This was a good reply over at Oz's place on Troy's obsession with Canada and the SEC shutting Zeek:

Troy has been going on and on in his last video and in replies to comments on his blog about his belief that an international Ponzi ring has infiltrated Zeek and they are, at least partially, responsible for transforming Zeek into a Ponzi.

I’ll ignore that discussion for now since Oz and K. Chang have covered it above.

What I wanted to address was Troy’s insistence on this tidbit (emphasis is mine):

I think those at the very top could face criminal charges. I am starting to believe this could be part of an International investigation into a large Ponzi Ring which found an easy niche to oporate in called the MLM Penny Auctions.

I feel this way because the Complaint made it clear the SEC was working with thier counterparts in Canada. If this is true, then some of those at the top could face RICO charges.

I am not sure that anyone inside the company was involved directly, but who knows. And whatever happened to DD, his auction house launched before Dawns, I think?

This is classic Dooly taking one small tidbit of information and extrapolating into something that is unlikely (he did this with other tidbits and reached the wrong extrapolation: OFAC sanctions, banking situation, NC AG CID, voluntary shutdown, SEC’s civil complaint).

If I were to put my expert analysis hat on, I would simply apply Occam’s Razor and conclude:

Maybe the SEC worked with its Canadian counterparts not to bust an international Ponzi ring, but simply because…

…WAIT FOR IT…

…WAIT FOR IT…

SolidTrustPay and AlertPay (before they became Payza) are based in Canada! The SEC needed to see both sides of the financial transactions, obviously! They can access data for Zeek’s US banks and NXPay as they are in the US.

To complete the picture, they needed access to SolidTrustPay and AlertPay transactions. What easier way than to engage the SEC’s counterpart in Canada?

Isn’t that a MUCH simpler and more probable explanation than an international ring of organized Ponzi scammers that somehow took over the Zeek comp plan by force and RICO charges are forthcoming?

I’m just an amateur, if I can figure this stuff out…

Affiliates spar with banks over Zeek checks

As nearly one million affiliates wait to stake their claim against Zeek Rewards, several users are already battling their local banks.

In recent weeks, handfuls of affiliate checks were never cashed by Rex Venture Group LLC, the Lexington-based company that maintained Zeek Rewards and penny auction site Zeekler.com. The federal government shut down Zeek's operations last week, issuing fraud charges and an emergency asset freeze against the company they allege was a $600 million Ponzi scheme.

Some checks sent or delivered to the company are dated back to mid-July, affiliates say, and are for amounts ranging from $1,000 to $10,000.

Affiliates are attempting to cancel those checks at their local banks, but are quickly finding out it's not that easy.

Donna Grooms, of Winston-Salem, and her family have sent a total of six cashier's checks for a combined $8,000 to Zeek's headquarters at 803 West Center St. in Lexington. Of those checks, only one for $2,500 was deposited by the company.

Grooms said she went to her local BB&T branch on Monday, hoping to cancel the payments. She was told, “No,” she said.

"We know we may lose the $2,500 from the one that has been cashed, but we'd like to get the money back on the one's that haven't been,” Grooms said. “If they shut the company down and froze the assets, I don't see how they can be cashed anyway.”

Most local banks are not allowing stop-payments, citing recommendations from the North Carolina Attorney General's office as well as statutes included in the Uniform Commercial Code. The UCC, which includes a set of statutes and rules for financial institutions, is adopted in North Carolina and most U.S. states.

“Unfortunately, we do not have the authority to stop payment on an official check based on the Uniform Commercial Code,” said David R. White, vice president for corporate communications at BB&T.

In reality, customers don't have the ability to issue stop-payments on cashier's checks, as they become obligations of the bank after they are endorsed, according to the UCC. Essentially, and in most cases, once a cashier's check is cut, the bank has to pay the receiving party.

However, if a cashier's check is not cashed after ninety days, customers may be able to file a “declaration of loss” form at their local branch, White said.

According to section 3-312 of the UCC, a declaration of loss can be issued for lost, destroyed or stolen cashier's checks. The claim becomes enforceable after 90 days.

To the contrary, the N.C. State Employee's Credit Union has placed all outstanding funds from cashier's checks into an escrow account. Pending approval from the U.S. Securities and Exchange Commission, the bank will release those funds back to its members, said Leigh Brady, spokeswoman for NCSECU.

Louv Robinson, of High Point, was told on Monday she couldn't stop her payment to Zeek Rewards. She said the company has yet to deposit her check, which she submitted earlier this month.

“It doesn't make sense,” Robinson said. “If they didn't deposit the cashier's check or money order, why can't we stop payment on it? If those checks never get deposited, who keeps that money?”

Robinson said her local Bank of America branch informed her that the Attorney General's office had advised the bank to not stop any payments from Zeek affiliates.

The Attorney General's office, which has received dozens of complaints and inquiries about Rex Venture Group, Zeek Rewards, Zeekler.com in recent months, is still investigating the company's workings after demanding its records last month.

Noelle Talley, public information officer for the Attorney General's office, confirmed on Tuesday that the Attorney General has reached out to many area banks.

“We cannot advise banks what to do with the checks and are simply telling them to comply with the court order,” Talley said. “We've shared copies of the consent judgment and the order with banks and the N.C. Office of the Commissioner of Banks. Banks would need to consult with their attorneys to interpret the order or contact the receiver for further instructions.”

Talley advised affected affiliates should contact their banks, to see how they are specifically dealing with the issue. However, affiliates can send emails to the Attorney General's office at zeek@ncdoj.gov.

Tracy Wilbon, of Dayton, Ohio, said it's inappropriate for the Attorney General's office to contact banks that cross state lines, such as Bank of America. Wilbon, a Zeek Rewards affiliate, said banks should be able to release the money that Zeek has not deposited.

“These are hard-working American people,” Wilbon said. “You say you are trying to help them out, then give it back to them immediately and let them stop their checks.”

The court-appointed receiver, Charlotte attorney Kenneth Bell, began his investigation into Zeek Rewards on Monday. Bell, who will collect and marshal remaining investor funds, has also set up a website, ZeekRewards Receivership Website, and email, info@zeekrewardsreceivership.com, for affiliates.

In a previous post I had mentioned that Troy Dooly was a big promoter/supporter of ASD Cash Generator. I found his name in some of our notes from when we were assisting the Secret Service in their investigation of Zeek. All our information was sent to them.

It was pointed out that Troy was not a promoter/supporter of ASD, but in fact was reporting against them. I thought I remembered him promoting/supporting ASD back in the fall of 07 when ASD was just starting to take-off, and then changed his position around April.

Since I have not been able to find anything (even him being for or against ASD) I am apologizing to Troy for saying he was a major promoter/supporter of ASD.

Actually I looked into that myself and it turns out that when Todd left (well before it was a national company) it was not a "legitimate, thriving business" but a close to failing restaurant. It only became successful after Todd was long gone.
