yeah i saw that video but was surprised how Lyoness are going so strong today. They apparently sponsor a PGA golf tournament! The Austrian Open in now the Lyoness Open. That doesn't come cheap. and unlike other MLMs they file annual accounts and keep business addresses and take opposition into court. All this lends legitimacy.

Lyoness, cashback loyalty card operator, taken to court by ACCC over allegedly operating a pyramid scheme

THE consumer watchdog is taking a popular loyalty card company to court for allegedly operating a pyramid selling scheme.

Lyoness, an Austrian company founded in 2003, operates a ‘cashback’ scheme which provides rebates to members who shop through a Lyoness portal, use its vouchers or present their Lyoness card at participating retailers.

A number of large brands participate in the Lyoness Loyalty Program, including Vintage Cellars, Overland, Oakley, Microsoft, First Choice Liquor, Liquorland, DealsDirect, Tyrepower and Barbeques Galore.

According to the Australian Competition and Consumer Commission, although Lyoness has been investigated by regulators in other countries, this is the first court action taken against the company alleging that the Lyoness Loyalty Program constitutes a pyramid scheme.

The ACCC also claims the conduct by Lyoness breached laws against ‘referral selling’, where a consumer is induced to buy goods or services by the promise of a commission or rebate contingent on a later event.

WHAT IS A PYRAMID SCHEME?

A pyramid scheme involves existing participants gaining a financial or other benefit from recruiting new members into the scheme.

New participants are in turn encouraged to join largely by the prospect that they will be entitled to benefits relating to the recruitment of further new participants.

Pyramid schemes may offer products and services, but making money out of recruitment is their main aim. The only way for a member to recover money is to convince other people to join up.

This is in contrast to multi-level marketing schemes such as Amway, in which people can earn money by selling genuine products to consumers and not from the recruiting process.

ACCC chairman Rod Sims told news.com.au: “The old days of simple pyramid selling don’t exist anymore, understandably. They’re complex schemes. The judgement we make at a high level is whether your money essentially comes from signing up other people rather than selling something of substance.”

The most recent pyramid scheme to be targeted by the ACCC was accommodation site Jutsen in 2011. In that case, the court determined while the site offered accommodation, the most important inducement was making money by encouraging others to join the scheme, who then had to pay a fee

LYONESS IN THE FIRING LINE

While cashback offers themselves are not prohibited by Australian Consumer Law, the ACCC alleges that the Lyoness scheme also offers commissions to members who recruit new members who make a down payment on future shopping.

According to Mr Sims, Lyoness had around 50,000 members in Australia as of May this year. “Our concern was that this scheme is growing rapidly — by the nature of a pyramid it can,” he said.

The ‘premium’ membership, under which members can participate in what the ACCC claims is the pyramid recruitment side of the scheme, costs $3000.

“$3000 is a good number, but there are all sorts of inducements and a lot of pressure on members to spend more and more money in the scheme,” he said.

Under Australian Consumer Law, it is illegal not only to establish or promote a pyramid scheme, but also to participate in one in any capacity.

Despite this, Mr Sims indicated individual members and the retailers themselves — some of whom had been encouraged to recruit new members — would not be targeted by the ACCC.

The first hearing will be in Sydney on Tuesday 16 September.

Lyoness has been approached for comment.

It was just a matter of time. No surprises here unless you still believe in the tooth fairy. Most of the MLM plans out there are using a broken model, IMO.
If your MLM program is not Product Based and Retail Sales Driven, it will eventually fail or get shut down.

It was just a matter of time. No surprises here unless you still believe in the tooth fairy. Most of the MLM plans out there are using a broken model, IMO.
If your MLM program is not Product Based and Retail Sales Driven, it will eventually fail or get shut down.

Lyoness is based on a shopping service and most of their distributors/customers are happy to use it to get discounts and/or cashback offers. Most of them save money and do not lose and that's what makes the difference between lyoness and other failed MLM models!!!

