Pro sun model was perfect, allegedly he has been in business for 4 years thus tweeking it and accumulating clients which is very believable and would go along with improving his business model to include outside participants to contribute their resources for a benefit!! On the Zeekler deal Nancy Frazer still tells the ppl who lost money that Zeekler was shut down because some parents of college students complained and got it shut down. She also says that North Carolina decided Zeekler wasn't a Ponzi and that they are suing and starting back up.

We were very excited to learn this week that the ProSun website domain was purchased by someone in China. We believe that this person / business might be one of Roman's customers.

New Bank:
... Due to the increasing problems with the Czechoslovakia bank, Roman's Chinese client is helping Roman move to a Hong Kong bank.
Roman is working on a debit card and a e-checking system to facilitate withdrawals.
We understand that only bank wires might be allowed for withdrawals.

Servers:
He and told us that he was going to be upgrading, since our old servers were totally maxed out.
Roman moved the servers to Hong Kong in order to protect us and ProSun.
The servers are safe, and our data is safe.
The 36 - 48 hours sent out by a support person referred to 8-hour business days.
We expect the servers to be up and running very soon.

RULING
Application under Rule 12(1) of the Supreme Court (Supervisory Jurisdiction over Subordinate Courts, Tribunals and Adjudicating Authority) Rules

This Application was entered on 16th March, 2010.

The Petitioner is an employee of Lotus Holding Company Limited, a company incorporated under the Companies Act, 1972, of Seychelles, (hereinafter "Lotus Holding"), which carries on business as an international corporate service provider (hereinafter "ICSP") under the International Corporate Service Providers Act (hereinafter "ICSP Act"). An ICSP provides international corporate services, i.e. renders services connected with the formation, management or administration of a specified entity as defined in the ICSP Act.
The Respondent is a body corporate established under the Seychelles International Business Authority Act, 1994.

Lotus Holding, as an ICSP, and its employees are regulated by the Respondent in terms of the ICSP Act.

The Respondent has originally determined the Petitioner to be a "fit and proper person" under the ICSP Act.

By letter of 15th January, 2010, addressed to Lotus Holding the Respondent removed the Petitioner's "fit and proper" status under the ICSP Act. Prior to the issue of that letter, the Respondent's had on 12th January, 2010, addressed a letter to the Petitioner requesting her to clarify her position and that of Lotus Holding vis-a-vis the content of a series of publications within the public domain which appear to relate to the Petitioner's directorships on a number of companies.

On 14th January, 2010, Lotus Holding replied to the Respondent's letter of 12th January, 2010, stating the position of the Petitioner and Lotus Holding.

The presence of the Petitioner at the Office of the Respondent was initiated by a verbal request by Officer(s) of the Respondent inviting the Petitioner for a friendly chat. The Respondent's Officers and the Petitioner met on the 14th January, 2010, to discuss the said publications.
The publications referred to by the Respondent in its letter of 12 January, 2010, to the Petitioner, relates to articles published in the Dominion Post, a newspaper published in New Zealand, in relation to SP Trading, a New Zealand company which was allegedly involved in an arms scandal. In that article the Petitioner was obiter referred to as a person who holds the directorship in 338 companies incorporated in New Zealand.

In matters that come before this Court for Judicial Review, this Court is not concerned so much as to what decision the adjudicating authority took but, how the decision was reached. It is the process of the decision-making which is therefore reviewed.
In this instant matter, having had the benefit of reviewing and comparing the contents of the Affidavits of the parties and having heard the submissions made by Learned Counsel of the respective parties, I will now proceed to make my findings and determination.

I find that the Respondent's decision in removing the "fit and proper7' status of the Petitioner was procedurally improper and that finding is for good reasons including the following: -

1. The Petitioner was not given an opportunity to be heard or allowed sufficient time to prepare herself to respond to any complaint in that the Petitioner was requested by the Respondent to attend a meeting at extremely short notice called for the same day.
2.The Petitioner was not given a full opportunity to be heard and to defend herself against any complaint regarding the discharge of her duties as an employee of Lotus Holding.
3.The Respondent failed to form any complaint regarding the Petitioner's performance as an employee of Lotus Holding.
4.The Respondent took irrelevant matters and incorrect facts or baseless allegations into considerations to arrive at its decisions specially that the Petitioner was associated with SP Trading, when no such association exists and was proven.
The Respondent failed to conduct a thorough inspection of Lotus Holding's control systems and procedures, as required by law, before removing the Petitioner's fit and proper status.
2.If after the meeting the Respondent was of the opinion that Lotus Holding's control systems and procedures were deficient the Respondent should have conducted an investigation or make a formal complaint to the Petitioner or Lotus Holding, which would have been replied thereto.

