Additionally, we shall appreciate your modifying your website to eliminate any reference to trademarked or copyrighted text that is in fact not trademarked or copyrighted. In our conversation of October 21, 2005 and again on October 25, 2005, you admitted that MMillionaire Mindset Conference Income Producing System" is not trademarked; however, a review of the site www.advantageconferences.com/vip/income (http://www.advantageconferences.com/vip/income) opportunity. asp on October 26, 2005 shows false statements of trademark and copyright. Please make that change by November 1, 2005.

Finally, please provide a statement as to why Advantage Conferences is not conducting an illegal pyramid scheme. A pyramid promotional scheme Is a plan or operation by which a person gives consideration for the opportunity to receive compensation that is derived primarily from a person's introduction of other persons to participate In the plan or operatio,:", rather than from the sale of a product by a person Introduced into the plan of operation. They were not posted in haste, but based on ten years research of such schemes -which could hardly be classified as haste. And the information on the compensation plan was extracted directly from the web site.

The latter is already done, more than you or your client realize. In fact, it was the obvious potential for widespread victimization that this scheme represents that led me to post the evaluation of Advantage Conferences in the first place. But to save myself hassle, I plan to remove the posting from the site. You and he will find this a hollow victory, for reasons explained below.

4. < If my client hears nothing, it will be forced to assume that your website is another cybercriminal trying to earn money at the public's expense.> (Did you really intend to refer to your client as an "it?")
Now let's see. Who is the criminal in this case? And who is earning money? You certainly don't write threatening letters for your clients pro bono, and your client isn't conducting this scheme out of the goodness of his heart. But I do donate my time to help expose uneconomic schemes such as AC. Please tell your client, who I assume is Tim Darnell, that-

• I am in frequent contact with law enforcement officials in many states. As you know, some states are more vigilant in acting against these schemes than others.

• Due to your threatening letter and to compensate for the loss of the evaluation on my web site, I will redouble my efforts to bring this scam to the direct attention of law enforcement officials and consumer protection officials around the country. I plan to send out a bulletin alerting officials about the AC endless chain scheme, which is about as close to a naked pyramid scheme as any I've seen recently. Neither you nor he can stop me from taking this action, if! choose to do so.

I am double-checking the AC web site to verify all my conclusions re AC. I shall then be forwarding the information to the appropriate consumer protection officials nation wide, as well as the media. It takes time to verify addresses and to identify appropriate officials for this particular type of endless chain recruitment scheme - which it clearly is.

As soon as I complete this process, I plan to remove the posting from the site, and not a moment sooner - so that consumers will have some degree of protection. Law enforcement should ultimately act on this, but often many are victimized before agencies kick in gear.

As some of you know, we applied for Better Business Bureau membership in October of this past year. Their response to us was to take our $375.00 membership fee and post surprisingly erroneous information about our Company. Upon being advised of the posts, we immediately sent the documentation that clearly showed the errors of their posting. To our amazement, they refused to take them down, correct them, or much less apologize for their mistake, establishing a clearly belligerent stance with AC. They offered no contract for enrollment and no explanation of their irresponsible action. We, therefore, are now in the process of litigating against the north Texas chapter (an independent for-profit franchise) on several counts.


Our case is iron-clad and we are well represented. We could use your help, however, and here?s how:



If you have any instances of a Candidate who saw the posting and decided to not continue the 3 Simple Steps, the President?s Interview, or enrollment due to that posting; or if you have a Rep who was intimidated by the posting and decided to pursue other activities, our case will be strengthened by knowing those particulars. Several people have asked about the legal issues mentioned by me in an
e-mail to the field on Sunday evening. I thank you for your interest.

The Company experienced an inaccurate, incorrect posting on a website
almost a year ago by an outside entity. The posting was not only
inaccurate, but also not very helpful to our growth. After multiple
requests for the party to take down the irresponsible statements, especially
in light of the presentment of legal, documented proof of their error, we
were left with no other choice than to seek enforcement of our requests via
the courtroom.

Advantage Conferences is the plaintiff and is not being sued. We expect
full resolution in the next few months. Due to this being a legal issue,
there is not much more I can say in a public venue like this broadcast.

In business, there are always those who would like to see you not
realize the fruits of your labor; in fact, those attacks are inevitable,
especially to a boldly Christ-centered company. We have excellent legal
representation and have been excited and committed to continually meeting
any and all opposition head-on.

Thank you for your prayers - the best antidote to attack is simply
continuing to be successful by providing excellent products and service
to more and more people. I do expect further attacks in the future, but
I've always lived by the simple motto: "a man of integrity, when
questioned, allows time to prove him right". And that it will.

ORDER GRANTING SUMMARY JUDGMENT
On this 25th day of September, 2006, came on for hearing Defendant Better Business Bureau of Metropolitan Dallas, Inc.'s Motion for Summary Judgment ("Motion") filed on August 21, 2006. The Court, having reviewed the Motion, Plaintiffs Response to the Motion, Defendant's Reply, and all timely filed pleadings, and all competent, timely filed summary judgment evidence, and having heard the arguments of counsel, is of the opinion that the Motion should be GRANTED in all respects.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that Defendant Better Business Bureau of Metropolitan Dallas, Inc.'s Motion for Summary Judgment filed on August 21, 2006 is hereby GRANTED in all respects.
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Plaintiff Advantage Conferences, LLC take nothing from Defendant Better Business Bureau of Metropolitan Dallas, Inc. by reason of its action and that Defendant Better Business Bureau of Metropolitan Dallas, Inc. recover from Plaintiff its costs of court, for which let execution issue.

All relief as between Advantage Conferences, LLC and Better Business Bureau of Metropolitan Dallas, Inc. not expressly granted herein is denied.
