Welcome to RealScam.com.
Two interesting developments with Troy Dooly's repsonses to date in his blog comments:
- He's in total denial
- The infallable Dr. Keith Laggos is now public enemy #1 for Troy
First, there was this question:
Troy responded:
Troy,
Your immediate mission in life should be to try and restore your reputation. Mainly because of your blog and opinion of zeek is why I became an affiliate. 20,000 dollars total for my wife and I to "buy" bids and promote this business. Not one cent to show for it and a load of embarrassment. You need to do everything in your power to make sure people like me get their money back. I should have gotten a clue at the red carpet event when everyone was dressed like they were going to a MMA event. What a joke! Do the right thing Troy!
Then then this conversation with gen3benz1:@dtspharmd,
Thank you for reaching out and sharing your heart.
I did not know my reputation needed restored. I reported on Zeek Rewards as I report on all companies, I just gave it a boatload more coverage because it was what folks were asking about. I also reported all the facts I had on each editorial.
I fully understand folks took what I said and made their decisions around what I reported. I will stand behind what I reported and in reviewing all I have said and wrote in the last few days, along with all the comments I answered, I provided a very balanced review.
I have more to report and more questions and answers were are searching for. There is $225 million dollars for refunds, not counting the funds that have not yet been deposited. And I have learned there are around 200 founders which I had not known about that had special positions in the comp plan. The receiver will be reviewing all of this info and determining if the clawback rule will apply in specific situations.
One situation that I figure will be reviewed very quickly will be the fact Dr, Keith Laggos was the self-proclaimed mastermind behind the current compensation plan, which he changed in 2012 when he became the comp plan consultant and a top level affiliate earning $40K per month. We did report on that when it was made public right after the last Red Carpet Day.
So you can bet I will be doing the right thing and continuing to report on this and other situations surrounding the penny auctions.
Living An Epic Adventure,
Troy
gen3benz1:
1. Was zeekrewards a ponzi?
2. Were you ever paid by RVG?
Troy:
1. According to the latest SEC complaint.
2. I have answered that before. Yes, although I was not paid for the last red carpet day event.
3. But I never was hired as the compensation consultant to create what the regulators just called a ponzi, nor did I have a secret position in the ponzi compensation plan earning $40K per month. Remember that was Drl Laggos
4. I reported the story as I saw it, as I have for years.
gen3benz1:
But you did study the ponzi compensation plan and denied it was a ponzi over and over and over again.
But at least you admitted you were wrong with your analysis and very sorry for telling potential affiliates it was a good company to join. And for that, we thank you.
Troy:
Not true at all. I studied the compensation plan, and was very clear form day one, that the issue with the plan was the RPP. I also many times since Dec 2011, made it clear that in order for Zeek to fix that they needed real customer volume, and I was the one who both presented the DubLi model as an example and also provided the 3rd party partner to create and the Zee Bates platform. This was done at the first Red Carpet Day I attended in April. The contracts were not signed until time July of this year, and as we know I was right!
I admit that I did not see the federal regulators moving in as they did and cutting a deal for $4 million dollars (less than 1%) of the $600 million and not explaining why they did not seize the assets of the other $7 million.
And since I NEVER told anyone it was a good company to join, or that any penny auction was a good company to join, there would not be anything on that level to apologetic for.
As a matter of fact, I did in one video if you go watch it state the following... "If the only three companies left in network marketing were Zeek Rewards, Co2 Rewards, and DubLi Network, I would join DubLi Network, because one of my best friends is the Senior Marketing Director"
In thousands of emails, comments and how ever many posts, I have always made it clear I would NOT join Zeek Rewards, or any other penny auction.
I have also been very clear, that ANYONE who does join any penny auction make sure they fully understand the risks of the business model, because it was new and had never been tested under regulatory scrutiny.
You want to put words in my mouth make sure you fully know what I have said. You had better watch every video, read every editorial and read each comment... because that is exactly what the regulators from the Secret Service, AG and SEC have done over the last few months. Plus, some of them have listened and talked to me at the Red Carpet Days.
I am truly sorry for all the affiliates who are hurting financially and emotionally. And I will continue to fight so they can get their money back, and help to pursue those of the 200 founders who promoted Zeek illegally to get many of these folks to join on the promise of unrealistic financial gains. Which if you take the time to read all that I have said and written you would know this already.