I also find that the Respondent's decision in removing the "fit and proper" status of the Petitioner was unreasonable and that finding is for good reasons including the following: -
1. The decision of the Respondent is based on an article published in a New Zealand newspaper which incorrectly and without any proof linked the Petitioner with SP Trading a company involved in an alleged arms scandal.
2. The decision of the Respondent was also based on the facts that the Petitioner is a director of several companies incorporated in New Zealand which are have not been shown to be either subject to the ICSP Act and any other laws, or is an illegal act in New Zealand.
3. The Respondent had no cogent evidence that the Petitioner has committed any wrong doing to warrant her removal of fit and proper status, or that she is not a fit and proper person under the ICSP Act, or still, that she is unfit or has become unfit as a result of the finding that the Petitioner is the director of several companies or that renders her unfit or unable to discharge her duties as a member of staff of Lotus Holding for the latter to provide international corporate services under the ICSP Act.
4. The Respondent had no cogent evidence that the Petitioner being a director of several companies in New Zealand has contravened the laws of New Zealand or that of any other country (including Seychelles) and if she has, the Respondent has failed to substantiate such; or that Lotus Holding' clients' interest are threatened; or the Petitioner is unable to manage and administer the companies.
5. The Respondent conceded that the petitioner is possibly not the only fit and proper person under the ICSP Act who holds directorship in such number of companies in that if it is illegal or improper for a fit and proper person under the ICSP Act to be a director on any specific number of companies the Respondent as a regulator should have requested that every such person declare the number of directorship or run an obligatory questionnaire for all ICSP in this respect.
6. The principal facts on which the Respondent based its decision to remove the Petitioner's fit and proper status, are not necessarily facts that the Respondent as the Authority under the ICSP Act acting reasonably and judiciously could have reached.
7. The Respondent had no cogent evidence or any finding that Lotus Holding has contravened the ICSP Act for the Respondent to remove the Petitioner's fit and proper status.
8. The Respondent took into consideration irrelevant consideration and incorrect or unsupported allegations to arrive at its decisions specially that the Petitioner is associated with SP Trading, when in fact it could not be shown that the Petitioner had any relationship whatsoever or at all with SP Trading. At best, she was referred to in the article to show how New Zealand law permits one person to be a director in several companies (which has an open registry as opposed to a closed registry like the Seychelles' registry).

9. The Petitioner's failure to state at the meeting the exact number of companies on which she is a director ought not to have warranted the removal of the Petitioner's fit and proper status, for reasons earlier stated above in the light of how the meeting was convened.

10.The conclusions arrived by the Respondent regarding the Petitioner's inability and incompetence to manage and administer the companies of which she is a director are unsupported by reasonable evidence and were not subject to any thorough investigation.

I further find that the Respondent's decision in removing the "fit and proper" status of the Petitioner was illegal, and that finding is for good reasons including the following: -

1. The Petitioner has not contravened any of the provisions of the ICSP Act especially the provisions set out in the Code of Practice for Licensees under the ICSP Act.
2. It is not illegal in Seychelles or outside Seychelles for any person to be a director of any number of companies otherwise the relevant laws or the Respondent as the regulator would have set out a specific number.
3. The Respondent failed to conduct a thorough inspection of Lotus Holding's control systems and procedures, as required by law, before removing the Petitioner's fit and proper status.
4. In any event there was no finding that Lotus Holding has contravened the ICSP Act for the Respondent to remove the Petitioner's fit and proper status.
5. The Respondent's decision has no legal basis.

I find that the Petitioner made this Application in good faith and that she has sufficient interest in the matter as the decision of the Respondent has been made against the Petitioner and her status under the ICSP Act and, in my view she is substantially aggrieved by it.

On the basis of my findings enumerated above, it is my judgment that a Writ of Certiorari ought to be issued in the circumstances of this case. I accordingly issue forthwith a Writ of Certiorari quashing the decision of the Respondent to remove the status of the Petitioner as "fit and proper" under the ICSP Act.

I award cost o the Petitioner.

We were very excited to learn this week that the ProSun website domain was purchased by someone in China. We believe that this person / business might be one of Roman's customers.

New Bank:
... Due to the increasing problems with the Czechoslovakia bank, Roman's Chinese client is helping Roman move to a Hong Kong bank.
Roman is working on a debit card and a e-checking system to facilitate withdrawals.
We understand that only bank wires might be allowed for withdrawals.

