That passenger should not have had to stand. The late boarding obese passenger should have been made to wait for a flight that could accommodate them. Not being seated and buckled is a safety concern. Inexcusable!

That the airline admits the fault but refuses to correct it is pathetic. The guy should have parked in the 1st class washroom and told them they could have it back when they provided viable seating.

Upon a further look, it could be argued that the airline was in violation of Federal Air Regs:


Sec. 121.311 — Seats, safety belts, and shoulder harnesses.

(a) No person may operate an airplane unless there are available during the takeoff, en route flight, and landing—
(1) An approved seat or berth for each person on board the airplane who has reached his second birthday; and

(2) An approved safety belt for separate use by each person on board the airplane who has reached his second birthday, except that two persons occupying a berth may share one approved safety belt and two persons occupying a multiple lounge or divan seat may share one approved safety belt during en route flight only.
This fellow may want to let the airline know that it is in their best interest to refund his money...
