In other words, the "scam site owner" is not liable for what others post. Moreover, since this is a federal statute, it preempts any state law to the contrary.

Perhaps you should be careful what you promote and put online. You might also be surprised by what constitutes public record!

A few words about U.S. law:

(1) There is nothing unlawful about reposting information about you that you yourself made public. If you wish to guard your privacy, you should, well, guard your privacy.

(2) Even if there were, a site such as this one is not responsible for what people post on it. As Soapboxmom correctly wrote, that's 47 USC § 230.

(3) There is commentary in this thread about something that actually is illegal: "cash gifting". It's nothing more than an electronic chain letter, illegal everywhere in the U.S. The fact that there are a lot of these things floating around doesn't prove they're legal, it just proves that law enforcement has higher priorities. If you pick a day and go to Jackson, do you think you could find a three-card monte game or twenty?

The best thing that you can do is to stop this cash gifting folly. Eagle has a chapter in his book which explains the way that cash gifters obey instructions to wrap their bank notes in black paper and go to great lengths to avoid postal scanners. You may have been a bit of a "silly moo" to have not realized that this was decidedly dodgy but you got caught The best thing is to stop cash gifting immediately and admit being utterly naive.

People will respect you if you warn other people what happens to those who get caught and stop moaning. If you were just being a naive silly moo, it is better to admit it and learn from some of the very well informed people here like Eagle, SBM and "wserra."

It is far better to be caught doing something stupid than to be caught evading postal scanners with wads of cash!