Servers:
He and told us that he was going to be upgrading, since our old servers were totally maxed out.
Roman moved the servers to Hong Kong in order to protect us and ProSun.
The servers are safe, and our data is safe.
The 36 - 48 hours sent out by a support person referred to 8-hour business days.
We expect the servers to be up and running very soon.
One leader recently posted that the servers would be up late Sunday night, but we have not been able to verify that with Roman.

New Website:
We understand that the current programs in place will remain the same.
Roman plans to introduce new programs after the Easter Gift has been issued.
We heard this afternoon that the website release has been delayed a bit because Roman is address several security issues from the original website: 1) Hackers can easily reset your passwords; 2) you all of a sudden cannot log in; 3) no double opt-in for secret words, 4) no second confirmation for email address etc.
We believe that Roman will protect our Available cash.
Double opt ins when you sign up.
Possible new name and different business structure.
We may or may not have daily benefits accruing during down time. We truly believe that the daily benefits have been calculated.

I just dropped by the Jim Paris blog to see what the believer's are up to, and can't believe they are wanting to argue that Roman was doing bridge loans/hard money lending. There were several ponzis back in late 2008 that used the "global banking crisis" as an excuse to close up shop. Then the swiss banking crack down....... They missed an opportunity here with the mess in Cyprus. There is always something going on around the globe that can be used as an excuse. I never even thought about this until you brought it up. I need to think more like a criminal and liar.

I don't think I can productively respond to the hedge fund issue but I don't for a moment buy the notion that Nanci Jo was duped. This is no fewer than her third ride on the ponzi pony, what ever innocence she may once have had vanished many referral commissions ago. She claims to be some amazing business woman with massive success after massive success to her credit. She also has a husband who's a banker esteemed enough to chair the local chamber of commerce. That isn't to mention the overwhelming likelihood that she herself has participated on this forum (http://www.realscam.com/f10/zeek-members-again-targeted-1586/#post32029). No, for her to claim that she's been duped by Roman she'd almost have to plead insanity.

That being said she clearly made some very novice mistakes. For one thing she let her group grow beyond her ability to moderate it. She also never crafted an exit strategy. The thing is both of those issues could have been combined. She didn't recognize, or at least admit that the birth of the "long haul program" was the first sign of the inevitable collapse. She should have promoted it the way she did but then instead of trying to fight us, use us. As more negative attention started to accumulate she could have used it as a reason to close her group. "No new signups till we see were this is going." That would have cost her a little money but it would have made her more credible, more realistic. At some point she should have used her (makes that sticking his fingers down his throat and gagging sound) "Christian Principles" to explain why it was worth sacrificing the upline commission on compounding to make sure the downline got their investment back. Then when the North Carolina C&D came out explain to her entire group her questions about Roman's commitment to Christ and implored everyone to cash out as fast as they could.

If she'd done all that she'd have an organization to whore out to the next program. Instead she made herself Roman's spokes model and I'm glad that she'll pay the price for that mistake. She did more than anyone to convince people that Roman Novak was a gift from God and all she has left is a cell phone number that never picks up and the smell of sulfur, that and a butt load of money she can only hope no one sues her out of.

Don't think for a minute Nanci Jo didn't know any better, this was hardly her first rodeo. I have seen her own postings about Zeek and a few other scams, all promoted through her FUMI website, she's a holy roller Ken Russo in a skirt as far as I can tell.

Another interesting little tidbit from the FUMI website is a very prominent disclaimer about the "president and board members" not getting any proceeds of the donations, but if you look carefully at the positions mentioned, and then at the positions Nanci Jo holds, you'll notice that the two never intersect. Go have a look, and tell me if I'm wrong.... and still, has anyone found anything to indicate that in spite of 20 odd mentions on the FUMI website that they are a 501(3)C charitable tax exempt organization that they are in fact one and not just flat out lying? Or posting another organization's EIN, now taken down?
If you spend a bit looking back at Nanci Jo there are a lot of pictures from cruises and overseas trips and I have to wonder how many of them paid for by some arm or another of FUMI (you can have a board meeting on a boat, after all, when I owned a company I didn't have much trouble arranging meetings in places where I was pretty much on vacation and taking a partial tax deduction for the trip. (mind you I was still using my own money, or my company's money and not "donations")

And another damn thing that I find curious, there are several mentions on FUMI about not getting a voucher or receipt for donations of less than $250 AND the donation buttons are all for amounts less than that. Does that look to anyone else like trying to avoid leaving a paper trail or is it just me?