97.33% of distributors GROSS an average of $24.78 a year. Do anything more than brush your choppers and leave the house the affiliate has lost. Purrty much like any other MLM.

They lied? :shocked: This can't be true. Such an upright, respectful and legal company like Lyoness/Lyconet/CashbackWorld/myWorld (They keep changing their name to confuse the regulators) wouldn't lie. This has to be rogue IMA's that lied.

Wonder how long before the people and merchants from Woking will realize this and demand their money back?

When Lyoness couldn't keep the recruiting going, and all the investigations into them, they changed their name to Lyconet. Then they chose the CashbackWorld name for their loyalty card and now have re-branded themselves as myWolrd.

It's taken me many weeks to get to the bottom of the Cashback World Scam, but this is how I think it operates:

In brief:
Cashback World are buying Giftcards from National Retailers (in particular Love2Shop) at a discount and then re-selling them back to their members at full price. They give a percentage of that profit back to the members through 'cashback' and keep the rest.
Then they pretend that major Retailers are their merchants, so they can entice in the Small/Medium sized business owners, who pay them vast sums (up to £1050) to join.

Finally! A retailer with some back bone! Well Done Tesco's!
This is the message they have sent me today:

'Hi Tara,

Thank you for taking the time to make us aware of this.

To call us a merchant of theirs however could be deemed misleading – as we are not a merchant but an issuer of Tesco gift cards in the relationship.

This will be picked up with them and we'll request that they stop referring to Tesco in that way.

Lyoness SME merchants in Australia are being lured in with free membership which doesn't include the cards.
But then when they join, they have to pay Lyoness $50 a month in fees AND 8% of any sale that is purchased using the card.
I don't know if this is happening in other countries but the SME's in Australia seem oblivious to this racket.

I have two bits of news tonight that I'm hoping are really good:
Firstly Tesco.
I've been in regular contact with Tesco's over the summer and have been telling them all about CashBackWorlds 'business practices' and they've been really helpful and very appreciative of the information. So I'm really, really hoping that this news tonight is permanent?

Lyoness is permanently banned in Norway. The Norwegian Gaming Board has rejected Lyoness’ second appeal, resulting in the Ponzi scheme being permanently banned in Norway. The Gaming Board initially banned Lyoness in Norway in January 2018. Lyoness appealed that decision.

The Gaming Board’s investigation found that the majority of revenue Lyoness generated in Norway was from direct unit investment, as opposed to cashback shopping, as well as commissions and unit returns were also primarily funded by new unit investment. Lyoness recently had to explain, in an Austrian Court, why they weren't a pyramid scheme.
They failed!
The court document is very long but consists of two main conclusions;
1/ The Terms and Conditions could not be read by affiliates in full before they became members, so are unfair and can't be enforced.
2/ The Lyoness member is not an entrepreneur or a business owner but a consumer with consumer rights.
But they also weren't too complimentary about Clouds!

'But the advantages of a simple membership are not attractive, even economical even considered completely uninteresting: The cashback moves in the deep single-digit percentage range and the member is even better served if it is the same negotiate a discount with a dealer of his choice. In addition, the selection of partner companies and their range of products is modest, poor, mostly only local small companies (hairdresser Susi, Gasthaus zum Kirchenwirt etc.). Often the companies don't even know anything of their luck, listed on the Lyoness website as a partner company become. In view of the doubtfulness of the business model, everyone has already agreed well-known companies distanced from Lyoness. On 30th August, 2019 the biggest recruiter of Lyoness in the USA replied to an email from a concerned Lyoness member who was trying to tell him that Lyoness was a scam:

Dont you think it is enough of your ****? Just remeber you are very small piece of **** which can stink for awhile....but everything has end !!! Im sure you understand'
And...
'As I said, you have no balls....and such pervert little dickheads who are jerking off on child porno are always hiding....but you are on the list ��'
And...
'Do not be such bad example to those kids.....you want them to remember you for something good.....so, my suggestion is if you have such huge problem with our business, company etc to simple communicate because only this way we can find solution. All other options will be painfull....Think about it'