That's one of the main problems facing anyone trying to prevent online fraud.
People who either can't read or can't quite comprehend what they DO read and the people who capitalize on the fact they exist in growing numbers.
Zeek implanted the idea that the "investment/not investment" argument was the problem it faced when it never was.
It will take years (if ever) before many of the victims realize it was NEVER about using the words "invest" or "investing'
Zeek reinforcing the idea it was by charging for "compliance courses" worked perfectly FOR ZEEK
They made extra money for nothing from those who paid for them AND made the targets of their fraud think what they were doing was legit.
Zeeks' plan obviously worked because there are thousands, if not hundreds of thousands of real people out there who STILL believe Zeek was legit. DESPITE what's happened.
Unlike many others, I am totally convinced there are a large number of real, genuine people left in the wake of this fraud who, for whatever reason, believe they had found financial heaven.
IM(very)HO, it is way too easy to dismiss ALL victims as being greedy and stupid and deserving of being defrauded.
In fact, it amuses me that the only people not guilty of being judgmental are the fraudsters themselves.
THEY aren't judgmental.
They'll take money from anyone and everyone.
The only thing necessary for the triumph of evil is for good men to do nothing
Wow, Thanks Mitch. I tried to sign up with Troy's new comment system but couldn't get a confirmation e-mail. I'll try again tomorrow. But Troy, Dude, get real.
After your meeting in Las Vegas you have never been neutral or unbiased in your coverage of Zeek. You played the same "compliance" puppet show that Dr. Laggos. Paul and Dawn did (I left some people out of that list but you know who you are). Troy, they changed the words they used to sell the RPP BUT THEY NEVER CHANGED THE RPP !!!
The RPP IS the problem!!! It always was.
You told people how hard ZR was working to become legal without ever reflecting on the fact that if they already were legal they wouldn't need to make that effort.
Troy, hundreds if not thousands of people have lost tens if not hundreds of thousand dollars because they like and trust you. They relied upon your opinions and your reputation when they decided to put money into Zeek Rewards. If you feel no responsibility for that then you not only aren't the man I hoped you were, you are not the man you claim to be.
So your prophets of finance have fallen on their collective proverbial face, and you hear muffled voices calling: Welcome to the human race.

I am DEFINITELY not a lawyer, but, I can see there's several different possible scenarios arising out of the bankruptcy question:
* AFAIK, the receiver has the ability through the courts to force bankruptcy if he/she cannot come to a satisfactory arrangement with the creditor. Some types of court judgments are discharged in bankruptcy, but some are not. The general rule is that bankruptcy discharges all judgments. However, bankruptcy does not discharge judgments for family support obligations, government-imposed fines or penalties, or taxes.
Government Fines
- If you broke a law and were ordered by the court to pay a fine or penalty, your financial obligation will not be discharged in bankruptcy.
Family support obligations include decrees such as court orders that require payment of child support or alimony.
They also include orders to pay debts in a divorce decree. These judgments will not be discharged in bankruptcy.
If you broke a law and were ordered by the court to pay a fine or penalty, your financial obligation will not be discharged in bankruptcy.
Judgments for unpaid income taxes and property taxes are not discharged in bankruptcy
* Bankruptcy does NOT discharge debt arising from fraud
* There are certain debts that are NOT dischargeable in bankruptcy. Generally speaking, the following debts will not be discharged: taxes; spousal and child support; debts arising out of willful misconduct and or malicious misconduct by the debtor; liability for injury or death from driving while intoxicated; nondischargeable debts from a prior bankruptcy; student loans and criminal fines, penalties and forfeitures.