As I was going to turn in I read your post and wanted to put a little food thought out there. Not that it is a knowable answer, just pure speculation on my part. When I say she was duped, I don't want to imply she is innocent or a hapless victim. However, when I clicked your link and read CadioBeam's posts I am taking them to be from NJF. I would buy that because like her member updates they are unorganized and almost cut and paste. It could be a ruse, but her writing comes across of that of a complete idiot, not a planner. And I mean that in a nice way. Her explanations of Roman, a seeming lack of understanding of even basic laws, and as you say a rather unplanned exit strategy make me wonder. Her calls with the Roman just further heighten my suspicion, just the way she reports them back she is leaving herself wide open to legal action.

There is no doubt that she can attract a following and raise cash, but the calls to Roman and subsequent messaging to her flock seem almost childlike. I am left wondering if perhaps her husband or someone behind her is not pulling the strings? On the other hand, there are surely some arrogant criminals out there that think they will never be caught. I remember reading about Wade Cook laughing through his whole trial, until they read the verdict.

Every once in a while I have to post the maths, just to show how crazy these schemes are.
I use an investment of $100,000, not because I think anyone would put in that much, but surely we can all agree that there is a group of people, a rather small group, that all of their investments added up would total that, and for the sake of the maths, it's the same thing, the only other assumption we need make is on the time scale....so here we go...

Investment scams you can find on the internet promise returns of 2% a day. Think hard about this for a minute. Checking your math: A 2% increase is a multiplier of 1.02, so a 2% increase for 1,825 days is a multiplier of 1.021825, or 4,958,079,264,200,877.85, rounded a bit. Shift the unrounded value left by five digits to represent the initial investment of 100 grand, and we get $495,807,926,420,087,785,122 and 80.2 cents. That's nearly 500 quintillion dollars in the U.S., about 270 million billion pounds, around 389 quintillion Euros or nearly 53 sextillion yen.

A $100 thousand initial investment becomes larger than the estimated GWP after just 1,013 days, or two years and nine months or so. And it would pass the 2005 budgeted Federal spending for the U.S. after just 857 days, or two years and about four months.

No matter what the initial investment, at 2% per day it would double every 36 days. Well, slightly more than double, as 1.0236 is real close to 2.04. So, if a person were to initially invest just a thousand bucks, the above calculations on $100,000 would become true after less than seven 36-day periods go by (in other words, at 2%, $1,000 becomes $100,921.55 in 233 days). As a condition of their EU bail out deal they are beginning to, but only on accounts above a certain size. Up until this point they had been a popular destination (http://www.marketplace.org/topics/world/european-debt-crisis/where-will-money-launderers-turn-after-cyprus) for money laundering and by complete coincidence a significant number of Russian depositors are unhappy about the new policies. In this context it's amusing to note that of the three or four company names in the Czech Republic that processed bank wires for Profitable Sunrise that I was aware of, all of them listed Russian citizens as principles. Hell, it really is possible that a percentage of Pro Sun investor's money will go to refinance Cypriot bank debt.

And while I can't blame PS for not having a crystal ball to see how the Cyprus situation would play out it would have been a token of genius if they had used the banking situation as a cover story, enough so that I almost expect them to retcon their lies. In addition to the "hair cut" large deposits will take there are some pretty funky new regulations on how much money can be withdrawn and under what circumstances. I don't think PS will turn the lights back on but these new regs could make a perfect excuse for slow and selective pay all while pretending they wanted to give everyone their Easter Present as promised. (that loud Slap you just heard was Roman's palm striking his forehead)

High priced motivational training, and if you are lucky enough to have some extra cash they will mark up a "turn key property" and bilk you for whatever you have in you wallet.

Wherever we all are in the spectrum of possibilities, we're all in the same boat together. Are we praying that Roman gives us good news about Profitable Sunrise on Monday? Sure! Do we know for sure he will? No. Nanci does not have official word from Roman and therefore we can't and won't make statements or assurances that aren't based on fact. Do we see positive signs of IT activity that suggest that Roman is working behind the scenes on our behalf? Absolutely. Are we defending Roman? No. Roman is accountable for his own actions.

In the midst of all the uncertainty, remember that in God's perfect, loving plan, every day since the unexpected news from North Carolina on February 27 has already been planned from eternity, including Monday. The truth is, none of us can control tomorrow, so why let tomorrow control us through worry?

