But now he's gotten his head a lot straighter and I'm going to give him some pub. Troy's posts on the latest Fun Club developments.

I sent an email to a Zeek promoter, asking what he thought of Quilling's motion and what the reasoning was behind it. Listen to this:

The ultimate goal is to bring Zeek back to life. This the most practical way to do it. The Court appointed receiver is going to waste a lot of that money in my opinion.

So their idea is to help waste the receivership estate even more in an effort to protect the Circle of 12?? If this gets granted, I am moving to Canada.....

Well, it's only fair. They gave us Rush, it's about time we gave them something nice.

But my condolences in advance to our Canadian friends, it looks like the Wizzard will be staying in the land of non round bacon. And in the unlikely event the motion is granted it probably wont be Mr. Quilling who's made the Examiner.

Remember, Robert and the Fun Club are paying well qualified attorneys good (donated) money to come up with something in what is otherwise a pretty hopeless case. And last I saw the "loyal affiliates" were starting to ask questions about why their NXPay money isn't freed up yet like Robert promised. Dave has already moved on to "Bids that Give" (and other programs), Robert needs to go for broke. I may be underestimating the gullibility of Robert's faithful but the number of people on the call in line for his conference calls is dropping and the "loyal affiliates" facebook page is still under 120 members, he can't keep milking those people forever. One of these days Robert's going to have to go out and find a real job, and it probably wont be in legitimate MLM.

^^ This pretty much sums up the only possible logical explanation of Craddock's moves.

IMHO, Craddock knows this will fail and he's going to use the denial of the motion as his 'exit strategy'. He will blame the evil & unfair court system and then take what's left of the 6 figures he collected in donations and go on his merry way. He had to do something to prevent claims of fraud (in taking donations for the purpose of mounting a legal challenge) and he has to find a path that he knows will fail that he can then scapegoat.

I was forwarded a message from the latest installment by Kevin Thompson, and I have to ask and you should too, why is Kevin so interested in the Zeek affiliates, it can’t be because he wants to help them and it is certainly not because he was an affiliated and if you have looked at the motivation of Kevin, there must be a financial gain, if he can cause confusion and create doubt in your mind.

Please, if you take the time to unsubscribe to his never ending emails, slamming the business you enjoyed, and in return made so many people the money never before possible in traditional network marketing product based companies.

We have some big announcements and we are reaching out to your leaders to setup smaller and more frequent conference calls as there is someone out there that wants to fuel them updates on our progress and they use this information to spin the truth and create doubt in your minds.

It's easy to see why Robert wants to muddy the waters with personal attacks rather than address the issues involved. The $300 a pop subpoena objection service he has been selling is revealed to be a waste of money and Mr. Maglich goes on to explain why it's unlikely that an Examiner will be appointed and if one is, why it almost certainly wont be Mr. Quilling. Now if Mr. Maglich had only addressed the NXPay situation he'd have blown Robert's complete sales pitch out of the water. It is very clear why Robert wants as many people as possible to unsubscribe from Kevin Thompson's email list.

Last night's call marked the death of Cradddock's biggest lie, that they were fighting to get Zeek rewards reopened. The Fun Club has always and only been about fighting clawbacks for the 12 members of the club using Robert as the bold lying face of the effort. Ken Bell has 20 days to file his objection to the motion appointing an affiliates representative and he doubtlessly will. Robert needs an exit strategy and that strategy needs to include something to sell the loyal affiliates. Son of a gun, he's got one. In "two to four weeks" something is going to be launched which will take Zeek rewards place.

I'd laugh if we see HogBid dot com relaunched, it fits pattern but I think Robert would be getting better advice than that. If these guys have been paying attention it's usually better to be Todd Disner than Paul Burks, so why would they want to run one of these things? It makes far more sense to organize a mass downline and move it under Greg Baker in GoFunPlaces or Dave Kettner in Bids that Give or even under Todd in Adit Network. I don't think these people are dumb enough to start up their own penny auction ponzi but it would be oh so very amusing to be wrong.

Summary of December 3 call. In essence, it was more of the repeats of the same stuff from other calls.

• Craddock was out in Las Vegas, working diligently
• There are people listening to the calls whospin information, so he has to be general

• Craddock needs to be representing all affiliates, so Quilling filed the Examiner motion, and counsel to affiliates
• Bell opposes this motion because it would reduce his billable hours with McGuire Woods.
• Seems he thinks the Motion has already been granted and if not for him, you would not get a dime
• Said people worked and had value in bids
• "We were all in a business, working hard to earn money" working for a percentage of the daily profits
