What business deals? What associates? Will this Massartic clown return from Europe?

One thing that has bothered me from the get go is the car deal and what would somewhat seem to be an otherwise secret "billionaire".

The car story reads almost like an email rumor would in the blogs showing up only on various car and rap sites which is strange. It makes me wonder if Arnaud planted the story and Birdman never bothered to correct it. Why not, it is a pretty good story?

That NO other business deals seem to have surfaced seems rather odd. No doubt there are very rich people that are very private, but then why the story about the car? Why not broker it in a private transaction. If that was the case, all that would be left are the shells.

Why would presumably Arnaud show up here and Rip-Off Report with some half baked answers when if there was a good explanation it could be easily spelled out? Then any business people who suddenly googled him could see a plausible answer. As is, this is very strange.

I checked PACER. No filings today. The Plaintiff's attorney is an interesting character. A Google search for Andrew Lachman shows that he is a political activist and die hard Democrat with political ambitions. He does not seem to be an active litigator by any means. Pages into a Google search showed no cases where he was listed as the attorney of record. Curious.

ORDER DENYING EX PARTE APPLICATION
FOR TEMPORARY RESTRAINING ORDER AND
PRELIMINARY INJUNCTION [5]

This matter is before the Court on Plaintiffs’ Ex Parte Combined Motion for Temporary Restraining Order and Preliminary
Injunction (the “Application”). (Docket No. 5). In support of the Application, Plaintiffs also filed a Memorandum of Points
and Authorities (the “Memorandum”). (Docket No. 5). The Court reviewed and considered the papers filed on this Application. For the reasons stated below, the Application is DENIED without prejudice.

On March 20, 2014, Plaintiffs Arnaud Massartic and Societe Panamerica filed a Complaint. (Docket No. 1). The Complaint includes claims for libel, breach of a nondisclosure agreement, and invasion of privacy, among other claims. On March 21, 2014, Plaintiffs filed the Application. (Docket No. 5). On March 22, 2014, Plaintiffs filed a Supplemental Declaration and Certification of Andrew Lachman in Support of Temporary Restraining Order and Preliminary Injunction (the “Supplemental Lachman Declaration”). (Docket No. 6). None of the Defendants have appeared in this action, and no opposition has been filed….

Defendant began posting false online comments about Massartic.
(Memorandum at 2; Compl. ¶¶29-33). The standard for issuing a temporary restraining order is identical to the standard for issuing a preliminary injunction. Stuhlbarg Int’l Sales Co. v. John D. Brush & Co., 240 F.3d 832, 839 n.7 (9th Cir. 2001); Carrillo v. Schneider Logistics, Inc. , 823 F. Supp. 2d 1040, 1042 (C.D. Cal. 2011). “A plaintiff seeking a preliminary injunction must establish that he is likely to succeed on the merits, that he is likely to suffer irreparable harm in the absence of preliminary relief, that the balance of equities tips in his favor, and that an injunction is in the public interest.” Winter v. Natural Res. Def. Council, Inc., 555 U.S. 7, 20, 129 S. Ct. 365, 172 L. Ed. 2d 249 (2008). Where the balance of hardships tips sharply in the plaintiff’s favor and the plaintiff has demonstrated a likelihood of irreparable harm, however, the plaintiff need only show that “serious questions” exist as to success on the merits. See Alliance for Wild Rockies v. Cottrell , 632 F.3d 1127, 1134-35 (9th Cir. 2011). “A preliminary injunction is an ‘extraordinary and drastic remedy’ . .; it is never awarded as of right.” Munaf v. Geren , 553 U.S. 674, 689-90, 128 S. Ct. 2207, 171 L. Ed. 2d 1 (2007) (citations omitted).

The Application fails for the following reasons:
First , the Application is procedurally defective in that it does not advise the Court of whether any party opposes the Appli
cation, as required by Local Rule 7-19.1. Although the Application indicates that counsel notified Defendant of Plaintiffs’ intent to file the Application and subsequently sent a copy of the Application to Defendant’s counsel, it lacks information on whether counsel attempted to ascertain opposing counsel’s position. (See Application at 4; Declaration of Andrew Lachman ¶ 4 (Docket No. 5); Supplemental Lachman Decl. ¶¶ 4-6). Although Defendants have not appeared in the action, as noted above, Plaintiffs’ counsel was contacted by an attorney identifying himself as counsel for Defendant, and thus, had the opportunity to inquire if Defendant would oppose this Application. (Supplemental Lachman Decl. ¶¶ 4-6). Nonetheless, the Court assumes that Defendants oppose the requested relief, and therefore now turns to the substantive reasons for the denial.