I have a long way to go, but I've begun to learn in my life journey that worries, especially over money, can enslave, destroy, control and ruin. Matthew 6:24 says "No one can serve two masters. Either you will hate the one and love the other, or you will be devoted to the one and despise the other. You cannot serve both God and money." It really comes down to realizing we can't control much of anything, except our choice of Who we will place our trust and faith in and Who we will serve.

Worry is self-serving. Instead, we ask you to follow us and join Joshua who said (in the midst of facing giants) -- "As for me and my house, we will serve the Lord!" (Joshua 24:15) Why? Because only GOD can control everything. And He is the same Lord who said He came that we might have life, and have it to the full (John 10:10) .... THAT's what Easter is all about, and Monday too!!

God's Word says "Do not worry about tomorrow..." (Matthew 6:34) May God help us to surrender our worry, and be hopeful and positive not because something good with ProSun might happen on Monday, but because God is in control, and His good and perfect plan will be accomplished.

I see between this email and the Good Friday conference call he's making a very large point that his services to NJF Global were as an unpaid volunteer. Perhaps it makes him feel better (or less bad) that he wasn't being paid to lie to all the good Christian people he helped Nacni Jo rope in. I would very much like to see what his personal downline looked like, he might not have taken money from the NJF Global group or FocusUp Ministries but I'm willing to bet he cleaned up on referral commissions. Pastor Nanci and Reverend Jon are civilly liable for the representations they made about this investment. They took great pains to assure you all how safe this was and the people who believed them and took action upon those beliefs are now the ones in great pain. Pastor Nanci and Reverend Jon also made a whole lot of money by delivering your money to Roman (referral commissions) and while you all are still praying for your Easter Gift they're already gearing up to promote their next great passive income opportunity. They've already moved on and I'm sorry to say their victims will have to as well but there isn't a single reason that all their victims have to move on without at least a partial refund.

Assemble as many victims as possible, maybe kick in the small sum it would take to register a website, something like NJFGlobalVictimsUnite dot com to get the message out past your email lists. Unite together and hire a qualified law firm to file a civil suit on a class action basis against NJF Global and all it's leaders. I'm not an attorney and I'm not giving a legal opinion but if a legal team representing the NJF victims gets in touch with us we can provide all the documentation needed to prove NJF's culpability.

I do want to make one thing plain, even if this were made to happen people shouldn't expect a 100% refund for what they lost. SO let's say Nanci Jo has half of them as direct referrals and she got the 5% commission on that, and just for giggles, let's suppose she put in $10 of her own money so as not to be too greedy. That's $275,000 Nanci Jo made, not counting the earning on her $10. And someone else made another $275K too. That's just the direct referrals, this scam paid down four layers, but I don't want to even bother, suffice to say, Nanci Jo, if she was smart enough to pull her money out, made some serious bank on this one. A screenshot earlier showed her with a $6,000 balance in her account, which is not to be confused with how much she had made, that's just what she hadn't pulled out by then.

Going by the numbers in the Ohio C&D Nanci Jo's "organization" included better than 71,000 members who had invested more than a combined 33 million. She didn't get 5% on all of that but she and her NJF Global group were the largest organization in the program and if she didn't have a side deal with "Roman" she'd have been leaving money on the table. It's good that she's been playing 501(c)(3) games with the IRS, it will encourage them to take an endoscopic view of her finances. And the fact that it'll be the better part of five years before she can file of bankruptcy again only ups the ante on any future settlement.

It does seem unusual that Nanci Jo while not a respondent does bear such scrutiny in the Ohio C&D, why it almost seems that the local powers that be might suspect that Roman Novak is nothing but an apparition, a second cousin to Harvey the Rabbit. And while it is difficult to prosecute a case against someone who isn't there and who may well not exist in the first place it is easy to prove, with her own words that no one in the USA has done more to make Profitable Sunrise the massive success it is today than Ohio's own Nanci Jo Frazer.

You were the BEST Nanci, never forget that. No one was better than you at convincing people to send money through a maze of shell companies in multiple foreign countries in a manner that ensures they can never get it back. I would also point out that the Ohio document goes to great pains to describe the activities of Nanci Jo Frazer and Focusup Minitries, Inc., but strangely doesn't name either of them as respondents. Kind of makes you wonder if another, possibly sealed, document deals with Nanci Jo and her fake charity.