Forbes magazine had two stories about Zeek by two different reporters. They allow comments. I bet neither reporter was prepared for the comments they received about their articles on Zeek. The pro-Zeeksters were out in force and all the conspiracy theories, the evil government, and then asking questions that neither reporter could possibly answer even if they tried, and it is a zoo. I think they are probably shell-shocked.
So I welcomed them to my world but let them know that the names they were being called were really tame compared to what names I am called. It will be interesting to see if they contact me. But I was able to get a plug in for Kasey's blog and behindMLM's blog. They deserve it.

I had a stray notion cross my mind, can't decide if it's a worthy idea but I'll throw it out to the community for consideration.
Does anyone have any hands on experience with running a free Wiki website?
There is a considerable list of people who played a role in making Zeek Rewards the program it is today. Not only Paul Burks but the high profile Rex Ventures employees as well. Then there's the MLM dream team who lent their reputations to legitimize Zeek in the minds of the affiliates and on down to the promoters who lined their pockets with those affiliates money. I think it would be a shame if their contributions were lost to the mists of time.
The problem is forum software like we use here isn't really a good format for this sort of thing, the linear layout is great for conversations but the structure doesn't lend it's self to a project like this. A Wiki is more or less perfect, individual pages for individual players all inter linked where appropriate. I know there are Wiki addons that could be integrated into our software but there are some issues with that. First of all I don't have the time at the moment to find the most appropriate package, deal with the install and integration issues and find someone to run the thing.
And that last point needs to be expanded. If this was to work out it would need to be a community project, I wouldn't want to "own it" I'd want every person who contributed to it to own it together. It wouldn't be a RealScam thing it would be an anti-scam community thing.
But we could collectively ensure that so many people responsible for the Zeek debacle can not out run the truth. The next time some future Paul Burks tells his flock that he's legit because Keith Laggos said so there would be a resource warning people they're about to get fleeced. This could extend past just the people and into some of the basic concepts. What does it mean when almost all the income being paid to the affiliates comes directly from the affiliates themselves? That sort of thing.
I'd be willing to get the ball rolling and put interested parties in contact with each other but between my real life obligations and my responsibilities here I sure as hell couldn't run the thing. But I sure as heck would contribute to some of the pages.
So, is anyone up for ZeekWiki?

It would need to be a moderated wiki for obvious reasons.
It seems like in this "industry" common sense is not all that common!

The latest interaction on Troy's blog...
gen3enz1 asked Troy:
Troy replied:2. RVG failed the howey test badly, has your mind changed on this yet?
3. RVG is not a legit business, have you changed your mind on this yet?
Troy seems to ignore the part about the 1.5% daily compound profit rate being simply made up. Ignore the 800-lb gorilla in the room. "No, that is not an elephant."2. No, my mind has not changed on the Howey Test. I still believe the company was running a legit business, as does the feds. However, I also agree with the feds, and have since day one and we have all talked about it. The RPP needed to be filled with true customer revenues outside of the compensation structure, or eliminated. But the underlying business of penny auctions are legal.
3. Seems like the same question as two. I still believe RVG was running a legit penny auction business with a compensation plan that was flawed. I also believe as I have stated publicly, all penny auctions in the "MLM" space should not be classified direct sales, but direct marketing, because they are manufacturing, private labeling or selling anything they make. There could be an argument, that if the penny auction house is warehousing and shipping products purchased through the auctions, that they are a direct selling. But most are not doing this.
I also stand by the fact, if affiliates were buying bids and using them personally in the auctions, then those purchases would be classified retail volume. However, based on what affiliates stated and the SEC is alleging that did not happen.
Unbelievable. Well, not really based on Troy's denials to date.
I also sent them some information about the saga of the critics. I messaged a few of my friends who also contacted them using their real names on Facebook. I wanted to make sure the critics story was known to them. I noticed a few replies buried in the mass of Pro-zeeksters and .gov-is-evil posts from real people making real sense about the Ponzi.

