James McDonald, "cooljames" on a number of websites and "Jimmy Cash" when answering emails, claims to be an Animal Control Officer who graduated from Rio Hondo Police Academy. So, if he attended police academy, why is he up to his ears in shady financial dealings and running his own cash gifting club in defiance of state law?

Gifting Laws

An individual may give as a "cash gift" up to $12,000 USD total, to as many individuals as that individual desires within a calendar year. While these gifts are non-taxable, and need not be reported to the IRS, there are conditions. In order to be deemed non-taxable, the cash gift must be given without the expectation of receiving anything in return."

Gift taxes are taxes on gifted money or property that supplement the estate tax. Gift taxes are placed on gifts given to any person while you are still living, and only apply on gifts of certain value. Starting January, 2009 a person may gift up to $13,000 in cash or assets to an unlimited number of people each year without incurring gift tax liability. The gift tax exclusion is indexed for cost-of-living.

The concept of private gifting is based upon the fact that both American and Canadian citizens have the Constitutional right to gift property, cash and other assets, and are subject to the rules and regulations established by the laws. The U.S. gifting rules are found in the IRS Tax Code, Title 26, Sections 2501-2504 and 2511.

Hmmmm, in case anybody was wondering...
There are two types of Humane Officers. One is a Level 1 Humane Officer and a Level 2 Humane Officer. They are not peace officers, but have peace officer powers while on duty. They are sworn officers, have full authority to serve warrants, arrest, and enforce animal cruelty state laws per the California Corporations Code 14502. The difference between the two of the positions are Level 1 officers carry on duty and are required to attend a full basic police academy. Level 2 officers do not carry and are only required the PC 832 course. Animal Control Officers and Humane Officers are different positions. Humane Officers are employed by non profit SPCA's and Animal Control Officers are employed by governmental agencies, however some governmental agencies contract with SPCA's for animal control services. The SPCA's are run independently. Some have Humane Officers that striclty investigate animal cruelty and not animal control duties.

Considering that Mr. McDonald also fell for the Apex Catfish Foundation scam (I looked it up after seeing that he'd advertised it last spring, and it was like staring the classic Chinese ant farm ponzi scheme in the face it was so obvious), I am doubtful that he ever passed a class on detective work or forensics in his life. That he cannot do due diligence is as plain as day.