That second call link was new to me, I'd heard the Dave Steckel call from the same day but not Nanci Jo's preyer meeting. The first 27 minutes is nothing but the Pharisees blessing the money changers but after that we learn that anyone who condemns Roman is doing the Devil's work. Our problem is twofold, first we are in no way injured by Nanci Jo's promotion of ProSun and even if we had tossed a ten spot on her referral link we, just like she did, knew this was a ponzi scheme from the get go. We're not aggrieved parties. However, among the 70,000+ people who joined Pastor Nanci Jo Frazer's downline organization there are, I'm sad to say a great number of people who trusted her and lost money for having done so.

What can we do? We can make sure those people understand that they have legal recourse. Nanci, as of at least last (Good) Friday was still telling people what an honest, Christian man Roman Novak is, she has never stopped telling people what an honest Christian person she is and with so much honesty and Christianity dripping from every one of her ProSun recruiting calls well it's enough to make people wonder how Satan had the nerve to get the Securities regulators from so many US states, Canadian provinces and foreign nations to speak ill of Saint Roman (but I'm pretty sure that Nanci thinks Jim Paris is on Satan's speed dial).

The answer is simple, if not easy. If enough of the people who got suckered by Nanci's good looks and false faith join together in a class action lawsuit they can make sure that Nanci Jo will not do to anyone else that which she did to them. And they can get some of their money back, sorta like a bonus. All we can do is offer the rather amazing amount of evidence we have to assist any legal team hired to help those victims and it goes without saying that we'll do that free of charge. Nancy Frazer is not really a pastor. She has taken online courses from Vision Christian Bible College and Seminary in Florida in 2011-2013. As far as I know she has never graduated or received even a certificate of completion.

In the early 2000s she was into various MLMs. Around 2009-2011 she was working on two new ideas, taking her MLMs global and getting it into the Christian community. She started working with the Latino community with her ministry and of course they needed to prosper so she signed them up in her MLMs. The Charity/Christian aspect enhanced her MLM activities. Fast forward to the Ponzis (Zeekler, Profitable Sunrise and a couple of others), She promoted the Ponzis just like she did the MLMs.

It always makes me hesitate a moment to see her called a pastor because of what I know.

Hmm, it seems some of the players are starting to turn on each other. I got offered all the information on Tony Infante from a poster on the Jim Paris blog if I would pay this person $500. The claim was this person was not going down alone. Rather odd wording for someone to use when all the major group pimps are still telling their people everything is going to be all right and that Roman willl come through eventually, they just don't know when. And of course pimping their next Ponzi de Jour that will get any money they lost in PS back and make them even more money.

There was this nonsense that Roman had money in the Cypress banks, and that's why everything has been delayed. Or at least that is what someone told me who was on the call. It was also reported on the Jim Paris blog today that the Czech bank and the Australian bank where Roman had money the accounts have been frozen for possible fraud. So it seems the federal authorities are now involved too.

This story has been going around for over a week now, and it is nothing more than smoke and mirrors to keep all the members from these major groups from going en masse to the authorities filing complaints. This is the last thing that Nanci Jo, Tony Infante, John Shepcoff, Owen Brown, and Chris Lombardi want happening right now. Not only is it bad for business to get people in their latest Ponzi de Jour, but it also could mean serious problems with law enforcement. This is just CYA to hopefully negate any of that from happening.

While sad, it is no different than in any other Ponzi that goes down, whether by the feds or the admin runs with the money like Roman has. ASD, Zeek Rewards, NewGNI, CashTanker, Megalido, PTVPartner, GNI, PIPS, GIN, PlexPay, FLO, you get the picture. They pretty much all say the same things. Straight from the Ponzi playbook.

So far they have not even come close to what happened after ASD was shut down by the feds. They took idiocity to a whole new level. Heck there are still people who were in ASD that think it was legal and the feds only wanted the money. This after the first round of remission payments were made to those who filed a claim and they received 100% of their money back. Now a second round of remission payments will be made and they will still say ASD was legal and the government was evil.

As GlimDropper pointed out a few posts ago, the script that Roman Novak used is the same one being used by other HYIP's, and he believes it's part of stock HYIP software. If that's the case, then everyone should stop referring to Roman Novak as if he were a real person. It is probable that some made up names were just plugged into the off-the-shelf software. Who would use their real names anyway? Even the good people on this website refer to him in real terms. There is no Roman Novak, it's more likely a made up name. He doesn't exist. And the people behind this scam are untraceable, and unidentifyable - totally anonomous in Eastern Europe or deep in Russia somewhere, untouchable by the US Feds.