Just as FYI, I wrote a new hub explaining what happened, and what will happen with ZeekRewards.
ZeekRewards shut down by SEC as $600 Million Ponzi Scheme, What happens now and what should you do?
We had this whine today from Robert "Bigtyme" Smith of 2010blessings infamy...
As well all know that Zeek Rewards is no more. There has been many mixed emotions and great sadness with this development news. Here is an email that was forward to me from a member of Zeek Rewards
"It is with heavy heart that I write to confirm and put to rest any rumors or misinformation that
may be flying across the Net - Zeek is indeed closed by the SEC and is not coming back.
www.sec.gov/news/press/2012/2012-160.htm
This has left many in shock and utter sadness, including me. Zeek absolutely changed the lives
of many for the better. It helped save families' homes, cars, put their kids in college, pay off
credit card debt and so much more.
All Paul Burks wanted to do was create an opportunity for the average person to be able
to succeed with. Paul and the Admin team at Zeek were not out to rip anybody off; it was
the US SEC who took this from us. Zeek was in complete compliance and the SEC simply
told the story the way they wanted to tell it and froze (now in their procession) 265 million
dollars (of OURS). So, who is the thief here? Please keep Paul and the rest of the Zeek
Admin in your thoughts and prayers.
The SEC claims they will redistribute the frozen funds to Zeek affiliates upon completing
their investigation. We have no idea how they will choose to do that or what their formula
will be based on. You can rest assured though that the SEC will soak up plenty of it in
"legal and consulting" fees and "expenses".
There will be so much garbage and rumors running all over the Internet. Please do not waste your timeor energy on it. If you want to stay abreast of what is happening, please follow Troy Dooly over at www.MLMHelpDesk.com He is a straight-shooter and will report the facts. You can also find Troy on Youtube.
As many of you know, this was my full-time income and was the only thing that stopped me from sliding over a financial cliff about two years ago. This news leaves me physically sickened, and feeling even worse for those who were involved and not in profit. I pray for a speedy disbursement of funds from the SEC.
There is nothing more we can do but raise our heads, and move forward to a brighter future. Whether you just joined Zeek last week, or you've been around a year or more with a BIG VIP balance, you joined for a reason.... I encourage you to keep your "WHY" in mind and move forward".
My take on this sounds to me like a "gangster-mafia" style approach. "They" referring to the system just wanted a cut of the pie and allow the owner to walk away and nothing else. I will be doing an in depth analysis on this matter. Please stay tune

Troy was on Tom Chanault's show. You'll need to fast forward a bit, I didn't see a counter but it seemed like Troy came on 15 to 20 minutes in.
He almost maybe but not quite admitted that maybe a small part of ZR could kinda be viewed as a ponzi.
Baby steps folks, baby steps.
And a late edit to add:
I'm not putting this up because Troy (indirectly) asked me to, I made my mind to put it up before he did. There may or may not be someone trading off of Zeek's name and perhaps with the intent of pawning off a tag along scam. You want to piss me off, victimize victims. But perhaps as much as that, I will admit that I want to like Troy and it feels good to post a video by him that I agree with and endorse:
Anyone know who Paul's long time buisness partner "Rodger" might be? I know we'll find out one way or another. ;)

I have scams.wikidot.com that I just started (I'm still in the process of changing the menu a bit), but I could set one up for this project and invite people and help them if they get stuck. Wikidot.com is one of the most powerful sites SEO-wise right now as well.
It might make more sense for someone else to set it up, since I merely pointed people to the Zeek info here and else where. But I can certainly help people understand how to use the Wiki and help with any problems or questions. It's free for up to 5 wikis.
There are also several wikidot.com tutorials on YouTube in addition to wikidot.com's own documentation.