Second, the Application fails substantively because it lacks any discussion of whether the requested temporary restraining order and preliminary injunction would be a valid prior restraint under the First Amendment. The Application seeks a temporary restraining order and preliminary injunction that would enjoin Defendant from posting on Internet websites or otherwise publishing two categories of information: (1) confidential information that he obtained from his prior business relationship with Massartic; and (2) libelous comments regarding Massartic’s business activities and purported criminal activities. (App. at 1-2). Because the temporary restraining order would restrain Defendant’s speech activities, it is considered a prior restraint. See Alexander v. United States , 509 U.S. 544, 550, 113 S. Ct. 2766, 125 L. Ed. 2d 441 (1993) (“Temporary restraining orders and permanent injunctions—i.e.,court orders that actually forbid speech activities—are classic examples of prior restraints.”); Oakley, Inc. v. McWilliams, 879 F. Supp. 2d 1087, 1089 (C.D. Cal. 2012) (“Injunctions against any speech, even libel, constitute prior restraints. . . .”).

Such prior restraints come before the Court “with a ‘heavy presumption’ against its constitutional validity.” Org. for a Better Austin v. Keefe , 402 U.S. 415, 419, 91 S. Ct. 1575, 29 L. Ed. 2d 1 (1971). Indeed, “prior restraints . . . are the most serious and the least tolerable infringement on First Amendment rights.” Neb. Press Ass’n v. Stuart, 427 U.S. 539, 559, 96 S. Ct. 2791, 49 L. Ed. 2d 683 (1976).

“The threshold question in such cases is whether the injunction, taken as a whole, is content-based or content-neutral.” W. Schwarzer, A.W. Tashima & J. Wagstaffe, California Practice Guide: Federal Civil Procedure Before Trial , Ch. 13-C, § 13:65.2 (The Rutter Group2014) (collecting cases). A content-neutral regulation is made “without reference to the content of the regulated speech.” Madsen v. Women’s Health Ctr., Inc., 512 U.S. 753, 763, 114 S. Ct. 2516, 129 L. Ed. 2d 593 (1994). In contrast, the requested temporary restraining order and preliminary injunction here are content-based because their scope is determined by the content of the anticipated speech. The requested injunctive relief would extend only to speech disclosing confidential information and certain allegedly libelous comments. A content-based restriction is subject to strict scrutiny, and thus, must be “necessary to serve a compelling state interest and [be] narrowly drawn to achieve that end.” Madsen, 512 U.S. at 761 (1994) (citing Perry Ed. Ass’n v. Perry Local Eudcators’ Ass’n, 460 U.S. 37, 45, 103 S. Ct. 948, 74 L. Ed. 2d 794 (1983)).

The Application includes no discussion as to whether the requested temporary restraining order and preliminary
injunction can survive strict scrutiny.

Third, the Application fails substantively because Plaintiffs have not established irreparable harm. Plaintiffs assert that Defendant’s comments are irreparably harming Massartic’s business reputation. (Memorandum at 5-6). Plaintiffs further assert that because of Defendant’s comments, several of Massartic’s business deals have been put on hold or canceled and Massartic has been forced to return to Europe to explain what is going on. (Memorandum at 5). The usual rule is that “‘equity does not enjoin a libel or slander and that the only remedy for defamation is an action for damages.’” San Antonio Cmty. Hosp. v. S. Cal. Dist. Council of Carpenters, 137 F.3d 1090, 1092 (9th Cir. 1998) (quoting Cmty. for Creative Non-Violence v. Pierce, 814 F.2d 663, 672 (D.C. Cir. 1987) (the seminal case for this proposition));
see also Balboa Island Vill. Inn, Inc. v. Lemen, 40 Cal. 4th 1141, 1155, 57 Cal. Rptr. 3d 320 (2007) (holding that equity will not enjoin libel or slander, absent an adversarial determination that the speech in question is unlawful). It is thus unclear to the Court why monetary damages would not be adequate to reimburse Massartic for any business deals that have been stayed or put on hold, and for the money he is spending to manage the harm to his reputation.

Accordingly, the Application is DENIED without prejudice.
IT IS SO ORDERED.

Strike 1! Will Massartic be willing to go forward and produce the documentation to prove his damages? This could get very interesting!

What a buffoon. No legitimate businessman conducts themselves in this manner publicly. Massartic might want to chat with the others who have lost their tempers online and made fools of themselves. Charles Gregoire de Rothschild has disappeared entirely and likely can't cut a deal to purchase a soda. Jack Weinzierl is once again unemployed and was stupid enough to admit in court that he couldn't get a job because of his internet reputation. Weinzierl claimed Advantage Conferences lost 95% of its business due to online bloggers. Don Allen Holbrook has been reduced to selling timeshares. Definitely a brilliant idea to draw attention to the fact one has critics.

Arnaud, darling, I assume you are the poster, bvh2014, that responded on the first page of the thread. I don't respond to folks that offer me court docs in exchange for my silence when I know perfectly well said docs are public record and that I can publish them whenever it suits me. Why would I sign a non-disclosure agreement?

If the original poster had made statements that could be refuted, then why has that not happened? If there are any false statements of fact or things that are twisted in this thread, then lets have some verifiable documentation and get those things corrected. That is the same offer I make to anyone who complains (though by law the site is not responsible for what is posted by third parties.)

Strange stuff does abound, but I am very careful to only comment on things that I can research, which is why I choose to comment on the particular things I did. No doubt the humongous case will be most enlightening.