There were no securities being sold. The SEC and Justice dept did their investigation and found no Securities. People, The reason zeek got attack was for one reason. Not that they were doing anything illegal which they weren't. What happened was Zeek grew so big and so fast and was a great opportunity for people that once people saw what it was all about they began pulling their funds from their banks over to Zeek. It was the big bank institutions that got on the horn with the SEC and Justice dept and made false accusations as ZEEK became a huge competition for peoples money. People have to stop going by hearsay, DO you know that when the SEC filed their complaint to the judge and got an order expedited to cease & desist they never told the judge the money came from the penny auction, the penny auction was never mentioned in the filings. When zeek was stopped by the government the government put a gag order on Paul Burks and he or any of the top managers of zeek were not able to talk about the company to anyone , they were told they would be put away a very long time. Even if Paul wanted to prove his innocents they would throw him in jail. I believe the very same thing can be going on here. People... it is and always will be politics that's in the way. If the Gov wanted to serve each and every one of you a subpoena and accuse you of funding terrorism all because you are sending funds across seas they will and can. There are multiple cases where this has happened and is happening. You are guilty until proven innocent when fighting the gov. 90% of the crap we hear on blogs in cases like this are BS. Why is Paul Burks not in prison if he was such a criminal ??? As long as he keeps his mouth such he keeps his freedom. Roman Novak officially announced prior to March 22, 2013 that the website release had been delayed a bit to address several security issues from hackers. This coincides with the data presented below.

It is also noteworthy that the servers went offline and showed a change to DNS and MX records about the same timeframe as major institutions worldwide (mostly financial) suffered DDoS Cyber Attacks. DDoS stands for "distributed denial-of-serve", and is a Cyber attack intended to overload and crash servers.

Also noteworthy is that Spamhaus, a spam-prevention service based in Europe and victim of the DDoS was a service used by Profitable Sunrise, and that one of the banks we were wiring deposits to was located in Europe specifically in the Czech Republic.

So, while these observations are not a representation of fact as to why Profitable Sunrise website is offline currently or why Roman Novak hasn't provided more responsive updates, it is still important for us to consider the timing of all this because I have members in my downline who have continued to receive payouts that were not processed as quickly as would have typically occurred, and they have continued to receive processed withdrawals days after the website went down.

I personally choose to take all this in consideration, take the high road, and hope for the best. On the other hand, I like you anxiously await an official status update.

It is our prayers, not worries and suspicions, that are needed right now!

It will be interesting to see how the SEC case plays out, I'm fairly certain no "Roman Novak" will be deposed but we will learn the names of some of the people behind the companies that did receive the money. The facebook pages had been chattering about bank accounts being seized and I had been pretty agnostic about that info but now it seems more likely. The press release intheknow posted mentions that in addition to the Czech Republic, bank accounts in Hungary, Latvia, China among other places held Pro Sun money. I wonder how good "Roman" was at money laundering.

Now that the end for Profitable Sunrise is for certain with the recent SEC order, I feel that all members who were "invited" into Profitable Sunrise and lost their investment should come together and attempt to recover lost funds. This can be done through the judicial system, both criminally and civilly. Instead of all of us who are out money going our own separate ways to recoup our funds, we need one point of contact to organize all of our information (how we came into Profitable Sunrise, who our upline is, who our group leader is, how much did we invest, in what program did we invest (private plane, long haul, or combination, and how much we lost, what banks or payment processors did our funds go to, etc..). We need this information to go to one source who can then mediate our information to various law enforcement agencies to begin the criminal investigation. We then need to consult with one law firm who specializes in fraud/ponzi schemes for civil action. The more organized we get, the better our chances of getting something done and recover some of our funds.

In my situation, I decided to get into Profitable Sunrise under John Schepcoff and joined in February. I noticed he stopped deleting my posts when I stopped saying anything about suing uplines or anything about the ponzi industry writ large. He had to let people bitch about Profitable Sunrise, that's only realistic. But anything which might keep folks from joining his next scam, that he couldn't allow.

First, we'll find that PS Team Leaders have in fact not had any personal contact with "Roman Novak" and all the "heard it direct from Roman" cheerleading was made up from whole cloth. None of the know anymore about the person who called himself the leader than we do.

Second, as much as I want Nanci Jo to be in a lot of trouble (she still is), I think we're going to find out that her and the other "Team Leaders" we're stuffing their bra in regards to their downline. Sorry, but the "it's safe from interference because it's all overseas" people are wrong about it being safe but the chances of any of the money coming back when you sent it to Eastern Europe are pretty slim.

One of the major pimps will have not taken out more than a token amount in the grand scheme of things. I dunno why, but every time, there's always one who had a balance on screen of millions who had only withdrawn hundreds or a few thousand. Even Faith Sloan and Ken Russo got burned that way (on the same scam no less). There is also going to be at least on major pimp who got a purported business background to convince them, something as plausible as the new Oscar Meyer Flying Bacon and Ham Hocks, and they actually believed it because even though "the industry" puts them forward as some great business expert they in fact know very little about business. For the last year I've called it the "Troy Dooley" effect. That man has done more damage to victims than most admins and pimps because he's respected for his business knowledge, which amounts to being able to use a few big words in a sentence and convince the rubes he knows more about business than my dog. He doesn't.

And this last one I'm going to regret and hope I'm proved wrong on, but I've been burned saying otherwise so many times, I've lost the faith. None of the big pimps is going to get in much trouble. They may have some disgorged profits, may have some civil fines. They'll pay these as quietly as they can (not good for the downline to find out the last "best program I've ever seen" you ended up paying the SEC a few million for) and move onto "the best program I've ever seen". We have finally seen a few of the people running the programs in orange jumpsuits, but some of them have even walked away with Charis Johnson and friends. But not once have we seen the big serial promoters, people who each have led to more theft than any of the so far caught admins, face even a misdemeanor charge. And it infuriates me. You lock up Andy Bowdion and within months you're shutting down Paul Burkes. Zeek goes down and the pimps take their downline over to ProSun, Banners Brokers is running right out in the open and when the Canadian Government finally shuts them down, we'll have another one. And what they all have in common is Ken Russo, Faith Sloan, and, hell it's tired and I'm sick and I can't think of the regular cast but we all know who I'm talking about. The day they get perp walked into a federal courthouse, and not just one of them but a whole paddy wagon full, will do more to stop the online fraud game, at least in North America, than closing down and prosecuting the whole front page of programs on TalkGold or MoneyMakerGroup.

Some people have FINALLY gone to jail, and that's a good thing, but it's time for trials with pimps trying to cut deals by testifying against each other, a series of trials that involve dozens of ref whores on RICO charges. The law hasn't kept pace with technology. 20 years ago the cost and lack of reach that direct mail, hotel seminars and face to face contact were able to provide posed a natural check on a scams growth. Websites, email and social networking drop that cost through the floor and drive that reach around the world. Only idiots rob you with a gun these days, a keyboard is a far superior criminal tool. The law needs to catch up if they want to keep pace.

That will happen, if not soon. Am I an optimist? Hell no, it's just that the collective economic losses these things cause are great enough to spur eventual action and unlike many somewhat organized less than mutually positive legislative issues there really isn't a pro ponzi political lobbing group to grease the palms of our honest and honorable public servants. The less than fully competent regulatory response to these crimes is born more of ignorance than of kickbacks campaign contributions.

Part of the issue is, of course, human nature. People who think they just found a perpetual motion money making machine will crow it from the roof tops but the people who found out the hard way that "there ain't no such thing as a free lunch" seldom talk about how much money learning that lesson cost them. But those victims aren't alone, they're not even close to being alone. At the present they just aren't close to being aware or organized. The math isn't on the scammers side, with each new scheme defrauding 80 to 90% of it's participants through their very actions they're breeding more victims than players. One of these days the fluid mass will become saturated with enough victims that a simple tap on the glass will trigger a crystal formation. When it does there will be enough of a reason for lawmakers to more fully examine this issue.

That wont happen today or tomorrow or perhaps soon. But the one good thing about human nature is that we eventually do the right thing, after we've exhausted a whole hell of a lot of the other options.

Just look at ladym12 on MMG forum. Talk about jumping from one ponzi to the next. She continues to state she is done putting money into these scams, but she continues to do it.

For those of you who may have been enticed to "step up to the plate" and "invest" a boatload of money into Profitable Sunrise - now that the SEC has gotten involved on the civil side of things and likely criminal charges will be levied on the major promoters and group leaders (i.e. John Schepcoff and Nanci Frazer), just wanted to share that there may be IRS tax relief in the form of ponzi theft loss. Please educate yourself with: Ponzi Scheme Tax Loss (http://www.PonziSchemeTaxLoss.com). The attorney is Richard S. Lehman. It sounds like if criminal charges are brought (just a criminal compliant filed will suffice) the IRS provides "administrative ease" (i.e. no questions asked) when reporting your ponzi losses. This is just another avenue to pursue while we wait for the civil lawsuits and our rights to claim our share of the fruit.
